MR. BENJAMIN TIMBOL Brgy. San Isidro Calabanga, Camarines Sur SIR: This pertains to the portion of an agricultural land in your possession located and identified to be within Lot 963, Cad 494-D, Case 42 with an area of 755 sq.m, located at San Isidro, Calabanga, Camarines Sur and declared under Tax Declaration No. 97-031-0297, and covered by OCT No. 19079 registered in the name of Domingo Ted, Sr. Please be informed that your possession and occupation of the portion of said lot, where you erected some improvements, are now considered to be unlawful in view of the relocation survey conducted by the Heirs which revealed that you are encroaching upon their lot. The matter has already been referred to for mediation/conciliation with the proper barangay authorities of San Isidro, Calabanga, sometime on June 2014 but the same proved to be futile due to your non-cooperation to settle the matter amicably. It is expected therefore that upon demand you will vacate said lot. In view of the need of the Heirs to develop said lot, there is a need that the same be now free from occupants and improvements. Considering the foregoing, demand is hereby issued for you to VACATE AND DELIVER the peaceful possession of said lot to the Heirs of Domingo Ted, Sr. within THIRTY (30) days from receipt hereof. Otherwise, we will submit this matter with the court of competent jurisdiction for decision to protect the property rights of the landowners.
