Swimming Pools

The installation of an in-ground swimming pool requires a zoning / building permit.


Above ground pools require a zoning permit and do not require construction
drawings.

Applications for a Swimming Pool Permit require the following:

must be submitted at the same time as the permit application submission
(see attached example)

4. Required information for contractor:


a. An affidavit of assurances, pursuant to KRS 198B.060(10)
b. Occupational license number for the city/county work is being performed
c. Proof of Kentucky Workers Compensation coverage & liability insurance

Residential swimming pool regulations are located in the 2013 Kentucky Residential
Code all others are regulated by the 2013 Kentucky Building Code. Please check
your deed restrictions as our office does not enforce these requirements.

Requirements for Residential In-Ground Swimming Pool Permits

Existing House Where a wall of a dwelling serves as


part of the barrier, special conditions
must be met. See page 2.

List access gate type, size and direction of swing. Gate must be self closing, self latching

List all diving board and pool specifications, showing that the board is designed for the pool to be installed.

Skimmer

Show pool drainage system to be installed and


list all drain sizes and drain cover types.

Dual main drain Show pool egress types and locations in-
cluding steps and ladders

List pool type and size including depths at both shallow and deep ends

Show fence type and height; include dimensions of any openings.

Diving Board and Pool Depth Specifications

Diving board and pool specifications may look similar to the drawing below. It is important to verify
the proper diving board is installed on the appropriate pool to meet all safety requirements.

Barrier Requirements

326.8 Barrier Requirements. The provisions of this section shall control the design of barriers for residential swimming
pools. These design controls are intended to provide protection against potential drownings and near drownings by re-
stricting access to swimming pools.

326.8.1 Outdoor Swimming Pool. An outdoor in-ground swimming pool shall be surrounded by a barrier which shall com-
ply with the following:
• The top of the barrier shall be at least 48 inches above grade measured on the side of the barrier which faces
away from the swimming pool.
• The maximum vertical clearance between grade and the bottom of the barrier shall be 4 inches measured on
the side of the barrier which faces away from the swimming pool.

See illustrations on pages 3 and 4 for more requirements regarding pool barriers and access gates.

326.8.1 Item 9 Where a wall of a dwelling serves as part of the barrier one of the following conditions shall be met:
• The pool shall be equipped with a powered safety cover in compliance with ASTM F 1346
• Doors with direct access to the pool through that wall shall be equipped with an alarm which produces an au-
dible warning when the door and/or its screen, if present, are opened. The alarm shall be listed and labeled in
accordance with UL 2017. The deactivation switch(es) shall be located at least 54 inches above the threshold
of the door; or
• Other means of protection, such as self-closing doors with self-latching devices, which are approved by the
governing body, shall be acceptable as long as the degree of protection afforded is not less than the protec-
tion afforded by the items described above.

326.8.4 Barrier Exceptions. Spas or hot tubs with a safety cover which comply with ASTM F 1346 shall be exempt from
the provisions of this appendix.

R326.8.3 Prohibited locations. Barriers shall be located to prohibit permanent structures, equipment or similar objects
from being used to climb them.

R326.9 Locations. Private swimming pools shall not encroach on any front or side yard required by this code or
by the governing zoning laws, unless in accordance with specific rules of the jurisdiction in which the pool is located.
A wall of a swimming pool shall not be located less than 6 feet (1829mm) from any rear or side property lines or 10 feet
(3048mm) from any street property line, unless in accordance with the specific rules of the jurisdiction in which the pool is
located.

R326.10 Entrapment Protection for Swimming Pool and Spa Suction Outlets. Suction outlets shall be designed and
installed in accordance with ANSI/APSP-7

Regulations for Various Pool Barrier Construction Types

Solid Barrier
Solid barriers which do not have openings, such as a masonry or stone
wall, shall not contain indentations or protrusions except for normal
construction tolerances and tooled masonry joints.

Pool Barriers Containing Openings


The maximum allowable spacing between vertical members of the pool barrier (fence) is determined by the distance
between the tops of the horizontal members of the pool barrier (fence).

Fence with Vertical and Horizontal Members


Where the barrier is composed of horizontal and vertical members, and the
distance between the tops of the horizontal members is less than 24 inches
(610 mm), the horizontal members shall be located on the swimming pool side of
the fence. Spacing between vertical members shall not exceed 1 3/4

members, spacing within the cutouts shall not exceed 1 3/4 inches (44 mm) in

Where the barrier is composed of horizontal and vertical members, and
the distance between the tops of the horizontal members is 24 inches
(610 mm) or more, spacing between vertical members shall not exceed 4
inches (102 mm).

Regulations for Various Pool Barrier Construction Types

Chain Link Fence or Lattice

Maximum mesh size for chain link fences shall be a 2 1/4-inch (57 mm) square, unless the fence has slats
fastened at the top or the bottom which reduce the openings to not more than 1 3/4 inches (44 mm).
Where the barrier is composed of diagonal members, such as a lattice fence, the maximum opening formed by
the diagonal members shall not be more than 1 3/4 inches (44 mm).

Pedestrian Access Gates

Access gates shall comply with the requirements of items 1 through 7, and shall be equipped to accommodate a
locking device. Pedestrian access gates shall open outward away from the pool, and shall be self-closing and have a
