TERMS AND CONDITIONS

The 3T Challenge (Contest)

1.

This Contest is being organized by Aditya Birla Group (hereinafter referred to as Organizer) in
association with Fountain Head Entertainment, and is open for participation for individuals and a
maximum group of 3 individuals, who are citizens of India between 15 (Fifteen) to 25 (Twenty
Five) years of age, pursuing either an under-graduate or post graduate course and having a valid
college ID proof.

2.

A single Participant taking part in the Contest from multiple ids shall be disqualified from
participating in the Contest and winning any Prize(s) under the Contest.

3.

Information as available on the Contest page shall be the only authentic and valid source of
information about the Contest. Organizer shall not be responsible for any incorrect / misleading
information relating to the Contest, presented / displayed on any other source other than the
Contest page as specified above. Organizer shall not be liable for any loss suffered by any
Participant based on the representation, terms, conditions, information presented / displayed on
any other source other than the Contest page as specified above.

4.

Organizer shall not be responsible or liable in case any person is unable to participate on account
of his/ her inability to access the Contest links as specified above, due to connectivity/ network
issues or any other reason, whatsoever.

5.

There is no entry fee or participation fee payable by the Participant for participating in this
Contest. Organizer or any of its officers, employees or agents, shall not accept any form of
payment (whether in cash or in kind) from any of the Participant interested in participating in the
Contest.

6.

The Participants shall not be entitled for the Prize(s) as set out herein below simply by reason of
giving the right answers. The response submitted by the Participants will be evaluated by a jury
panel appointed by the Organizer, or in such other manner as determined by the Organizer, at its
sole discretion. The selection process may be revised and shall be as per the Organizers sole
discretion. Neither the Participant nor any third party shall have any right to question the process
of selection followed/ adopted by the Organizer. In the event there is a tie between two or more
Participants as the final Winner(s) of the Contest, then the same shall be resolved through a
random draw, to be conducted in the manner determined by the Organizer at its sole discretion.
No correspondence, clarification, explanation in this regard shall be entertained by the Organizer.

7.

The Contest shall commence from January 15, 2015 and shall conclude on February 10, 2015 or
on such other date as decided by the Organizer in its sole discretion (Contest Period). Any
entries received after the Contest Period shall not be entertained and shall be considered
ineligible for the Contest.

8.

The

entries

submitted

for

the

Contest

should

fulfill

the

following

requirement:

9.

(a)

The

idea

submitted

is

required

to

be

an

original,

feasible

concept.

(b)

The entry for the Contest should not exceed the limit of 5 slides in PowerPoint or 5 pages in
Microsoft Word/PDF.

During the Contest Period, the Organizer shall select various Participants who have submitted
their entries and declare them to be the winners of the Contest (each a Winner and
collectively, the Winners) who shall be entitled to win prizes (each a Prize and collectively,
the Prizes), in the following manner:
(a)

Top 12 entries from different cities across India, shall be eligible to meet and greet with
the Pilot of Solar Impulse 2, tour of the plane & an Apple Ipad subject to their availability
and at any date, time and venue as indicated by the Organizer from time to time. The
Winners shall be announced at any time between February 16, 2015 and February 28,
2015;

(b)

The first and second runner-ups shall each shall be eligible to meet and greet with the
Pilot of Solar Impulse 2, tour of the plane;

Organizer takes no responsibility, liability or any other expenses for the Winners.
10.

The Prize is non-transferable, and may not be exchanged/ redeemed for cash. Further, the Prize
shall not be combined with any other offer or prize. No request shall be entertained by the
Organizer in this regard. A Prize that is not honored as required or otherwise not claimed within
two (2) days after delivery of notification, or if the Winner is not available on the date, time and
venue as indicated by the Organizer, the Prize will be forfeited and awarded to an alternate
winner, in the manner determined by the Organizer. In the unlikely event of unavailability of any
of the Prize(s) mentioned above, Organizer will make reasonable endeavors (without any
obligation) to distribute prizes of similar value to the respective Winners.

11.

Income tax, gift tax or any other statutory taxes, duties or levies as may be applicable from time to
time, if any, arising out of the Prize(s), shall be payable by the Winner(s) of the respective
Prize(s). In case the Winner fails to comply with the applicable law(s), the Organizer shall be
entitled to select another winner at their own discretion.

12.

Organizer shall not be responsible for the quality or deficiency etc., of the Prizes and no claim or
request, whatsoever, in this respect shall be entertained by the Organizer. Winners may contact
the Prize manufacturers customer care directly in case of any complaints relating to defects in the
Prizes and in any event, the Organizer shall not be held responsible or liable for any such defect,
default, damage, malfunctioning of any of the Prizes.

13.

Employees of the Organizer and/or its associate and affiliate companies/ concerns shall not be
eligible to participate in the Contest, or win any Prize(s) in the Contest.

14.

The Organizer reserves the right to change/ modify terms and conditions and/ or criteria of the
Contest and / or the Prizes for the Contest and/ or the duration/ timing of the Contest, at any
time at their own discretion and without any prior notice and without assigning any reason.

15.

The decisions of the Organizer in connection with the Contest (including without limitation, the
interpretation and enforcement of these Contest terms and conditions, the selection of Winners,
disqualification and/ or suspension of Participants, etc) shall be final & binding on all
Participants, and shall be non-contestable.

16.

The Winner shall be intimated by the Organizer directly. Organizer shall not entertain any
questions, correspondence, enquiries on the manner of conduct of the Contest, or the results of
the Contest, and the distribution of the Prize from any party whatsoever.

17.

Apart from the entitlement to the Prize, the Winner or his/her legal heirs will have no other rights
or claims against the Organizer. Organizer does not provide any warranty or guarantee the proper
functioning of the products which comprise of the Prize and/or any warranties with respect to the
Products or any defect in the products shall be directly taken up with the producers of the said
products.

18.

The Participant acknowledge that he/she will not hold the Organizer and/ or any of its affiliates or
agencies engaged by it with regard to this Contest liable for any loss or opportunity, monetary loss
due to its participation in the Contest.

19.

The Organizer is not responsible for any errors or omissions in the terms and conditions
contained herein. All information provided in the Contest is provided "as is" without warranty of
any kind. The Organizer makes no representations and disclaims all express, implied and
statutory warranties of any kind to the Participants and/or any third party including, without
limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any
particular purpose.

20.

Under no circumstance, shall the Organizer and/or its directors, employees, officers, affiliates or
subsidiaries, be liable to the Participant and/or any third party for any lost profits or lost
opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if
the Organizer has been advised of the possibility of such damages. The Participant specifically
agrees not to file in person/through any family member and/or any third party any applications,
criminal and/or civil proceedings in any courts or forum in India or elsewhere, against the
Organizer and/or their directors, employees, officers, affiliates or subsidiaries to claim any
damages or relief in connection with the Contest.

21.

The Participant shall indemnify the Organizer against any claims from any party and consequent
losses, damages, compensation, whatsoever, that may arise from, or be related to the
participation of the Participant in the Contest. Notwithstanding anything contained herein, the
aggregate liability of the Organizer in case of any damage, loss, cost, claim, liability or expense
(including legal costs and expenses) caused to or incurred by any act, omission or representation
in respect of the Prize of this Contest to any Winner, shall not exceed the value of Prize. Further,
the Organizer shall not be liable to share the invoice of any of the Prizes (or the gratification units)
with the Winners at anytime whatsoever.

22.

Organizer shall not be liable for any failure to comply with its obligations caused due to events of
force majeure. Further, the Organizer shall not be responsible for any loss or damage if it has to
discontinue or cancel this Contest in compliance with any law, ruling, order, regulation,
requirement or instruction of any Central/State Government or for any other unavoidable reason
beyond its control. Participants shall be informed of such discontinuance/cancellation as soon as

reasonably possible, on the Contest page, or through email or such other manner as determined
by the Organizer, from time to time.
23.

The Participants grants the Organizer, its irrevocable consent in perpetuity to use his/ her name,
photographs, video taken during the Prize distribution, if any, in connection with the Contest, in
any and all applications including but not limited to advertising, commercials, promotion, stories,
text, articles and commercial exploitation, in any and all media forms, including but not limited to
radio, broadcast and television, internet, newspapers, magazines and such other modes, media
and platforms (whether existing at present, or which may be developed at any time in the future)
at any time without the Participants further knowledge or consent.

24.

Participation in this Contest implies acceptance of all the terms and conditions of the Contest as
described herein. Participants agree to be bound by any decisions made by the Organizer,
including any interpretations of these terms and conditions by the Organizer. Acceptance of the
Prize by a Winner constitutes permission for Organizer, and its affiliates to shoot videos, click
photographs of such Winner and use the Winners name, photographs, likeness, voice and
comments for advertising and promotional purposes in any media worldwide for purposes of
advertising and trade without any additional compensation whatsoever. The Organizer shall not
responsible for any Participant not being able to understand the Contest mechanics or these
terms and conditions, or for misinterpretation of the same. No correspondence, clarification,
explanation in this regard will be entertained by the Organizer.

25.

It is the Participants responsibility to ensure that their personal details (name, address, date of
birth, email id, ID Proof) are always updated and accurate in order to be able to receive the
gratification/ notification in time.

26.

In order to avail the Prize the Winner must collect the same from the office of the Organizer or
such other venue specified by the Organizer, upon presentation of appropriate and credible ID
proof and sign a release form or such other document(s), as may be required by the Organizer at
its sole discretion. In the event the Winner does not present a credible ID, the Winner shall no
longer be entitled to the Prize and the Organizer may select another winner. The Organizer may in
its sole discretion courier the Prize to the Winners if it so deems fit, at the cost and expense of the
Winner.

27.

Any Participant taking part in the Contest and declared the winner of the Contest, but is unable to
fulfill, or commits a breach of any of the terms and conditions specified herein, shall be
disqualified from receiving any Contest Prize under this Contest.

28.

In case of any dispute or difference in respect of this Contest, the decision of the Organizer shall
be final and binding on all concerned.

29.

The Contest (including without limitation, these terms and conditions), shall be governed by the
laws of India, and any disputes arising out of the Contest, or these terms and conditions, or
otherwise, shall be subject to the jurisdiction of competent court(s) of Mumbai alone.
