RESOLUTION NO. [Insert Number] (s. 2020)

A RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR HON. ALI M. MIDTIMBANG TO ENTER INTO
AND SIGN A MEMORANDUM OF AGREEMENT WITH THE NATIONAL HOUSING AUTHORITY,
INDIGENOUS PEOPLE COMMUNITY, MINISTRY OF INDIGENOUS PEOPLES AFFAIRS (MIPA) FOR THE
DEVELOPMENT OF THE IP HOUSING PROJECT AND APPROVING THE USE OF LGU PROPERTY AS A
HOUSING SITE FOR THE IDENTIFIED QUALIFIED BENEFICIARIES.

WHEREAS, this LGU desires to address the housing needs of our constituents particularly the Indigenous
People in our locality;

WHEREAS, the Teduray Community requested for housing assistance;

WHEREAS, based on municipal survey, we found out that barangay Boboguirun have an 1:4 household-
family proportion.

WHEREAS, the NHA has expressed its willingness to provide assistance to Municipalities under the
conditions prescribed in NHA’s Memorandum Circular No. 2018-029, “Updated Guidelines for the Implementation of
Housing Assistance Program for the Indigenous Cultural Communities (ICCs)/ Indigenous Peoples (IPs)”;

NOW THEREFORE, premises considered and on motion of SB Member Hon. ___________________,


unanimously seconded, be it,

RESOLVED as it is hereby done to authorize the Municipal Mayor Hon. Ali M. Midtimbang to enter into and
sign a Memorandum of Agreement with the National Housing Authority, Indigenous People Community, Ministry of
Indigenous Peoples Affairs (MIPA), for the development of the IP housing project.

RESOLVED FURTHER, that the Municipality approves the use of LGU property, with an area of ______________
portion of TCT No. TAF-233, owned by the Local Government Unit (LGU) of Talayan, with a total area of
approximately Sixty-Three Thousand Two Hundred and Eighty-Nine (63,289.00) sq. M. situated in Barangay
Boboguirun, Talayan, Maguindanao as a housing site for the identified qualified beneficiaries.

RESOLVED FURTHER, that the Municipality commits to undertake the project in accordance with the
following guidelines;

1. To provide its owned land for the Project free from all liens and encumbrances
2. To undertake jointly with NHA, IP Community, and Ministry of Indigenous Peoples Affairs (MIPA) all
aspects of the land development in accordance with the approved plans, specifications, costs, and schedule
3. Provide water and power facilities for the project
4. Provide funds necessary for the implementation of project components not covered by NHA’s assistance
5. Create a Project Implementation Team which shall be responsible for the preparations of the project plans,
and implementation of the project to include land development and housing construction
6. Undertake social preparation activities with NHA and MIPA in compliance to the Free Prior Informed
Consent (FPIC) Process pursuant to Sec. 59 of IPRA Law and Sec. 43 on the Validation Process based on
A.O. No. 3 s. 2012
7. Secure all required permits and clearances necessary for the implementation of the project
8. Submit all monitoring and project completion reports as required
9. Return to NHA any unutilized funds released for the project.
10. To accept, maintain, and repair the completed infrastructure turned-over by the NHA to the Municipality
and to undertake proper use and maintenance of open spaces
11. To Provide socio-economic facilities and services and/or implement programs for the welfare of the
beneficiaries
12. Without need of demand, return the total fund contribution to the NHA should it fail to complete the
development works, except in cases of force majeure, within the prescribed period and failure to award the
said units to qualified beneficiaries

RESOLVED FINALLY, that copies of this resolution be furnished to the Regional Manager of NHA Region
IX and ARMM, Hon. _______________- Municipal Mayor, the MPDC – Mr. _____________, the Municipal Engineer
– Engr.________________, and all concerned entities for their information and appropriate action.
