BACKGROUND

The DOE in cooperation with the geothermal


developers spearheaded in 1990 the formulation of
the Geothermal Safety and Health Rules and
Regulations (GSHRR).

The GSHRR was signed on November 8, 1991 under


OEA Circular No. 91-11- 06 by then OEA Executive
Director Mr. W. R. De La Paz.

The GSHRR authorizes the DOE to conduct safety and


health inspection in all geothermal field but only
limited to the field operations (power plants not
included).

BACKGROUND

In 1996, the DOE formed a Technical Working Group


(TWG) to revise the original GSHRR, which will conform
with the International Standards of Modern Safety
Management or Loss Control Management.

The Revised Geothermal Safety and Health Rules and


Regulations (RGSHRR) was signed by Secretary Mario
V. Tiaoqui on February 2000 under Department Circular
No. 2000-02-001 and supersedes the existing GSHRR.

The RGSHRR expands the authority of the DOE to


oversee not only the safe operations of a geothermal
steam field developer but also those of geothermal
power plant operators.

BACKGROUND

With the passage of RA 9513 also known as the


Renewable Energy Act of 2008, the RGSHRR was
amended to incorporate other renewable sources of
energy such as Biomass, Solar, Wind, Hydro and Ocean.

The new Circular known as Renewable Energy Safety


Health and Environment Rules and Regulations
(RESHERR) was signed by Secretary Carlos Jericho
Petilla on November 21, 2012 under DC 2012-11-0009
and supersedes the RGSHRR.

Under Rule 2 Section 8 of the DC 2012-11-0009, the


Bureau shall, in consultation with RE stakeholders and
relevant government agencies, promulgate the Code of
Practice of this Circular.

OBJECTIVE

The RESHERR serves as the policy


guidelines in RE Operations, to ensure
safety and protection against hazards to
health, life and property as well as pollution
of air, land and water in all the RE projects.

SCOPE AND COVERAGE

RESHERR applies to all Employers, Employees, contractors and


other entities engaged in RE Operations in the Philippines.

RESHERR covers all activities related to exploration,


development and utilization of RE resources and
manufacturing, fabrication, and suppliers of locally-produced
RE machineries, equipment, components and parts.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To have a general safety, health and environment policy
statement in writing shall be issued by the Employer or
corporate organization to reflect management's positive
attitude, support and commitment to effective leadership and
program administration for safety, health and environment.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To have a Safety, Health and Environment Committee
Composition of Committee with more than one hundred (100)
workers:
Chairman -Manager
Members -One (1) Foreman/Supervisor
-Four (4) workers
-Nurse/First-aider
-Environmental Officer
-Contractor Safety Officer (if applicable)
Secretary -Safety Officer

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To have Safety Officer duly registered with DOE-REMB
Qualifications (any of the following)
-Duly licensed engineer with at least two (2) years actual
experience in occupational safety and has attended the
minimum training requirement on BOSH; or
-Degree holder or two years in college with at least five (5)
years actual experience in occupational safety and has attended
the minimum training requirement on BOSH; or
-Accredited as a Safety Practitioner by the DOLE.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To have Safety Officer duly registered with DOE-REMB
Requirements for Minimum Number of Full-time Safety Engineer/Officers
-Duly licensed engineer with at least two (2) years actual experience
in occupational safety and has attended the minimum training
requirement on BOSH; or
-Degree holder or two years in college with at least five (5) years
actual experience in occupational safety and has attended the
minimum training requirement on BOSH; or
-Accredited as a Safety Practitioner by the DOLE.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:

o Quarterly submission of statistical


accident/incident/illnesses/diseases report to REMB within
twenty (20) days following the end of each quarter using the
prescribed form.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o Notification to REMB within twenty-four (24) hours after
occurrence of any, but not limited to, the following incidents:

a) Fatal accidents;
b) Hospitalization of three (3) or more persons;
c) Accidental detonation of explosives including blasting agents;
d) Explosion or blowout;
e) Accidental or over-exposure to ionizing radiation;
f) Accidental exposure to Immediately Dangerous to Life and
Health levels of toxic substances; and
g)Property damages amounting to P1,000,000.00.

manufacturers /fabricators:
o To provide adequate safety and health training to its
Employee to be conducted by DOLE-Accredited STO upon
employment and on their being exposed to new or increased
risks and shall be repeated periodically where appropriate.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To provide to its Employees with the appropriate PPE, safety
devices and equipment. All PPE to be used shall be of the
approved design and construction appropriate for the
exposure and the work to be performed that meets the
minimum OSHS.

o To monitor and control the employees' exposure to workplace


hazards, and shall maintain such records for each employee.

• RESHERR requires all RE developers and accredited


manufacturers /fabricators:
o To (1) create a Disaster Emergency Preparedness/Contingency
Plan and Response Team, (2) Establish appropriate emergency
action plan to be implemented in the event of serious and
imminent danger, (3) Set up, communicate and maintain an
appropriate emergency alarm system to alert or warn all
persons likely to be affected by existing or imminent disaster
conditions; and (4) Conduct emergency drills at least twice
every year to ensure safe and orderly evacuation of personnel
as well as timely and effective action of response team.

manufacturers /fabricators:
o To promote, protect and maintain the health and well being of
its employees through the implementation of an occupational
health program.

o To provide the necessary medical and dental services and


facilities for its employees.

manufacturers /fabricators:
o All RE operations shall be conducted in accordance with
existing environmental regulations as prescribed by the DENR
and/or any other concerned agency.

• Stiff administrative fines to ensure full compliance


of all RE developers and accredited manufacturers
and fabricators
1. Failure or late submission of quarterly statistical reports
for incident/accident/illnesses/diseases:
a. First Offense Fine of P10,000.00;
b. Second Offense Fine of P20,000.00; and
c. Third and Succeeding Offenses Fine of P50,000.00.

and fabricators
2. Failure to register or secure/renew a permit for safety
engineers/ officers:

a. Within one (1) month after the expiration of the old


permit Fine of P10,000.00; and
b. After one (1) month after the expiration of the old permit
- Fine of P20,000.00 and additional fine of P 20,000.00
per month on the succeeding months.

3. Failure to employ a qualified safety officer:

a. Within six (6) months after the signing of


service/operating contract and/or certificate of
registration - Fine of P 100,000.00; and
b. After the sixth (6th) month and every succeeding month
an additional - Fine of P 20,000.00 per month.

4. Failure to notify the Bureau using the fastest and
efficient means of communication the occurrence
of any incident/accident within the 24 hrs.

-Fine of P 10,000.00.

5. Failure to correct any unsafe condition(s) noted by
the Bureau's authorized representative.
a. First Offense Fine of P 100,000.00;
b. Second Offense Fine of P 200,000.00; and
c. Third and Succeeding Offenses Fine of P 500,000.00
and/or suspension of operation in the area affected until
the unsafe condition(s) is/are rectified.

6. Withholding or failure to provide pertinent data
or information regarding the safety aspects of
RE operations as required by the Bureau.

a. First Offense Fine of P10,000.00


b. Second Offense Fine of P20,000.00; and
c. Third and Succeeding Offenses Fine of P50,000.00.
