Sub: Legal notice on behalf of …………………., through its proprietor.

Under instructions and authority from my client ………………….,


through its proprietor Sh. ……………., I hereby serve upon you the legal notice
as under:

1. That my client has ……….. in Delhi for catering coaching to the


aspirants for designing courses in India. My client employs Admin.
Counsellors for the purpose of co-ordination between the
students/aspirants and itself.

2. That my client, after due selection process, offered yourself the post of
Admin. Counsellor for its centres at ……. at Rs. ……… (basic and
conveyance) along with other incentives. As per the appointment letter,
dated 14.11.2016, yourself would be under probation for 2 months
including training for 1 month. However, due to dismal performance your
probation was extended by 2 more months. On 12.03.2017 your
appointment was confirmed.

3. That vide the …………………. terms & conditions acceptance letter,


dated 12.03.2017, you had undertaken/committed to serve my client at
the above mentioned post till March, 2018. As per the terms and
conditions of appointment, dated 12.03.2017, you are supposed to serve
an advanced notice of 2 months before quitting/resigning from the said
post.

4. That due to numerous complaints from the students/aspirants, you were


transferred to the …….. centre of my client.

5. That your performance during your employment was dismal. However,


my client had to retain you due to shortage of staffs for the said post.
Taking advantage of the situation, you used to demand high perks and
salary from my client, upon failing to achieve the said aim you used to
create unwarranted situation with other staffs and students/aspirants of
my client.

6. That yourself, on 12.05.2017, called upon the Centre Head ……………..,


and asked her for advance of Rs. …………./- for ………….. The said
amount was duly extended to yourself, on 13.05.2017, as my client
wished to avoid conflict with yourself. The said amount was through cash
and as an acknowledgement you had signed the voucher. However, on the
same day, you had mailed your resignation to my client, without giving
due advanced notice of 2 months, and asked to clear your dues.

7. That by demand of an advance of Rs. …………/- from my client and


subsequent resignation without giving due advanced notice of 2 months
you have committed misappropriation, defraud, cheating, etc. upon my
client.

8. That by not giving due advanced notice of 2 months are liable to pay Rs.
30,000/- as compensation to my client for the loss he has suffered due to
violation of the ……………………… employment terms & conditions.

In view of the aforementioned facts and circumstances, you are,


therefore, directed to comply the following within 15 days from receipt of this
notice:
1. Pay Rs. …………… as compensation to my client for the loss suffered
due to violation of the ……………….. employment terms & conditions.

2. Pay Rs. ………./-, the advanced amount which you have misappropriated
by fraud.

Failing to comply with these directions, I have clear instructions from my


client to initiate appropriate legal proceedings against yourself, in the competent
court of law, and in that event yourself shall be liable for all costs and
consequences arising therefrom.

You are also liable to pay Rs. ………../- towards the charges for this legal
notice.
