  • While we know authorship of this photograph, we do not know that it was published prior to 1923, as asserted in its PD rationale. According to [1], Choate's photographs were likely collected by teachers at the school where he took them and were donated to the National Anthropological Archives in 1966 and 1973. As Wikipedia:Public_domain#Unpublished_works notes, many family photos are unpublished works, and being owned by an archive doesn't make them PD. I believe we need information on publication of the photograph to retain it. This is part of a CCI, so the uploader is being notified at Wikipedia:Contributor copyright investigations/20141020 in courtesy rather than directly at his talk page.   • It is usually possible to obtain a photocopy of a photograph held by an archive if you contact the archive. According to s:Letter Edged in Black Press, Inc. v. Public Building Commission of Chicago, a public artwork is published (under pre-1978 law) if the public can inspect the work and take photographs of it. Wouldn't this mean that a photograph which is publicly accessible in an archive before 1978 typically also becomes published when the archive first makes it publicly accessible? How do you determine if this publication was with or without a copyright notice?
This page suggests that the photographer died in 1902. If we can determine that it wasn't published at all before 2003, then the photograph should be fine. However, if it was first published at the archive in the 1960s or 1970s, the term becomes 95 years from publication, regardless of the year of creation. Unfortunately, the 1960s and 1970s were less than 95 years ago. --Stefan2 (talk) 22:23, 18 November 2014 (UTC)[reply]
