BRIEF ON BIZERTA LINES & MUSLIM COLONY, KATCHI

ABADIES , KARACHI

It was January 1988, when the Government of Pakistan (MoD) conveyed sanction for
regularization of Bizerta Lines Katchi Abadi on Defence Land.

A piece of land measuring 32.57 acres was declared as bazar area through MoD gazette
notification and the land was classified as B-4 under the management of Karachi
Cantonment Board.

SALIENT FEATURES OF THE POLICY FOR REGULARIZATION FOR


ENCROACHMENT ARE AS UNDER:-

Regularization of encrochment can be done by way oy leasing out the occupied sites to
the existing occupants after inevtible municipal adjustments and upon payment of ground
rent, premium, development charges etc.

ISSUES

Leases to remaining occupants /encroachers could not be granted due to reasons


mentioned below.

1. Non-Cooperative Attitude of occupants towards completion of codal formalities.


2. The majority of legal occupants sold their occupancy rights to other individuals
and in some cases transactions have been made twice even thrice.
3. Whether the lease could be granted to the current occupants who have purchased
the houses on simple/non judicial stamp paper..

DIRECTION SOUGHT FROM THE HQ ML&C IN THIS REGARD.

The matter was teken up with HQ ML&C Deptt several times seeking direction/advice on
the following.

1. Whether the current occupants be granted lease ab-initio.


2. Whether the lease be granted in favour of the actual person borne on the survey
slip and subsequent transfers be regularized.
3. Whether existing commercial use be given the commercial lease.

HQ ML&C ASKED THIS OFFICE TO PROVIDE ITS RECOMMENDATIONS.

This office sent its suggestions / recommendations as following.

1. Lease to the original occupants or to their survivors/heirs may be granted subject


to fulfillment of all codal formalities.
2. Renewal of leases may also be granted to the lessees for 2nd term of 30 years.
3. All illegal transaction of unleased plots may be realized till the last transferee(s)
subject to payment of all cantonment dues such as TIP tax, Mutation fee,
Composition fee, premium, regularization plan & development charges as per
CBRs (to be decided by the Competent Authority)
4. Illegal Construction may be allowed to be regularized subject to payment of
composition fee and submission of regularization plan, structual stability certficate
& other requisits in this regards.

5. New form at Schdule-V be presented to Board based on actual occupation by the


applicant.
