Hindi man nagtagpo si Sandro Muhlach at ang GMA-7 independent contractors na sina Jojo Nones at Richard "Dode" Cruz sa Senate hearing, hindi naiwasang magkaharap sila sa first hearing na ginanap sa Department of Justice (DOJ) nitong Huwebes, September 12, 2024.
Kinailangang dumalo nina Nones at Cruz dahil isinumite at sinumpaan nila ang kanilang counter-affidavit kaugnay ng mga reklamong rape through sexual assault at multiple counts of acts of lasciviousness na isinampa ni Sandro laban sa kanila.

NONES AND CRUZ SUMBIT THEIR COUNTER-AFFIDAVIT
Nakakuha ang PEP Troika ng kopya ng counter-affidavit nina Nones at Cruz.
Pero sa official statement na ipinadala ng kanilang legal counsel na si Atty. Maggie Abraham-Garduque, halos ito rin ang nakapaloob sa isinumite nilang counter-affidavit.
Nakasaad ditong layunin nilang ma-dismiss ang mga reklamong inihain ni Sandro dahil wala umanong mga ebidensiya na ginawa ito ng kanyang mga kliyente.
Saad ni Atty. Garduque: “We are moving for the dismissal of the case for rape through sexual assault and acts of lasciviousness filed in DOJ.
“Wala namang alegasyon si Sandro na may pinasok na ari or object/instrument sa bibig or anal orifice in Sandro.
“Wala rin pong nakita sa medico legal niya. Gayundin, he was not able to establish the qualifying circumstance that he was deprived of reason or unconscious.
"Ang alegasyon niya ay he was drugged and intoxicated, kaya hindi siya nakapanlaban, pero sariling drug test niya negative po ang resulta.

“Nagprisinta rin po kami ng call logs and messages nila ng girlfriend niya at the time that he was at the room showing na nakakapag-text pa siya sa girlfriend niya at nakausap niya ang girlfriend niya while he was inside the room.
“If something bad as rape was happening to him that time, it was the best opportunity to ask help.
“Sa CCTV footages din ni Sandro, makikita na paglabas niya ng kuwarto maayos siya maglakad, his hair was nicely combed and he was properly and neatly clothed eradicating any indication that he was drugged and raped.
“We trust the DOJ that they will decide the case based on merits lalo na at ngayon mas mataas ang quantum of evidence na kailangan to indict a person for a criminal case. As opposed sa dating probable cause, ‘reasonably certainty of conviction’ na po ang requirement ng DOJ.
“If based on evidence ng complainant pa lang mahina na to get conviction, dapat po i-dismiss ang kaso.”

May ilang miyembro ng media ang nakapag- cover sa hearing sa DOJ.
Ayon sa kanila, nag-iba raw ang mukha ni Sandro nang nakita niya sina Nones at Cruz.
Tinanong ng PEP Troika si Atty. Maggie kung ano ang nangyari sa hearing nang magkaharap silang tatlo.
Saad nito, “Sandro seemed to be violent. Kaya I requested to the panel na ilipat ng kuwarto sina Jojo to subscribe.
“Which for us is absurd kasi if he is that angry and violent, why in the CCTV footage after he went out of the room kalmado siya.
“Makikita sa CCTV na maayos siya sa CCTV footages if gusto niya saktan sina Jojo and Richard because of the alleged rape, it should be immediately after the alleged rape.”

Ang pahayag ni Atty. Garduque tungkol sa CCTV footage ni Sandro ay taliwas sa interpretasyon ng behavioral science division ng National Bureau of Investigation (NBI) sa nakitang kilos ng baguhang aktor base sa CCTV footage.
Ayon sa agent on case na si Zulikha Marie Conales, "makikitang nagbago yung kanyang kilos" matapos ang insidente ng diumano'y pangmomolestiya kay Sandro.
Noong papunta pa lang siya sa hotel ng respondents ay "normal at relaxed ang movement ni Sandro."
Pero saad ni Conales, pagkatapos ng alleged incident ay "distressed at very anxious" na ang binata.
Ipinunto rin ng NBI agent na makikitang "balisa" si Sandro dahil sa bilis ng lakad at "bigla na lang siyang umupo sa tabi ng wall" sa tapat ng elevator.
Pagsusuma ni Agent Conales: "This is very consistent sa finding ng bureau na mayroong traumatic event na nangyari doon sa hotel kung saan naka-check in yung dalawang subjects na nirereklamo ni Sandro."

Ani Enzo: “To everyone messaging me, I don't mean to be rude, but right now, I'm struggling to find the right words or feelings to respond.
“I'm also in an indescribably uneasy place after writing down everything that happened, from start to finish. Reliving those moments feels like I'm back in that powerless, deceived state, and with the understanding I have now, it's impossible not to get emotional.
“To anyone else who was a victim of this person, speak up and free yourself. This wasn't our fault; HE TOOK ADVANTAGE OF OUR INNOCENCE.
“I sincerely hope get justice, not just for ourselves, but for the potential victims he may be targeting and everyone he already preyed on.”
