COUNTY OF GASTON
MEMORANDUM OF UNDERSTANDING
THIS MEMORANDUM OF UNDERSTANDING is entered into the first day of business activity between
the parties of this agreement, which is the _____ day of _________________, 200_ by and between
___________________________________________________ (herein called “Contractor”) and
__________________________________, (herein called “ Landlord”) in Gaston County, North Carolina.
Reinvestment in Communities of Gaston County, Inc. (RIC) receives federal funds from the City of
Gastonia in order to administer housing assistance programs for homeless people or for those in threat of
becoming homeless. The Tenant-Based Rental Assistance Program (TBRA) is for homeless people who
are residents of Gaston County. Preference is given to people who meet the HUD definition of chronically
homeless and to long-term homeless families. TBRA provides for a Security Deposit, Utility Deposit and
Rental Subsidy. The Security Deposit Only Program is for homeless individuals/families or those in threat
of becoming homeless who have income sufficient to pay rent. It provides for a rental security deposit
only.
Based upon each individual program criteria the parties of this Memorandum of Understanding agree:
Reinvestment in Communities of Gaston County, Inc. shall:
1. Provide written or verbal notification to the landlord on the program which the potential tenant has
qualified, either the Tenant-Based Rental Assistance (TBRA) Program or Security Deposit Only
(SDO) Program;
2. Provide written or verbal notification of the amount of security deposit available for the tenant and,
if applicable, the monthly rental subsidy amount from the TBRA program, which is reviewed
within 90 days from initial move-in and each month thereafter (if tenant continues to qualify) for
up to two years;
3. Pay the amount(s) for rental security deposit within five business days;
4. If applicable, pay the monthly rental subsidy amount by the first of each month or the date specified
in the lease agreement each month; and
5. Follow-up with the tenant each month for three months after entry into the housing unit to help
assure housing success and good tenant/landlord relations.
Landlord shall:
1. Provide tenant with a clean, safe housing unit that is well maintained;
2. Follow federal Fair Housing regulations;
3. Follow state residential rental agreement laws and regulations;
4. Accept payment in the form of cash or organization check;
5. Provide a completed W-9 (if using social security number instead of Federal ID number);
6. Provide statement of assurance that housing unit is free of lead-based paint hazards or that unit was
constructed after 1978.
7. Provide a copy of the rental lease agreement to Reinvestment in Communities (RIC) if applicable;
8. Upon move-out, provide RIC with an accounting of the charges deducted from the security deposit;
and
9. If applicable, return any security deposit funds to RIC at P.O. Box 550492, Gastonia, N. C. 28055-0492.
This agreement shall remain in effect until termination. Termination of the MOU shall be by 30 days
written notification by one or both parties of this agreement. No just cause shall be required for
termination.
