As counsel to plaintiff-appellee Edith Schlain Windsor in the above-
captioned matter, we write to inform the Court that today we filed in the Supreme Court
of the United States a petition for the issuance of a writ of certiorari before judgment with
respect to the pending appeal in this case. A copy of the petition is attached hereto.
In light of the uncertainty surrounding what action the Supreme Court will
take, and because any such action will not be taken until the fall at the earliest, Ms.
Windsor respectfully requests that the schedule currently in place remain in effect.
