I. INTRODUCTION
Pursuant to the 1987 Constitution, the State shall defend the right of
children to assistance, including proper care and nutrition, and special protection
from all forms of neglect, abuse, cruelty, exploitation, and other conditions
prejudicial to their development (Article XV, Section 3).
With this guideline, San Juan Elementary School reiterates a zero tolerance
policy for any act of child abuse, exploitation, violence, discrimination, bullying,
and other forms of abuse.
II. OBJECTIVES
4. To ensure that the school’s Social, Personal and Health Education program
raises awareness of the factors associated with child abuse and bullying
behavior and develops appropriate knowledge, skills and behaviors;
9. To work with, and through, the various local agencies in countering all
forms of abuse, bullying and anti-social behavior.
2. Orienting all teachers, parents, and pupils on the Child Protection Policy
and the Anti-Bullying Act during pupils’ orientation and Homeroom PTA
Conference;
4. Initiating programs in and outside the school that are intended to promote
positive and non-violent discipline.
1. In any case where it has been determined by the classroom teacher that
bullying behavior has occurred:
1.2 The victim and the offending child shall be referred to the Child
Protection Committee for counseling and other interventions.
2. If the bullying resulted in serious physical injuries or death, the case shall
be dealt with in accordance with the provisions of Republic Act 9344 and its
implementing rules and procedures:
2.2 The child shall be given the opportunity to answer the complaint in
writing, with the assistance of the parents or guardians.

2. Upon the receipt of the complaint, the Principal must forward the said
complaint within forty-eight hours (48 hrs.) to the Disciplining Authority for
the conduct of a fact-finding investigation. The aforementioned time frame
must be strictly observed, except when justified by circumstances beyond
his/her control.
3. If a complaint is not sufficient in form, the Principal shall immediately inform
the complainant of the requirements of a formal complaint.
4. Upon the referral of the Principal or Guidance Counselor, the child victim
must be provided with an assessment and psycho-social intervention to be
given by a Municipal Social Welfare and Development Officer (MSWDO) to
help the child recover from whatever trauma he or she has experienced as
a result of the abuse. The offender shall likewise undergo psychosocial
intervention.
5. All complaints must be within the jurisdiction of the school and the
Department of Education and shall not be brought to amicable settlement
before the Barangay, subject to existing laws, rules and regulations.
6. The identity or other information that may reasonably identify the pupil,
whether victim or offender, shall be withheld from the public to protect his or
her privacy. Likewise, the Magna Carta for Public School Teachers protects
the rights of the teachers and no publicity must be given to any disciplinary
action against a teacher during the pendency of his or her case.
7. Criminal and civil case arising from child abuse, discrimination, exploitation,
violence and other acts of abuse are separate and distinct, and shall not be
a bar to the filing of an administrative case under these guidelines.
