There is no Freedom of Panorama in the Philippines. This image infringes on the copyright of the author of the depicted architectural work, Pimentel Rodriguez Simbulan & Partners.

English Wikipedia can import this image to their local site though, since enwiki since 2012 is not obliged to respect the laws of 110+ no-FoP countries like the Philippines and is only obliged to follow U.S. law only (1976 U.S. Copyright Act as codified under Title 17 U.S. Code), which does permit the public to exploit buildings without permissions from the architects (even if the authorities and architects of those 110+ countries contest/protest). There's no automatic freedom of panorama under US copyright law for 3D works of art (e.g. sculptures) installed after January 1, 1978 even in cases where such works are publicly displayed and can be freely photographed. Photographs of such works are threated as COM:DW by Commons which means that the copyright status of not only the photo of the work but also the original work itself needs to be considered. So, without knowing more about the en:provenance of this particular work, it should be treated as still under copyright protection and photos of it can't be hosted by Commons with some way of verifying the COM:CONSENT of the person (i.e. the artist) who created it.

According to the Wikipedia article en:James McKay Sr., this bust of McKay is installed somewhere on the en:Tampa Riverwalk, which was established in 1989. Of course, it's possible the bust pre-dated the riverwalk, but en:Tampa Riverwalk#Historical Monument Trail states the bust was one of six commissioned in 2012 as part of the beginning a new project. Although no attribution of the artist who created the bust was provided, but from this page it looks likes all of the busts were commissioned by the Friends of the Tampa Riverwalk, which appears to be made up of various private individual and organizations; so, the busts don't seem to be anything that might be {{PD-FLGov}}.

More information about the bust can be found here (scroll all the way down to the bottom of the page), which furthers states the monument was made possible "by the generous contribution of the Bright House Networks and the Hillsborough County" and the bust was dedicated in 2012. So, even though it's not clear whether this was a en:work for hire or whether the artist retained all or some of their copyright ownership over it, I think it's safe to assume that this is still under copyright protection at least until 95 years after first publication or 120 years after creation (whichever is lesser), and images of it can't, therefore, be hosted by Commons without some verification of copyright holder consent. -- Marchjuly (talk) 01:32, 13 December 2024 (UTC)[reply]

  • A councilman of an unidentified city. Maybe someone can identify the city by recognizing the background. I'd keep this as a very good portrait even if he's not very notable, but only if there's no copyright problem. This file was initially tagged by Intervex as Copyvio (Copyvio) and the most recent rationale was: A week-or-so ago I contacted the Anishinabek Nation asking who created their logo and when. Today I got a response stating: "The designer of our Thunderbird logo (for which we have legal copyright for) was Nick Deleary. Miigwech - mb". This is supported by [1] [2]. I don't know whether the Fex logo is above COM:TOO Germany. It might be. I note that a file of the logo, File:FEXNoBackground.svg, is made available under the Creative Commons CC0 1.0 Universal Public Domain Dedication and is COM:INUSE in several articles about the band, but User:Edwinhermann, who uploaded that file, does not seem to have explained what his association is with the band and why he would have the authority to license their logo.
