    of DR. REYNALDO RACAR DAVE, JR.

    I, DR. REYNALDO RACAR DAVE, JR., of legal age, Filipino,


    resident of No. 6, Gloria Ave, Tandang Sora, Quezon City, after
    having been duly sworn to in accordance with the law, hereby
    depose and state:

    Questions were propounded to me by Atty. Maisie Karissa F.


    Atticus of GARREZA Law Offices. The examination was held at 2/F
    Salinger Building, Amorsolo St., Makati City.

    I am executing this Judicial Affidavit to serve as my direct


    testimony. I was asked questions in English which I fully understand,
    and I responded truthfully and based on my personal knowledge,
    fully conscious that I do so under oath, and that I may face criminal
    liability for false testimony and perjury.

    OFFER OF TESTIMONY

    The testimony of the witness Dr. Reynaldo Racar Dave, Jr. is


    being offered to prove:

    1. That he is the Medico-Legal Officer who conducted the autopsy


    of deceased CASTOR CABASAN Y SEMILLANO;

    2. That he executed Medico-Legal Report No. M-696-03 attached

    as Exhibit J;

    3. The type of weapon used, the location of the wounds, and the
    cause of death;

    4. Other matters relevant to the case.

    1. Q: Please state your name and other personal circumstances for


    the record.
    A: I am Dr. Reynaldo Racar Dave, Jr, of legal age, single, and a
    Police Senior Inspector and Medico-Legal Officer in Camp Crame,
    Quezon City. (Annex A)

    2. Q: Why are you here today?


    A: To give a sworn statement concerning the death of Castor
    Cabasan Y Semillano.

    3. Q: What is your educational background?


    A: I finished my Doctor of Medicine degree at the University of
    Santo Tomas. (Annex B)

    4. Q: When did you take and pass the physician licensure exam?
    A: I took the exam in 2005 and passed it in the same year.

    5. Q: How long have you been practicing your profession as a


    Medico-Legal Officer?
    A: I have been in this profession for more than 10 years. (Annex C)

    6. Q: What are your functions as a Medico-Legal officer?


    A: I conduct autopsy on medico-legal cases such as in assault,
    rape, and death, to determine the cause, timing, and manner of
    such crimes . I am also tasked to make medico-legal reports and
    attend court hearings for my medico-legal opinion.

    7. Q: Have you ever testified in a court of law as a coroner?


    A: Yes, I have.

    8. Q: Have you ever examined the body of a man by the name


    Castor Cabasan Y Semillano?
    A: Yes, I conducted his autopsy.

    9. Q: How were you able to identify that the body belonged to one
    Castor Cabasan Y Semillano?
    A: The remains were personally and visually identified by the
    brother of the victim, Francisco Cabasan y Semillano.

    10.Q: When did you conduct the autopsy?


    A: On February 06, 2021 pursuant to the request of the Detection
    and Special Operations Division of the Criminal Investigation

    Division Group, Camp Crame.

    11.Q: What was the state of the body of Castor Cabasan Y


    Semillano when you examined the same?
    A: It was a fairly developed, fairly nourished male cadaver in rigor
    mortis with post-mortem lividity on dependent portions of the
    body. Conjunctivae lips and nailbeds are cyanotic. The exposed
    portions of the upper and (lower) extremities are soaked with
    green paint.

    12.Q: Were there any distinctive marks?


    A: Yes, the body sustained five stab wounds.

    13. Q: How will you describe the first stab wound and its location?
    A: The first stab wound was located on the left pectoral region
    measuring 3 x 1.3 cm, 8 cm from the posterior midline, 8 cm deep,
    directed posteriorwards, downwards and medial downwards
    piercing the underlying soft tissues and muscle fracturing the 3 rd
    left rib and puncturing the lower lobe of the left lung and left
    auricle of the heart.

    14. Q: How will you describe the second stab wound and its
    location?
    A: The second stab wound was located on the right pectoral region,
    measuring 2.5 x 0.9 cm, 2 cm from the anterior midline, 8cm deep,
    directed posteriorwards, downwards and to the right, piercing the
    underlying soft tissues and muscle, fracturing the 3 rd left rib and
    puncturing the right auricle of the heart.

    15. Q: How will you describe the third stab wound and its location?
    A: The third stab wound was located on the left inguinal region,
    measuring 2.5x0.7cm, 16 cm from the AML, piercing the underlying
    soft tissues and muscles.

    16. Q: How will you describe the fourth stab wound and its
    location?
    A: The fourth stab wound was located on the left costal region,
    measuring 7x2.7cm, 7 cm from the posterior midline piercing the
    underlying soft tissues, muscles, and the 10th intercostal space.

    17. Q: How will you describe the fifth stab wound and its location?
    A: The fifth stab wound was located on the left buttocks, measuring
    2.4x1cm, 9 cm from the posterior midline piercing the underlying soft
    tissues and muscles.

    18. Q: What are your other findings, if any?


    A: The head and neck were grossly unremarkable. The extremities
    had no injuries. 500cc of blood and blood clots were evacuated from
    the thoracic cavities while the stomach is partially full of food

    particles which are mostly rice.

    19. Q: Based on your findings, what is the cause of death?


    A: Hemorrhagic shock secondary to stab wound on the trunk.

    20. Q: Are these findings reduced in writing?


    A: Yes, these are contained in Medico-Legal Report No. M-696-03.

    21. Q: Is the signature affixed in Medico-Legal Report No. M-696-03


    purporting to be that of Reynaldo Racar Dave Jr, your name and
    signature?
    A: Yes.
