FIRE AND ALLIED PERILS INSURANCE

1. CLAIMS PROCEDURES:

1. Immediately send notice of loss to the Insurer.

2. Protect the properties affected or not affected from further loss or damage and / or deterioration,
as if the property has no insurance coverage.

3. Submit a proof of loss duly signed and sworn by Insured within a reasonable period from date of
loss. It should include:

- The knowledge and belief of the time/origin of the loss.


- Actual cash value.
- Amount of loss.
- Encumbrances.
- Other contracts of insurance and information related to the Insured properties.

3. If the claim is substantial and / or complex, Insurer will appoint an independent adjuster /
surveyor to handle the investigation of the claim. The adjuster / surveyor will shortly get in touch
with Insured for inspection of the insured property and verification of the related incident.

4. Insured or his representative should be available for the inspection of the damaged insured
property.

5. To facilitate the processing and settlement of claim, required documents have to be


submitted without delay.

2. SUMMARY OF POLICY CLAIMS CONDITIONS:

(1) CLAIMS – NOTICE OF LOSS AND SUBMISSION OF CLAIM


This condition obliges the insured to notify the insurer immediately and submit the claim within
15 days (the period varies with different companies). The insured should prepare the claim at his
own expenses. He should also give the insurer all required information and details of any other
insurance on any property hereby insured.

(2) FORFEITURE

Fraudulent claim conditions which render all benefit under the policy to be forfeited in case of a
fraudulent claim.

(3) INSURERS RIGHTS AFTER THE LOSS


This condition is called “right of entry” clause which entitles the insurers to enter and take over
the damaged property without admittance of liability.

(4) SUM INSURED / REINSTATEMENT

This condition gives the insurer the right to reinstate the property damaged instead of paying the
amount of the loss.

(5) SUBROGATION

This condition reminds the insurer’s responsibility to co-operate with the insurer in enforcing the
subrogation rights against third parties either before or after the settlement of the claim by the
insurer.
(7) CONTRIBUTION

This condition stipules that if there are more than one insurance policy (covering the same risk,
same perils and same interest) then the insurer will pay only this ratable proportion of the loss

(8) AVERAGE

This condition says that in the event of the sum insured under the policy is less than the actual
value of the property on the date of loss, then the insurer will pay a ratable proportion of the loss.
This clause is enforce penalty for under-insurance.

(9) ARBITRATION

This condition says that any dispute between the insurer and the insured on the amount of loss
shall be referred to arbitration and procedures for such arbitration.

(10) TIME LIMITATION

In no case whatsoever shall the Company be liable for any loss or damage after the expiration of
twelve months from the happening of the loss of damage unless the claim is the subject of
pending action or arbitration.

(11) JURISDICTION

This policy shall be governed by the laws of the country in which it was issued and the courts of
the country alone shall have jurisdiction in any dispute arising hereunder.

A. General Requirements:

B. Building claim (if covered by policy)


1. Certified copy of the building permit or other documents to establish date of
construction, repairs and renovation
2. Certified copy of the Declaration of Real Property
3. Estimated reconstruction cost of the burned building with details and bill of materials
prepared by a civil engineer or an architect
4. Copy of the approved complete construction plans and specifications
5. Lease of contract or agreement if not owner of land
Note: No contemplated improvements may be included in the estimate of reconstruction
and/or repair costs. The estimate should be computed based on the prevailing cost at the
time of loss, and following the same design, specifications and materials of the building as
it was before the loss.

C. Machinery and Equipment claim (if covered by policy)

1. Complete list of machinery and equipment damaged or destroyed showing cost, date
acquired, and the value of each item at the time of loss
2. Purchase invoices, delivery receipts, suppliers' certificates, importation documents, and all
other records pertaining to the covered properties
3. Quotations from qualified suppliers
4. Appraisal report

D. Stock claim (if covered by policy)


1. Itemized inventory of stocks burned inside the building showing net cost (exclusive of
profits) of each item, extent of damage and salvage
2. Certified copies of Income Tax Returns and Audited Financial Statements for the last
three (3) years
3. Any other documents related to the claim
Insurers reserve the right to request for additional documents/information as they may find
necessary in the evaluation of the loss.

3. Loss Report: detailed loss report is prepared either by Company’s claims department in case or
minor loss. Appointed loss Adjusters have to prepare the same in case of substantial losses, taking
into consideration information provided in the intimation claim form.

4. Summary of Reinsurance Treaties Claims Relevant Conditions:

A) Fire First & Second Surplus Treaty:

Paid losses shall be debited in the half-yearly accounts, but when the amount of loss
falling upon all Reinsurers sharing the Quota Share to whish this treaty applies exceeds
US$275,000 the Reinsurer shall upon receiving advice from the Reinsured pay the
amount of his proportion of the loss within 14 days of receipt of such advice. The amount
so paid shall be credited to the Reinsurer in the half yearly accounts.

Claims in respect of which the loss is estimated to attain or exceed US$275,000 or the
equivalent in other currencies for all Reinsurers sharing the Quota Share to which this
Treaty applies shall be advised to the Reinsurer as soon as possible after they come to
the knowledge of the Reinsured and the relative estimate of loss is available.

The Reinsured at its sole discretion and without any right on the part of the Reinsurer to
Interfere shall adjust, settle or compromise all claims and losses. Every such adjustment,
settlement and compromise including ex-gratia payments shall be binding on the

Reinsurer. The Reinsured shall likewise at its sole discretion commence, continue,
defend, compromise, settle or withdraw from actions, suits or prosecutions and generally
do all such matters and things relating to any claim or loss as in its judgment may be
beneficial or expedient and all payments made and cost and expenses incurred in
connection therewith shall be shared by the Reinsurer in proportion to his liability for the
claim or loss. Any share of expenses in connection with settlement of claims or losses
shall not, however, include any part of the salaries of the permanent employees or the
office expenses of the Reinsured. The Reinsurer shall participate in proportion to his
share in all amounts recovered by the Reinsured by way of salvage or other recoveries.

B) `Fire & Engineering Excess of Loss Treaty:

Notice of Claims: It is a condition precedent to the Reinsurer’s liability that, in respect of


any claim or aggregation of claims which fall under the categories set out in the schedule,
the Reinsured shall give immediate written notice to the Reinsurer of such claims or of its
becoming aware of any circumstances which could give rise to such claims. The
Reinsured shall thereafter keep the Reinsurer fully informed of all significant changes
relating thereto as soon as they occur.

The Reinsured shall make available any additional information that the Reinsurer may
require with respect to claims or possible claims notified in accordance with the forgoing.

For each claim, the Reinsured shall provide the Reinsurer with notification of the reserves
as at the end of each year, in original currency, listing the year of occurrence or the
underwriting year as the case may be.

Settlement of Losses: Upon receipt of evidence of payment as may be reasonably


required, the Reinsurer shall pay its share of the loss.

Before the Reinsured’s ultimate net loss has been ascertained, the Reinsurer shall remit
provisional payments to the Reinsured as soon as the deductible is exceeded by
payments.

5. Claims Settlement Authority Limits:

- The General Manager, to settle Fire Claims up to the limit of YR.2,000,000.00 (two million
Yemeni Riyals), equivalent to about US$ 11,000.- Referral is made to Amman Regional
Office for claims in excess of this amount.

- Head of Technical Department, to settle Fire Claims amounting up to YR.150, 000. -


(Yemeni Riyals One Hundred Fifty Thousand).

6. Remarks:

Insured is always advised to bear in mind the following safety and security measures against Fire
Hazards:

 Always have the correct fire fighting equipment within easy reach.
 Do not store flammable or harmful material inside the warehouse, residence or stores.
 Daily disposal of work related waste.
 When storing materials, always secure 15 cm of the floor on wooden or steel shelves.
 Make sure that electrical wiring is of the correct standard and is in good condition.
 While storing, leave enough space between the goods in order to facilitate movement.
 Always leave approximately one meter between the ceiling and the goods in the storage
area.
 Make sure to have well constructed drainage systems to avoid flooding problems during
the rainy seasons. Pay special attention to basements and the ground floor.
 Always make sure the ceiling made of corrugated steel sheets or Kirby are secure to avoid
leakage or rain water.
