TERMS AND CONDITIONS


1. Advance Payment: - Secured advance, Moblization advance and machinery
advances may be paid as per CPW code.

2. Amount retain under defect liability


As the provision of manual the maximum defect liability of the contractor may not be
exceeded from 10% of the total contract value.
We also know and assume the contractor’s profit which is 10% of total value of any
contract.
This is not justified to retain the amount more than 10% at any stage of the contract as
per your document s it has mentioned as follows:
1: Security deposit in advance 5%
2: Withheld as per clause (form 15) 10%
3: finishing testing of whole work 7% .
Total 20%
This will make a bad impact on our cash flow and will create an extra price loading in
offer.
In our opinion to simplify this you can modify the payment schedule in following
manner:
1: Retention of 10% amount under clause 15 of contract should be retained after the
adjustment of 5% of security deposit + 5% from R.A bills.
2: Amount retains for filling and testing (trial period) 7% should be deleted from break
up schedule of payment. This amount may be retained from clause 15 because this
retained amount is sufficient for contractor’s liability which is maximum of 10% of
contract value as per norms.

3: Period for approval of drawing & design: Drawing and design shall be approved
within 15 days of submission.

4: Revision of drawing and design: should be considered for approval.

5: Bank Protection: The bank protection work will be done by the way of providing
cement concrete panel pitching including construction of toe wall suitable to retain
entire bank protection work bad slope cutting embankment the slope cutting of bank
shall be done in the stable slope in 10m upstream and 10m downstream or as per
design requirement.

6:Land acquisition: Land acquisition should be done by the department before


agreement for working area, approach roads for both banks and submergence area.

7: Time allowed for completion: This is a river valley project so it is not possible to
continue in Rainey seasons so time for completion shall be 15 months excluding Rainey
season.

8:Depth of foundation :
1. As per your contract data - The depth of foundation / cut off wall below the scour
line shall not be les than 1.2 meters. The depth of embedment shall exclude that
portion of rock which is weathered for fissured.
As per our suggestions –The depth of the foundation shall extend to the depth of at
least 0.60 meter in hard rock
2. Extra depth from the proposed depth of foundation given in NIT, quantity shall be
paid at 15% above the rate in USOR of W.R.D. with effect from 01.02.2009
amended up to date of issue of N.I.T with price escalation.

9: Under Water Concrete:As per your contract data - For laying foundation concrete
under water, it shall be done by skip boxes centremie pipe, pumping out of water shall
not be done be permitted from the time of placing of concrete up to 72 Hrs thereafter.
As per our suggestions -1. In case of under water concrete 10% extra cement will be
added for same mix as used for dry conditions. The concrete should have slump not less
than 100 mm for easy flow on depositing by approved method.

10: Cement Concrete: as per your contract data –


1. At page 28-29/ clause 4.6-The material for foundation shall Be M-10 plum concrete
encased all around by M-25 grade R.C.C. structure of minimum thickness of 20 cm only
2. At page 36/ clause C.9- The foundation, sill and superstructure shall be comprised of
plum, concrete and reinforced cement concrete. The plum concrete shall be in M-15
grade with maximum of 100 mm plum not more than 50%. The maximum size of
aggregate M-15 concrete shall be 40 mm. The plum concrete structure shall be encased
all around by M-25 grade RCC structure of minimum thickness of 20 cms with required
reinforcement for temperature and other stress.

As per our suggestions - The grade of concrete in foundation for leveling coarse may be
min. M-10, but as per recommendation of IS:456-2000 in hearting portion it will be M-15
with 25% plum, the size of stone plums may be from 150 to 300 mm. The maximum
dimension of these stones or plums shall not exceed 1/3 rd of the least dimension of the

members. The superstructure will be encased by minimum 30 cm thick layer of M - 25
R.C.C. with minimum reinforcement of 0.30 % of cross sectional area of concrete
encasing all over the body of anicut up to top level with construction of R.C.C. piers.

11: Treatment of Foundation: Consolidated grouting with testing for water loss will
have to be done by us but quantity shall be paid at 15% above the rate in USOR of
W.R.D. with effect from 01.02.2009 amended up to date of issue of N.I.T with price
escalation.

12: Approval of Drawing and Design :


As per your contract data – 1.At page 30/ clause B.9- Detailed drawing and design of
geological, hydraulic and structural requirement for anicut structure, bank protections,
key wall, wing walls, up stream and down stream protection and energy dissipation
works etc shall be submitted along with the main structural design duly checked by the
relevant department of the Govt. Engineering collage.

As per our suggestions - It is part of liability of department to checkout design and


drawing .No payment will be deducted from us against checking.

13: Testing : In our opinion one full flood made all worst combinations for testing so
passing of one rainy season is sufficient for defect liability in place of two Rainey
seasons.

14: any modification, addition and alteration to the design and structure to meet
such requirements if needed will have to be done by us but quantity shall be paid at
15% above the rate in USOR of W.R.D. with effect from 01.02.2009 amended up to date
of issue of N.I.T with price escalation.

15: The wall of pump house may be 20cm thick in brick masonry.
