Austin Police Department (APD) is the principal law enforcement agency serving Austin, Texas, United States. As of Fiscal Year 2010, the agency had an annual budget of more than $283 million and employed around 2,300 personnel, including approximately 1,600 officers.[1] Art Acevedo was appointed as the APD's eighth chief of police in June 2007.[2]

Official misconduct
In December 2010, SWAT Team Officer Michael Hamilton crashed his unmarked police car while driving. While on-call, Hamilton and other members of the department’s SWAT team were drinking at a party. In May 2011, Hamilton was fired and six others received suspension of between five and fifteen days. [5]
In February 2011, Officer Joshua James Peters was indicted on two charges of official oppression. He pleaded guilty agreeing to surrender his peace officer’s license. The charges were related to the officer peeking into windows of homes while on duty.[6]
In February 2011, Officer Blayne Williams assaulted an elderly man after an off-duty dispute concerning a line at an automated teller machine (ATM). Williams was indicted on a charge of assault on an elderly person, a Class A misdemeanor in May. In September, he was suspended for ninety days.[7]
In August 2011, Officer Michelle Gish was responding to the scene of a traffic accident when she slapped a woman who spit on her while she was strapped down to a gurney. Another officer on the scene, Jose Robledo lied to investigators. Both were fired in February 2012. Two other officers were suspended as a result of an investigation.[8] A lawsuit was filed against the City of Austin, Elisa Jaimes, and Jose Robledo regarding the Incident.[9]
In September 2011, Officer Danny Johnson was suspended for ninety days when his dashboard camera showed him being "rude and condescending" to a citizen.[10]
In December 2011, Officer Christopher Allen fired a total of 14 shots at the suspect as he drove away, putting neighbors and other officers in danger. Chief Art Acevedo reviewed the investigation and said, “Officer Allen's version and account of what occurred was completely not aligned with what the evidence and the facts showed." Allen was fired in April.[11]
On January 1, 2012, Officers Patrick Oborski and Robert Snider used force against and arrested two individuals. The first individual was a passenger in a car that was pulled over for a suspected DWI and was then arrested for Public Intoxication. The second individual, Antonio Buehler was a bystander who witnessed what he alleges was abuse against the first individual, and was then arrested for Felony Harassment of a Public Official and Resisting Arrest. However, multiple witnesses came forward alleging that the police officers fabricated the charges against the two arrested individuals, with one of those witnesses providing cell phone video evidence. Despite numerous witnesses, the cell phone video, the dash cameras and audio from both Oborski and Snider's vehicles, and a 7-Eleven surveillance video that exposed the misconduct and lies of the police officers, they were never disciplined for their actions. Buehler currently has a pending civil suit against the two officers, as well as other police officers in the Austin Police Department, and the City of Austin.[12][13][14][15]
In March 2012, Officer Elias Osegueda was charged with assault with family violence and interference with an emergency call. He was fired in July.[16]
On April 14, 2012, Officer Thomas Griffin shoots a dog named Cisco when he went to the wrong address during a call.[17] The news of the shooting became national news and Chief Art Acevedo ultimately gave a luke-warm apology on a local radio show.[18] Despite claims that they would change their policies, APD has killed numerous dogs since the Cisco killing, including Shiner Bock, whose owner Julian Reyes has become a police accountability activist.[19][20] The Austin Police Department eventually implemented "sensitivity training" in 2014 to try to curtail puppy killings, making it the butt of jokes nationwide.[21]
In June 2012, Officer Randall Keith Ballard was sentenced to a year in jail for failing to pay taxes on portions of his income.[22]
In July 2012, Corporal Luis Soler used a Taser to stop a handcuffed suspect from running away. He was suspended for five days.[23]
On 2 February 2013, Officer Manuel Garcia was detained in a downtown parking lot known for drug use and prostitution. He was charged with soliciting a prostitute and was fired in May 2013.[24]
On March 14, 2013, Corporal Rickey E. Jones threatened a member of the Peaceful Streets Project for filming him. He was given a 10-day suspension. [25][26]
On March 27, 2013, Officer Brian Yarger intentionally kicked a handcuffed suspect. He was given a 5-day suspension. [27]
In March 2013, Officer Shawnn Williams investigated an accident and allowed a drunk driver to go free. He failed to mention the driver in his report. Five months later he was suspended for five days.[28]
In May 2013, Officer Justin Boehm shot at, and missed James Barton, 55, who was reaching for his wallet during a traffic stop. In September, Officer Boehm was fired.[29][30] A grand jury declined to indict the officer.
On July 26, 2013, Detective Charles Kleinert killed Larry Eugene Jackson, Jr. after Jackson had twice tried to enter a closed bank that had been robbed earlier in the day. After misidentifying himself to a bank employee as an account holder that the bank manager knew personally, she asked Kleinert to speak with him. While questioning Jackson about his statements to the bank employee, Jackson ran. Kleinert pursued him, chased him under a bridge, where Kleinert's gun unintentionally discharged during a struggle. The investigation into this incident was closed in September 2013. [31][32] In May 2014, Kleinert was indicted and charged with manslaughter in connection with Jackson's death.[33] [34][35][36][37][38]
In August 2013, press reports indicated that Officer Jesus Borunda was suspended for three days for using an official database for personal use.[39][40]
On October 13, 2013, while transporting a prisoner from a hospital to booking, Officer Leonard Wheeler failed to secure a prisoner who then escaped. Wheeler failed to notify communications or his chain of command upon becoming aware the prisoner had escaped, and did not notify his Sergeant until after the prisoner had been recaptured. He was given an 11-day suspension.[41]
On October 21, 2013, Officer Frank Corpus walked up to a movie theater, flashed his APD badge, and told the employee he worked there in order to sneak in to watch a movie for free. Corpus was fired from APD.[42]
In November 2013, the media reported that Officer Jermaine Hopkins had been suspended sometime earlier that year for failure to follow proper procedures during an arrest.[43]
In January 2014, press reports indicated that Officer Ricardo Zapata had been fired after being caught driving while drunk. Officer Zapata plans to appeal his firing. [44]
In January 2014, Officer Jermaine Gaspard pleaded guilty to federal charges of lying to investigators. He gathered information from an official database and showed it to a person under suspicion of credit card fraud. He may face up to five years in jail.[45]
On February 14, 2014, Police Chief Art Acevedo gave a press conference to respond to critics who were complaining about the arrest of a woman who was jogging near the University of Texas for Failure to Identify. During the press conference Acevedo said, "In other cities, cops are actually committing sexual assaults on duty, so I thank God that this is what passes for a controversy in Austin, Texas," which infuriated critics.[46][47]
On April 26, 2014, Officer Gustavo Guzman was arrested in College Station for urinating in public near a vehicle with an unidentified woman in it.[48]
October 29, 2014, after an unprecedented four-day Class C Misdemeanor trial that spanned a full calendar week, Antonio Buehler was acquitted of charges and found not guilty of failing to comply with the order of a police officer on New Year’s Day 2012." During the trial, Officer Patrick Oborski admitted that the alleged spit may not have been intentional, which would have been a requirement for his felony charge against Buehler. Meanwhile, Officer Robert Snider admitted to threatening a bystander from across the street for being out at 2 a.m., on New Year's. [49][50][51] The trial was unique not only in its duration, but also in the resources invested into it by the state; the state had eight prosecutors in the courtroom and over a dozen police officers--including two Assistant Police Chiefs.[52][53][54][55]
October 30, 2014, a local attorney leaked dash cam video from a police investigation in which Officers Mark Lyttle and Michael Castillo joke about raping a woman who was walking by. In the dash cam video, you can hear the cops say, "Go ahead and call the cops. They can’t unrape you." [56][57][58] Lytle was suspended for five days without pay, and Castillo received a three day suspension.[59]
