    Manila, Philippines, after having been duly sworn in accordance with law,
    hereby depose and state:

    1. I am the representative of CARGOFLEX ENTERPRISES INC. in


    the case against MCC TRANSPORT PHILIPPINES, INC. by
    virtue of the secretary certificate dated ______________.

    2. I have read, known, and supplied the contents of the Complaint. I


    caused the preparation and filing of the foregoing Complaint.

    3. The allegations in the foregoing Complaint are true and correct


    based on my personal knowledge and authentic records;

    4. That this is not filed to harass, cause unnecessary delay, or


    needlessly increase the cost of litigation; and

    5. That the factual allegations therein have evidentiary support or, if


    specifically so identified, will likewise have evidentiary support
    after reasonable opportunity for discovery.

    6. I have not commenced any other action or proceeding involving


    the same issues subject of this present case in the Supreme Court,
    the Court of Appeals, or the different divisions thereof, or any
    other tribunal or agency.

    7. To the best of my knowledge, no such action or proceeding is, or


    remains, pending in the Supreme Court, the Court of Appeals, or
    the different Divisions thereof, or any other tribunal or agency.

    8. If I should hereafter learn that a similar action or proceeding has


    been filed or is pending before the Supreme Court, the Court of
    Appeals, or the different Divisions thereof, or any other tribunal or
    agency, I undertake to promptly inform this Honorable Court of
    that fact within five (5) days from notice.
