Probate Recording Department

The Recording Department of the Elmore County Probate Office handles the recording, indexing and preserving of permanent public documents, including real estate records and business entity records. This also includes recording marriage certificates and the appointments of notary public.

OFFICE HOURS AND CONTACT

Office Hours are Monday thru Friday: 8:00 a.m. - 4:30 p.m. except County recognized Holidays

Documents are accepted for recording from 8:00 a.m. to 4:00 p.m.

Documents submitted for recording after 4:00 p.m. will be recorded the next business day.

• Please provide a self-addressed and stamped envelope for any documents which are to be returned.
•  All deeds to be recorded must have a completed Alabama RT-1 form attached or must have all required RT-1 information set out in the deed. The RT-1 form is available at this link: Click Here
•  All documents which require the name of the Preparer, specifically including Documents which transfer an interest in Real Property, must include the name and address of the individual who prepared the documents. Corporate or Business names are not accepted. Documents not containing this information may be rejected for recording. Alabama Code 35-4-110 (1975)
•  All documents which transfer any interest in Real Property must contain the marital status of the Grantor or Grantors. Documents not containing this information may be rejected for recording. Alabama Code 35-4-73 (1975)

BUSINESS ENTITIES – Effective January 1, 2021, all Business Entity recordings in Alabama are filed directly with the Alabama Secretary of State and not with the local Probate Office. For Business Entity fees or information regarding Business Entity Recording contact the Alabama Secretary of State.

MARRIAGE CERTIFICATES

Alabama Marriage Certificates are accepted for Recoding in Elmore County. 

The filing fee for each Marriage Certificate is $80.00.

NOTARY PUBLIC - ELMORE COUNTY, ALABAMA
Effective: September 1, 2023

The office of Notary Public is a serious and responsible public office and should not be taken lightly. Abuse of the office or irresponsibility in the performance of notarial duties can result in grave consequences and in a felony conviction. If a Notary Public has doubts about the propriety of any action, he or she should seek competent professional advice before he or she acts.

Requirements to be appointed a Notary Public by Elmore County Judge of Probate

1.   Must be a resident of Elmore County, Alabama;

2.   Must be 19 years of age or older;

3.   Must complete required Notary Training and furnish Certificate of Achievement;

NOTE: Licensed Attorneys are exempt from Notary Training and may submit proof of being a Licensed Attorney in lieu of Certificate of Achievement.

4.   Must be able to acquire and furnish a $50,000.00 Commercial Surety bond from an Insurance Company or Surety Bond Company payable to the State of Alabama;

5.   Must submit $41.00 filing fee payable to Judge of Probate;

6.   Must not be currently a debtor in Bankruptcy;

7.   Must not have been convicted of a Felony or Crime involving Moral Turpitude.

All Applications must include the following:

1.   Fully Completed and Executed Authorized Application;

2.   Certificate of Achievement of Notary Training or proof of Attorney Status;

3.   Legible Copy of Current Alabama Driver License or Non-Driver ID with Elmore County address;

4.   Filing fee of $41.00 payable to Judge of Probate;

5.   $50,000.00 Surety Bond payable to State of Alabama;

6.   A Self-addressed and stamped envelope for return of Appointment Document.
