I, DING D. MABATO, am a Filipino woman of legal age who is married and a


resident of 72 B, Sampaloc Extension, North Signal Village, Taguig City. In this instance, the
plaintiff states under oath as follows:

INTRODUCTORY STATEMENT

Atty. Russel D. Mabalacit is the person conducting the examination. His address is
143 Barangay Malasin, San Jose City, Nueva Ecija. The examination will take place at the
same location. I am fully aware that I am answering his questions under oath and may face
criminal responsibility for false testimony and perjury.

The purpose of this affidavit is to establish that the Defendant, Beth Logarisma,
issued multiple DISHONORED CHECKS to Ding D. Mabato, the Complainant in this case.
It is humbly requested that this Judicial Affidavit of Ms. Beth Logarisma, be allowed as the
witness's Direct Examination to expedite the process.

DIRECT EXAMINATION QUESTIONS:

1. Q: For the record, Ms. Witness, please provide your name and other pertinent personal
information.

A: My name is Beth Logarisma. I am 30 years old, Filipino, married, and a resident 72 B,


Sampaloc Extension, North Signal Village, Taguig City

2. Q: Are you the same person who filed the complaint in this case?

A: Indeed, I am.
3. Q: Are you familiar with a particular Ding D. Mabato?

A: Indeed, I do.

4. Q: How did you become acquainted with her?

A: She is a close friend of the family. She came into my house one day and asked if she could
loan me some money since she needed it for her mother's medicine, and to ensure payment,
she produced ten (10) postdated checks. I accepted since her mother is a very good friend of
mine; they are almost family to me.

5. Q: When did this occur? Are you recalling?

A: This did occur on May 20, 2017.

6. Q: How much was the check she issued? Are you recalling?

Yes. Each check was for Php100,000.00, for a total of Php 1,000,000.00.

7. Q: What did you do when she issued the check? Which, if any?

A: Well, I sent her a check for Php 1,000,000.00.

8. Q: Returning to the check, what was the bank's name? Would you be able to tell me which
branch?

Yes. It was a Metrobank Check drawn on the A.S. Fortuna Branch of Metrobank.

9. Q: I'm presenting you with a Metrobank check drawn on the same account as Annex "A."
"Could you please confirm that this is the same check as the one provided to you by Ms.
Logarisma?

A: That is correct.

10. Q: Was there anything more that Ms. Logarisma did at the time she issued the check?

A. Yes. She assured me that the check is valid and that adequate cash will be available to
cover it when submitted for payment.

11. Q: What did you do after Ms. Logarisma issued the check? Which, if any?

A: When the check became due, I deposited it in my account.

12. Q: What occurred after you deposited the cheque, if anything?

A: I was taken aback when my bank notified me that the checks issued by Ms. Logarisma had
bounced. The bank notified me that the transaction was unsuccessful owing to 'insufficient
money.'

13. Q: What did you do after learning of the dishonored check? Which, if any?
A: I immediately notified Ms. Logarisma of the bounced check and requested that she make
good on it within five days.

14. Q: You stated that you made a demand; how did you go about doing so?
Was this a verbal or written exchange?

A: I initially called her and then wrote her a written demand.

15. Q: Presenting you with a demand letter, annexed as Annex "B" "Could you please
confirm that this is the identical demand letter you issued to Ms. Logarisma?

A: That is indeed the demand letter I sent her.

16. Q: What occurred when you delivered the demand letter? If any?

A: She contacted my house, apologized for the oversight, and offered to bring another check
in two weeks to reimburse the cost.

17. Q: What occurred after two weeks? What, if anything, did you do?

A: Because she did not come to my residence or issue me fresh checks, I attempted to reach
Ms. Logarisma directly on her phone, but she refused to answer my calls.

18. Q: What did you do after she refused to take your calls? If any?

A: I conferred once again with my Legal Counsel.

19. Q: What occurred after you spoke with your Legal Counsel? Which, if any?

A: On July 2, 2017, my legal counsel issued a formal demand letter to the Respondent
through registered mail with return receipt, which was received on July 4, 2017.

Q: Can you confirm that the demand letter attached as Annex "C" is the identical one that
your lawyers delivered to Ms. Logarisma?

A: That is indeed the demand letter we issued her.

21. Q: What occurred next, if anything, after Ms. Logarisma got the demand letter?

A: None. She continues to defy the payment demand.

22. Q: Has the sum of Php1,000,000.00 been paid as of this date?

A. No. Ms. Logarisma has not returned a single centavo of the money I loaned her.

1. Give legal consequences of lying on an affidavit? Explain.

Juries and judges frequently rely on sworn evidence and signed papers to arrive at
their convictions, punishments, or other significant decisions. Under oath, statements and
certain legal documents are considered to be accurate or made in good faith. However, how
can we be sure that witnesses and other participants in a judicial proceeding are truthful?
While we cannot always be specific, people who intentionally mislead a court face significant
criminal accusations of PERJURY. To PERJURE oneself is to intentionally make FALSE
STATEMENTS UNDER OBSERVATION intentionally or sign a legal document that you
know is false or misleading. Because the judicial system's basis is built on trust and
trustworthiness, the crime is taken quite severely. After all, a single sworn declaration can tip
the balance of justice and significantly impact someone's life. Perjury is regarded as a crime
against justice, as it jeopardizes the authority of courts, grand juries, governing bodies, and
public authorities when they lie under oath. Criminal contempt of court, probation violation,
and evidence tampering are further offences against justice.

2. Write an essay about the Importance of having a knowledge in signing an Affidavit.

An affidavit is a written or typed declaration of facts under oath, also known as an


affidavit. Due to the realities of crucial information utilized in the investigations, a sworn
statement is used. Sworn testimonies of the witnesses vary according to the purpose and
usage of the paper. The most frequent declarations of sworn witnesses concerning criminal
investigations are those made by the police or other officers. In civil proceedings, Sworn
Testimony Statements may also be utilized, though generally by lawyers. Every individual
may make a witness statement, but it only becomes a sworn statement of a witness when he is
promised to be truthful to a Commissioner of Evaluation.

An unsworn testimony differs only in one manner compared to a sworn deposition,


which is that it cannot be used for obtaining/obtaining warrants. Unworn statements by
witnesses are essential because they provide us with information that may be used to
interrogate and compare the facts of witnesses. When an unsworn declaration is used as
evidence, many supporting points must be shown to support the finding.

COMPLAINT AFFIDAVIT

I, Bridgette A. Roxas, of legal age, Filipino and a resident of #9 Blk 89 lot 4


Phase 1 Sampaloc st. Barangay Upper Bicutan Taguig City, after having been duly
sworn to according to law hereby depose and say:

(1) I am filing a complaint under the Article 308 of the Revised Penal Code for
Theft against Ms. Charline Geconcillo, a legal age and a resident of #3 Blk
53 lot 7 Phase 4 Nara St. Barangay Upper Bicutan Taguig City.

(2) The respondent was referred to me by an acquaintance at work, Ms Rochelle


Jaca, right after I mention that I need a house helper in duration three
months. The respondent likewise informed that I needed a house hold helper,
and through Ms. Jaca, we exchange phone numbers and agreed on a day in
which the respondent will start with his duties.

(3) On March 18th, 2021, the respondent arrived at 2 PM; I oriented her to her
duties and showed her around my house in order to familiarize her with her
in the area.

(4) The following day, she officially started her duties as a part of the house hold
help. I left home for work at 6:30 AM; after giving her instructions on what
to do for the rest of the day. I arrived home from work at 7 PM and checked
if all her task were accomplished. Everything was in order.

(5) We followed the same routine for one week. On March 25 th, 2021, when the
respondent was out on a day off, I was going through my bedside table were
my gadgets is. I was not able to find my laptop and decided to ask the
respondent if she had seen it through a text message. she replied she had not
seen the loptop but volunteered to look for it once she returned. However I
forgotten to ask her about it the following day.
(6) Two weeks had passed after that incident before I noticed that something was
amiss. April 14th, 2021, when a respondent had her day off. I noticed that
some of my jewelleries were missing. I also could not find some of my
designers shirts that I owned and I also check my drawers that day and I
discovered my 45 calibre pistol and iPod has been taken as well .

(7) I decided to report the incident to the police the same day, but before I left
my house my neighbour, Ms. Ester Manalo, approached me and said that she
kept seeing the respondent talking to a man by the gate and saw on April 5 th,
2021, between 10to 11 AM, that said man was permitted to enter the house
by the respondent and later exited the premises while carrying the
respondent’s belongings with the addition of a big brown bag.

(8) I reported the incident on that same day and tried to contact the respondent,
but she could not be reached and never showed up for work thereafter.

(9) Her acts are clearly within the purview of the Article 310 of the Revised
Penal Code, as she had taken personal belongings without consent and
without employing violence, intimidation and threat upon the rightful owner,
with grave abuse of confidence.

INTRODUCTION: Give legal consequences of lying on an affidavit.

Lying on a sworn affidavit can be a serious offense depending on a jurisdiction.


Perjury is a serious offense that is the consequence if you lied on your oath testimony
in court. Wherein, perjury happens to people who under oath the witness have vowed
to tell the truth to the authorized administer of the oath such as judge or prosecutor you
have sign the statement and swear that everything on that testimony is truth. Saying
something that is not true in an affidavit is a violation of the law that you can be fined
or imprison.
Lying on an affidavit is a serious legal offense; it is considered a crime and can lead to
arrest and detainment of the accused. And an individual who lied in a sworn affidavit
will had a permanent criminal record.

Affidavit is a written statement that is confirmed by oath that all the statements
that you said are truth.
You sign an affidavit without personal knowledge. That it contains false
information that can mislead a case and the subject or affiant that will lead you to
criminal penalties, legal offense, fine and perjury.
Because when you sign an affidavit you are asserting that the statements is true and you
have a personal knowledge to the facts that contained in that affidavit. And if you sign
it you already stating that you are competent enough to testify in court about the
information that you provided and written in the affidavit and can also are used as
evidence towards the accused.

1.) That I am formally charging respondent ELMER C. TUDAK, with postal


address at no. 789 Magsaysay Road, Barangay South Signal Village Taguig City, for
the crime of Slight Physical Injuries penalized under Art. 266 of the Revised Penal
Code, committed as follows;
(a.) That sometime March 3, 2021, while I was standing in front of my
house, I saw the respondent throwing their garbage beside my house, and I
immediately called his attention regarding his wrong practice of disposing of his
garbage.
(b.) That due to the same, respondent got irritated and a heated argument
ensued between us;
(c.) THAT while having the said argument with the respondent, he
suddenly approached me, punched my face twice which made me fall down on
the ground;
(d.) That on the same day, I went to the Recuenco General Hospital to
have an examination of my swollen face and the injuries I sustained, and the
doctor recommended for a healing and rest period of seven (7) days. Copy of
the Medical certificate is attached as Annex A hereof;
(e.)That also, as a consequence of the swelling of my face I was not able
to report for work for seven (7) days; f. That on March 3, 2021, I filed a
complaint before the barangay, and after several hearings, no amicable
settlement was reached between the parties as evidence the Certificate to File
Action which is hereto attached as Annex
3. That I am executing this affidavit to attest to the truth of the foregoing
statements, and for the purpose of charging respondent ELMER C. TUDAK for the
crime of Slight Physical Injuries penalized under Art. 266 of the Revised Penal Code.

Affidavit perjury can result in criminal charges and criminal convictions for the
involved officers. Perjury is the act of willful giving false testimony aster giving an
oath or affirmation to speak the truth. For example, some people lie to give themselves
an advantage or to avoid getting in trouble, when they did wrong but if someone lies on
his say they can be punished by the judge at trial. To “PERJURE” yourself is to
knowingly make misleading or FALSE STATEMENTS under oath or o sign a legal
document you know to be a false or misleading. The crime is taken very seriously
because the foundation of the legal system depends on trust and credibility. After all,
just one sworn statement has the power to the scales of justice and dramatically alter
someone’s life. When the truth is discovered, the judge may impose a fine, assign
additional litigation costs, or dismiss the case entirely if it was brought by the party
who provided false information.

For me, The Importance of having a knowledge in signing an Affidavit is very


important to have a personal knowledge to signing an affidavit because you aware and
understand on how to write the affidavit wisely without difficulty
It is a sworn statement that is made under oath under any jurisdiction. And the person
who is responsible for making the statements in known as the affiant. It is a fact that as
and when you sign an affidavit form, you simply affirm that the statement is made with
complete personal knowledge. For example, you have knowledge in signing an
affidavit an Affidavit of Guardianship when we say affidavit of guardianship this is a
legal guardianship is one of the options parents can avail if they are planning for their
children’s care without them around due to a variety of situations, such as illness or
incarceration. It allows parents to appoint a caregiver and give him or her certain legal
rights regarding the care of the children.

COMPLAINT-AFFIDAVIT

I, VICTORIA E. FLORES, Filipino, Minor, and with residence at No. 69 De

Enero Road, Brgy. Central Signal Village, Taguig City, Metro Manila., after having

been duly sworn in accordance with law, hereby depose and state that:

(1) This complaint-affidavit is being filed to charge Tequiero A. Santos a.k.a

“Boy I Love You”, Filipino, of legal age, and with residence at No. 50 Cardones

Road, Brgy. North Signal Village, Taguig City, Metro Manila, of the crime of Rape

under Article (Art.) 266 of the Revised Penal Code (RPC), committed as follows:
(a) On August 21, 2019, at around 11:00 in the Evening, I was 17 years of

age, was wearing a jacket and denim pants and walking towards my house when

Tequiero A. Santos, came by and pulled me into a dark abandoned lot.

(b) I screamed for help but Tequiero continued to hurt me and started to

kiss me on my lips and neck. He then pulled out his genital organ and removed my

denim pants and underwear.

(c) While I was pinned down on my back, crying helplessly, Tequiero then

inserted his genital into my genital and started to rape me.

(d) After satisfying his lustful desires, Tequiero then said “di ka na

makakaalis dito ng buhay” and then started to put his hands around my neck and

strangle me until I passed out.

(e) Tequiero A. Santos then left, thinking I was already dead.

(2) Appalled by what happened, my mother, Salvacion E. Flores, and I went to the

police station to report the crime committed by Tequiero against my person. The

police took my sworn statement, a copy of which is hereto attached and made an

integral part hereof as Annex “A”. Thereafter, I was examined by their medico-legal

officer. A copy of the Medico-Legal Report is likewise hereto attached and made an

integral part hereof as Annex “B”.

(3) Based on the definition and elements of rape, it is beyond reasonable doubt

that respondent Tequiero A. Santos committed the crime of rape punishable under

Art. 266 of the RPC. He had sexual intercourse with me by forcing himself unto me.

This constitutes rape as defined in our laws.

1. Give legal consequences of lying on an affidavit? Explain.

To arrive at their convictions, sentences, or other critical decisions, juries and


judges typically rely on sworn evidence and signed papers. Statements and certain
legal documents are assumed to be accurate or prepared in good faith when made
under oath. But how can we be certain that witnesses and other participants in a legal
action are telling the truth? We can't always be precise, but we can try like people
who purposefully deceive a court face serious criminal charges of perjury. To
willfully make false statements under observation or sign a legal document that you
know is false or misleading is to perjure oneself. Because the foundation of the court
system is confidence and trustworthiness, the offense is treated harshly. After all, a
single sworn statement can tip the scales of justice and have a profound influence on
someone's life. Perjury is a crime against justice because it puts the authority of
courts, grand juries, governing bodies, and public officials at jeopardy when they lie
under oath. More crimes against justice include criminal contempt of court, probation
violations, and evidence tampering.

2. Write an essay about the “importance of having knowledge in signing an


Affidavit”.

In my opinion, the importance of knowing how to sign an affidavit or having


personal knowledge of how to sign an affidavit is very significant because you will be
informed and understand how to write the said document sensibly and without trouble.
It is a sworn statement given under oath in a court of law in any country and the affiant
is the individual who is in charge of making the statements.
Let us say for example, you are a lawyer, someone filed an affidavit of loss
because he or she lost something like an identification card or school ID, etc. As a
lawyer, you will make sure that his or her statement about losing an important file or
document is relevant, reliable, and true to his/her belief because it is your duty to make
sure that he/she may file this kind of affidavit based on your expertise because if you
issued an affidavit without any knowledge of it, you may put yourself or the affiant at
risk so it is important to know the affidavit that you issue.
