1. Background

MCLM holds FCC licenses in the “AMTS” radio service, and competed to obtain those in FCC
Auction 61 against other companies managed by Warren Havens.

Another company controlled or formerly controlled by Donald Depriest that holds FCC licenses
is called MariTEL.

The Havens’ companies challenged MCLM before the FCC based on evidence of violation of
FCC rules, and false statements and withholding key evidence, before the FCC. They also
sued MCLM in several courts: those cases are pending. Previously, a Havens company
contested before the FCC actions by MariTEL and won that case (Depriest and MariTEL, which
he controlled, tried to ban all competitors in the FCC “VPC” license auction, for no good case
and by baseless assertions of fact and law.)

The Havens companies challenge before the FCC of the Depriests and MCLM resulted in a
FCC investigation of the Depriests and MCLM by the FCC Enforcement Bureau. See the links

In pursuit of these cases, the Havens companies obtained directly, or by referrals of others,
various documents, and themselves prepared and submitted various documents to the FCC.

2. Selected Relevant Documents

- This is (or was) an IRS tax lien: Mr. Depriest (who has joint tax returns with his wife, Sandra
Depriest, according to court documents in cases listed below) did not pay the IRS in excess of
“7-figures” as shown by this lien--
- This was during a time period they also took undeserved bidding credit before the FCC in
Auction 61, via their company MCLM, in violation of FCC rules, also in an amount in excess of
7-figures. In both cases, unlawfully taking from the public/ public government.
- Further in this period, Mr. Depriest was also on board of TVA, paid with federal funds by the
personal appointment of then-President G.W. Bush, on recommendation from ranking federal
politicians to whom Mr. Depriest was a major contributor.
- In recent years and at this time (mid 2010), Mr. Depriest and his wife now use Spectrum
Bridge to try to sell all of their MCLM company’s FCC licenses unlawfully obgtained in Auction
61. Spectrum Bridge is also funded, in part, by federal funds: one of its investors is the Telecom
Development Fund, created by the US Congress and funded by interest earned on certain FCC
deposits.
- Said sales are focused on the federal entity AMTRAK, the Southern California Rail Road
Administration (a public, California agency with local, State, and Federal funding) and other
railroad entities with substantial public funding and regulation. Thus far, these public or publicly-
funded rail entities are collaborating with the Depriests before the FCC, and not acknowledging
any of the legal issues underlying the subject FCC licenses and licensees, nor providing in the
legal proceedings any information they have as insiders to their subject transactions with
MCLM. Attorneys involved appear to be knowingly nor negligently aiding and abetting the
wrongdoing.1
- Mr. Depriest also has obtained major annual agricultural subsidies from the US Department of
Agriculture, e.g. see link below on Farm Subsidies.

company with assets and business acquired by MCLM. In this case, Day sued Mobex and
obtained a judgment but Mobex could or would not pay. Day stated it discontinued operations
of the Mobex FCC licensed stations that Day managed (since Mobex would not pay what was
due). However, later in an FCC proceeding Day told the FCC that effectively it had not
discontinued these stations, apparently for the reason Day earlier told the Havens companies
directly: Day desired to be paid by Mobex’s successor, MCLM, the amount of its court judgment
based on the licensed stations, then owned by MCLM, being sold. FCC finding of
discontinuance would have undercut Days interest in being paid, apparently. The sworn facts in
the court documents, however, are persuasive evidence.
