IMPLEMENTING GUIDELINES ON CHILD
PROTECTION AND ANTI-BULLYING

I. INTRODUCTION

Pursuant to the 1987 Constitution, the State shall defend the right of
children to assistance, including proper care and nutrition, and special protection
from all forms of neglect, abuse, cruelty, exploitation, and other conditions
prejudicial to their development (Article XV, Section 3).

San Juan Elementary School, together with the Department of Education,


recognizes that cases of abuse and bullying against school children may arise as
a result of the difficult situations faced by co-pupils, teachers and other officials
within and outside the school. In lieu of DepEd Order No. 40 s. 2012 and
Republic Act No. 10627 (An Act Requiring All Elementary and Secondary
Schools to Adopt Policies to Prevent and Address the Acts of Bullying in
Their Institutions), this School has adopted the policy and guidelines to provide
special protection to children who are gravely threatened or endangered by
circumstances which affect their normal development and over which they have
no control, and to assist the concerned agencies in their rehabilitation.

With this guideline, San Juan Elementary School reiterates a zero tolerance
policy for any act of child abuse, exploitation, violence, discrimination, bullying,
and other forms of abuse.

II. OBJECTIVES

This guideline focuses on the following objectives:

1. To create a school guiding principle which encourages students to disclose


and discuss incidents of abuse bullying behavior by the school head,
teachers, staff, and pupils;

2. To raise awareness of bullying and any form of abuse as an unacceptable


form of behavior with school management, teachers, students,
parents/guardians;

3. To create a school ethos that acknowledges, accommodates and respects


a diversity of learners with regard to physical, mental, emotional, and
economic factors;

4. To ensure that the school’s Social, Personal and Health Education program
raises awareness of the factors associated with child abuse and bullying
behavior and develops appropriate knowledge, skills and behaviors;

5. To take practical actions to prevent incidents of abuse and bullying


behavior e.g. to ensure comprehensive supervision and monitoring
measures through which all areas of school activity are kept under
observation;

6. To develop procedures for reporting and recording incidents of abuse and


bullying behavior;

7. To develop procedures for investigating and dealing with incidents of abuse


and bullying behavior;

8. To develop a program of support for those affected by any kind of abuse


and bullying behavior and those involved in aforementioned cases; and

9. To work with, and through, the various local agencies in countering all
forms of abuse, bullying and anti-social behavior.

III. COMPOSITION OF THE SCHOOL’S CHILD PROTECTION

IV. THE SCHOOL’S PREVENTIVE MEASURES TO ADDRESS CHILD ABUSE,


EXPLOITATION, VIOLENCE, DISCRIMINATION, BULLYING, AND
OTHER ACTS OF ABUSE

1. Conducting sessions, trainings, and seminars on positive peer relationships


and enhancement of social and emotional competence for both teachers
and pupils;

2. Orienting all teachers, parents, and pupils on the Child Protection Policy
and the Anti-Bullying Act during pupils’ orientation and Homeroom PTA
Conference;

3. Integrating and teaching Children’s Rights in all subjects in the classroom;


and

4. Initiating programs in and outside the school that are intended to promote
positive and non-violent discipline.

V. PROTECTIVE AND REMEDIAL MEASURES TO ADDRESS CHILD ABUSE,


EXPLOITATION, VIOLENCE, DISCRIMINATION, BULLYING, AND
OTHER ACTS OF ABUSE

A. PROCEDURES IN HANDLING BULLYING INCIDENTS

1. In any case where it has been determined by the classroom teacher that
bullying behavior has occurred:

1.1 The parents of the parties involved should be contacted at an early


stage to inform them of the matter and shall be immediately reported to
the principal and he/she will be the one to meet with the parents of the
offended and the offender.

1.2 The victim and the offending child shall be referred to the Child
Protection Committee for counseling and other interventions.

1.3 The penalty of reprimand shall be imposed by the Principal in the


presence of the parents or guardians.
1.4 If bullying occurred for second or subsequent time, after the offending
child has received counseling or other interventions, the penalty of
suspension for not more than one (1) week shall be imposed by the
Principal. During the period of suspension, the offending child together
with his/her parents or guardian will be required to attend further
counseling.

2. If the bullying resulted in serious physical injuries or death, the case shall
be dealt with in accordance with the provisions of Republic Act 9344 and its
implementing rules and procedures:

2.1The child and the parents or guardians must be informed of the


complaint through writing.

2.2 The child shall be given the opportunity to answer the complaint in
writing, with the assistance of the parents or guardians.

2.3 The penalty to be given by the Principal could be suspension,


exclusion, or expulsion. His/Her decision should be in writing, stating
the facts and reasons for his/her decision. However, the said decision
may be appealed.

B. RULES AND PROCEDURES IN HANDLING CHILD ABUSE, EXPLOITATION,


VIOLENCE, DISCRIMINATION CASES

1. The following acts are prohibited and shall be penalized in administrative


proceedings as Grave or Simple Misconduct depending on the gravity of
the act and its consequences:

a. Child abuse;

b. Discrimination against children;

c. Child exploitation;

d. Violence against children in school;

e. Corporal punishment; and

f. Any analogous and similar acts.

2. Upon the receipt of the complaint, the Principal must forward the said
complaint within forty-eight hours (48 hrs.) to the Disciplining Authority for
the conduct of a fact-finding investigation. The aforementioned time frame
must be strictly observed, except when justified by circumstances beyond
his/her control.
3. If a complaint is not sufficient in form, the Principal shall immediately inform
the complainant of the requirements of a formal complaint.

4. Upon the referral of the Principal or Guidance Counselor, the child victim
must be provided with an assessment and psycho-social intervention to be
given by a Municipal Social Welfare and Development Officer (MSWDO) to
help the child recover from whatever trauma he or she has experienced as
a result of the abuse. The offender shall likewise undergo psychosocial
intervention.

5. All complaints must be within the jurisdiction of the school and the
Department of Education and shall not be brought to amicable settlement
before the Barangay, subject to existing laws, rules and regulations.

6. The identity or other information that may reasonably identify the pupil,
whether victim or offender, shall be withheld from the public to protect his or
her privacy. Likewise, the Magna Carta for Public School Teachers protects
the rights of the teachers and no publicity must be given to any disciplinary
action against a teacher during the pendency of his or her case.

7. Criminal and civil case arising from child abuse, discrimination, exploitation,
violence and other acts of abuse are separate and distinct, and shall not be
a bar to the filing of an administrative case under these guidelines.
