Parties appeared before the SENA Hearing Officer Sushimika Balio.
Requesting party Howard Ong asserted its claim for monetary award on top of its assertion that he be
formally employed as a regular employee of Jolly Food Restaurant by reason of his work assignment
which is necessary and desirable to the nature of business Jolly Food Restaurant.
On his part, respondent Carlo Barangtay denied any claim of monetary award and asserted that they
have paid Mr. Ong the right amount of benefits under the law.
On the otherhand, respondent Jess Morante denied Mr. Ong’s claim of regularization by reason the
explicit provision of the service agreement between ABC Management Training Services and Jolly
Food Restaurant. The agreement categorically stated that the personnel deployed by ABC is not in any
way employee Jolly Food.
By reason of the irreconcilable difference attributable to both the requesting party and the
respondents, this case will be submitted to compulsory arbitration.
