SETTLEMENT OF ESTATE WITH SALE
KNOW ALL MEN BY THESE PRESENTS:
This Extrajudicial Declaration of Heirs, and Settlement of the Estate
with Sale is entered into by and among the following heirs of xxx, namely:
xxxxx, for herself and as attorney in fact of xxxxx (per SPA attached as Annex “A”), of legal age, widow, Filipino and a resident of Itum, Duero, Bohol; xxxxxx, for himself and as attorney in fact of xxxx (per SPA attached as Annex “B”), of legal age, married and a resident of Maco, Compostela Valley; and xxxx, for herself and as attorney in fact of xxxxx, of legal age, Filipino, single, and a resident Zone 3, Brgy. Central Signal, Taguig, hereafter collectively referred to as “Heirs”.
WITNESSETH that-
The Heirs are the only surviving heirs of xxxx who died intestate leaving a certain parcel of land located at Alejawan, Duero, Bohol identified as CAD Lot No. xxxx Survey No. xxxx, with an area of THREE THOUSAND TWO HUNDRED TWENTY ONE (3,221) SQUARE METERS, more or less, and covered by Tax Declaration No. xxxxxx; .
The Decedent died intestate, leaving no known debts that maybe
chargeable against her estate;
It is to the best interest of the Heirs to divide and adjudicate among
themselves the entire estate extra-judicially;
NOW THEREFORE, for and in consideration of the premises, and
invoking the provision of Rule 74, section 1, of the Rules of Court, the Heirs do by these presents agree to divide and partition the entire estate above described unto themselves;
WITNESSETH further that-
FOR AND IN CONSIDERATION of the sum of TWO MILLION FIVE HUNDRED PESOS (PHP2,500,000.00), Philippine currency, received by xxxxx from xxxx (“Buyer”), of legal age, Filipino, married to Roselyn Cape Sy and a resident of Pajo, Lapu-lapu City, Cebu, the Heirs hereby SELL, CEDE, TRANSFER, and CONVEY the above-described property to the Buyer, free from any lien or encumbrance.
