What To Do If You Are Injured On The Job
If you have been injured on the job, there are specific steps you must take to ensure you remain eligible for workers’ compensation insurance protection. These steps include:
- Report the injury immediately: Any type of injury should be reported immediately. You and the supervisor should complete the proper paperwork to begin the claim process.
- Seek medical care: Regardless of the type of injury, make sure a medical professional examines you. This ensures your condition and injury are documented, and any medical treatment is received. Delaying treatment could hurt your claim.
- Document everything you remember about the event: This information will be very relevant to your case once the claim process begins. Write down everything you remember, from witnesses and the cause of the accident to the time and weather, if relevant, and any information about your injury when it occurred and prior to medical treatment.
- Follow medical directions: It is very important for you to follow all medical care directions and make all medical appointments. Workers’ compensation adjusters will assume you are no longer in need of medical care or that you do not want to make a full recovery from your injury if you do not follow medical care instructions.
- Do not refuse light-duty options: If your employer can provide you with light-duty options for your job, you must make an effort to return to work. If you return and it is too physically demanding for your condition, speak with your attorney, so they can immediately notify the workers’ comp adjuster. Failure to comply with light duty work, if offered, however, can result in a termination of benefits. It is always in your best interest to at least try light-duty work.

How Are Workers’ Compensation Payments Calculated?
Nevada law regarding workers’ compensation states that workers’ compensation will pay 66-1/3 percent of your average monthly wage. These benefits are automatic when you are injured, and your injury will keep you out of work for an extended period of time. There are no state minimums for wage reimbursement.

Are Workers’ Comp Settlements Taxed?
One common question people ask about workers’ comp is, “Are workers’ comp settlements taxed?” In most cases, workers’ compensation settlements are not taxable. Nevada does not have any income taxes, so there would be no tax liability owed to the state. At the federal level, Title 26 of the Internal Revenue Code lists exceptions for taxable income when compensation is received for injuries and illnesses, including workers’ comp settlements.
When Can I Sue For Workers’ Comp?
Usually, you cannot sue your employer when you file a workers’ compensation claim. However, if your employer is refusing to pay for your medical expenses or pay your wages while you recover, you can sue them. There are specific rules and processes that employers are supposed to adhere to. Unfortunately, some employers attempt to cheat the system.
Some employers may even attempt to have you forgo filing a workers’ comp claim. When your employer does not comply with the law, it is important to get help from our injury attorneys as soon as possible.

What Does Workers’ Comp Law In Nevada Require Of Employers?
Nevada workers’ compensation law requires all employers with one or more employees to have workers’ compensation insurance. Workers’ comp is considered a no-fault insurance coverage, meaning even if the employee is partially or fully at fault for their injuries, they can claim workers’ compensation when injured on the job. The insurance coverage also affords employers certain protections from being sued.
Should an employee be injured while on the job, it is their responsibility to report the accident and injury within seven days. However, it is better to report it immediately to ensure the claim is not denied. Additionally, employees have up to 90 days to file their insurance claim with the workers’ compensation insurance company. The insurance company can take up to 30 days to decide whether to approve or deny the claim.
Depending on the extent of injuries, employees may be required to continue to work at a reduced capacity or in a light-duty position. Refusing to do this can result in claim denial. In the tragic event where an employee dies while on the job, death benefits can be available to the surviving family members.
