Unpaid Monetary Obligation to OCEAN
VIDA MALAPASCUA, INC.

Dear Sir:

Good day. I am writing to you on behalf of my client, OCEAN VIDA


MALAPASCUA, INC., of Malapascua Island, Daanbantayan, Cebu,
Philippines, regarding the matter of your outstanding obligations arising
from the due purchase of a portion of the parcel of land under Lot Nos.
9578-B-6 and 9578-B-7, specifically Lot No. 1 Block No. 3, together with
the structure built thereat, located at Logon, Daanbantayan, Cebu,
Philippines, with an area of SIXTY (60) square meters, more or less.

The monetary obligation abovementioned is in lieu to the DEED OF


CONDITIONAL SALE (HOUSE & LOT) which was duly entered into by
your stead on August 15, 2014. A copy thereof is hereto attached as
Annex “A” for your complete and proper perusal.

The total amount to be paid, as fixed in the aforementioned DEED OF


CONDITIONAL SALE (HOUSE & LOT), is set at FORTY NINE
THOUSAND FIVE HUNDRED PESOS (Php 49,500.00) only. The said
amount was to be paid for a period of three (3) years reckoned from August
15, 2014 until August 16, 2017. Unfortunately however, until the time being
and despite the lapsed of time of the intended date of full payment on
August 16, 2017, the total amount has yet to be paid in full.

Records disclose that you have various due and demandable


obligations with my client in the total amount of THIRTY FIVE THOUSAND
THREE HUNDRED SEVENTY-FIVE PESOS (₱35,375.00), exclusive of
interest and surcharges. 

Par. 4.3 of the abovementioned DEED OF CONDITIONAL


SALE (HOUSE & LOT) clearly provided, to wit: “The VENDOR
may declare the VENDEE in default and may cancel the
contract and demand the VENDEE and his family to
immediately vacate from the SOLD PORTION and the HOUSE
within five (5) days from the date the third installment payment
fell due and after due notice in writing for such declaration of
default and cancellation of this contract and peacefully deliver
actual possession thereof to the VENDOR, its assigns and
successors-in-interest.”

Accordingly, FINAL DEMAND is hereby made upon you to make


good and pay the full amount of THIRTY FIVE THOUSAND THREE
HUNDRED SEVENTY-FIVE PESOS (₱35,375.00) only. Payment must be
made to OCEAN VIDA MALAPASCUA, INC. within TEN (10) days from
receipt of this letter. Otherwise, we will be constrained to enforce
paragraphs 4 and 5 of the abovementioned Deed of Conditional Sale and
have you and your family cordially VACATED and REMOVED from the
subject property hereunder in order to protect the interest of my client.

We trust that you will give this matter your prompt and preferential
attention to avoid the expense and inconvenience of litigation.
