ORDINANCE NO.

8019-2002

AN ORDINANCE CREATING THE ROADS AND TRAFFIC ADMINISTRATION AS A


SEPARATE AND DISTINCT DEPARTMENT OF THE CITY GOVERNMENT, AND FOR
OTHER PURPOSES

BE IT ORDAINED by the City Council (Sangguniang Panlungsod) of the City of Cagayan de Oro in
session assembled that:

SECTION 1. Creation.- The Roads and Traffic Administration (RTA) is hereby created as a separate
and distinct department with the following functions and responsibilities:

1. Conduct continuing traffic surveys and statistics gathering;


2. Propose rerouting, parking and other regulations to the authorities;
3. Conduct feasibility studies or traffic networks and system;
4. Conduct studies and propose engineering designs or intersection management;
5. Maintain and operate the traffic signals;
6. Provide the needed traffic signs and pavement markings within the jurisdiction of the City
of Cagayan de Oro;
7. Maintain the flow of vehicular traffic and enforce the traffic rules and regulations;
8. Conduct traffic education program and administer the dissemination of information
regarding traffic updates;
9. Propose ways and means for traffic revenue measures;
10. Absorb and exercise all functions related to transport safety, develop and provide public
parking, and undertake environmental protection activities such as anti-smoke belching,
noise pollution and other pertinent laws and ordinances.
11. Manage and control the use of public roads and pathways and the clearing of obstructions of
any form to ensure smooth flow of traffic.

SECTION 2. Organizational Structure.- The Roads and Traffic Administration shall have the
following Organizational Set-up:

a] Traffic Administrator with the rank of City Government Department Head II:
b] Assistant Traffic Administrator with the rank of Assistant City Government Department
Head II
c] Administrative Services headed by an Administrative Officer III, with the following support
personnel:
 1 – Records Officer II
 1 – Computer Operator II
 1 – Supply Officer II
 6 – Clerks I
 1 – Bookbinder II
 1 – Messenger
 1 – Driver I
 1 – Utility Worker II

d] Traffic Engineering Division headed by an Engineer IV, with the following Sections and
support personnel:

d.1 Traffic Signal Control/Signage & Pavement Markings Section


 1 – Engineer II
 1 – Electronics and Communication Equipment Technician II
 1 – Engineering Aide
 1 – Draftsman II
 1 – Painter I
 1 – Welder I

SECTION 3. Budgetary Allocation - There shall be set aside yearly in the General Fund budget
starting CY 2003 so much amount necessary for personal services, operating expenses and capital outlay
and/or non-office outlay of the RTA.

Pending the full staffing of the RTA, the Traffic Administrator is hereby authorized to designate in
acting capacities to various positions thereof the existing personnel of the RTA .

SECTION 4. Status of existing RTA supplies & facilities - The existing equipment, facilities and
supplies of the erstwhile Roads and Traffic Administration shall be transferred to the custody, management
and administration of the Traffic Administrator.

SECTION 5. Separability - If any of the provisions of this Ordinance is declared unconstitutional or


invalid by competent authorities, the other provisions not affected thereby shall remain in full force and
effect.

SECTION 6. Repealing Clause – The provisions of existing Ordinances inconsistent hereof are
hereby amended, modified or repealed accordingly.

SECTION 7. – Effectivity. - This Ordinance shall take effect upon its approval.
