Paul, Weiss achieved a complete defense verdict for AbbVie Inc. in a products liability suit relating to AbbVie’s testosterone replacement therapy, concluding a two week trial in state court in Cook County, Illinois.
The win for AbbVie came in a bellwether case that will help decide the disposition of thousands of similar lawsuits. The plaintiff alleged that he suffered a heart attack as a result of using AbbVie’s AndroGel product, that AbbVie improperly marketed AndroGel for conditions it was not approved to treat, and that AbbVie inadequately disclosed risks of cardiovascular disease associated with AndroGel. The jury found AbbVie not liable on all counts after deliberating for an hour.
