Tadvi family writes to CM to revoke order removing SPP in suicide case

The family members of Dr Payal Tadvi, who died by suicide in 2019, allegedly due to harassment by her seniors, have written to Maharashtra Chief Minister Devendra Fadnavis, seeking revocation of a notification, which removed special public prosecutor (SPP) Pradip Gharat from the trial in the case.
In her letter to the CM, Payal’s mother Abeda sought reappointment of Gharat as SPP till the trial concludes and she gets justice. On March 7, the law and judiciary department issued the notification to cancel the appointment of Gharat with immediate effect and appointed another lawyer as the SPP. The trial in the case against Payal’s three seniors — Dr Bhakti Mehare, Dr Ankita Khandelwal and Dr Hema Ahuja — is yet to begin.
In February, Gharat moved an application to add as accused, the then gynaecology department unit head at the TN Topiwala National Medical College and BYL Nair Hospital where Tadvi was studying in 2019. Gharat said in the plea that Dr Yi Ching Ling, had overlooked the harassment and ragging complaint made by Tadvi, including on the basis of her caste, as she belonged to the Tadvi Bhil community, a Scheduled Tribe.
Abeda’s letter states that according to the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, the prosecutor is appointed as per the request made by the complainant.
“However, I was not given any prior indication or notice about the decision to remove the special public prosecutor,” stated the letter dated March 10.
