WhatsApp University is a phrase which refers to the fake news and misinformation spread in India through WhatsApp forwards.[1][2]
The phrase has gained a popular meme status and been a subject of stand-up comics.[3]
Usage
Politics
The phrase is generally used by political dissenters to refer to the Bharatiya Janata Party and Modi government.[4][5][6]
Courts
In May 2022, Kerala High Court dismissed a PIL, alleging forceful vaccination of children in schools based on social media rumours. It remarked, “Don't go by this WhatsApp University. You are here with a speculative cause of action. We are not going to create confusion in the minds of people.”[7]
Government response
On 26 May 2021, the Govt of India characterised WhatsApp's refusal to comply with Indian regulations as a clear act of defiance. It said while WhatsApp aims to share user data with Facebook for marketing purposes, it rejects the Intermediary Guidelines designed to combat fake news and maintain law and order. WhatsApp defends its stance by pointing out that messages on its platform are end-to-end encrypted. However, tracing the origin of information is mandatory for all social media intermediaries. The Indian government seeks to protect citizens' privacy and ensure public order, and it is WhatsApp's responsibility to find a technical solution that satisfies both objectives. Despite being a significant social media intermediary, WhatsApp seeks safe harbor protection but avoids the necessary steps for its enactment. This contradictory approach undermines accountability and hampers the government's regulation of the digital space. Thus, WhatsApp's refusal to comply with the guidelines while seeking safe harbor protection is a perplexing contradiction. WhatsApp must recognize its responsibilities and find a technical solution that safeguards user privacy while addressing the government's concerns regarding law and order, fake news, and national security.[8][9]
