EXPECTATIONS

This module was written in order to help the students understand the
different roles and powers of the President as head of the Executive branch of
the Government.

INTRODUCTION OF THE LESSON

The Constitution of the Philippines declared that the President of the country
will serve as the Head of the State and Chief Executive of the government, thus,
he/she has the executive power or the power to administer and execute the laws.

The Executive power reflects the capacity of the President to apply decision
making over state issues and implementation of the laws.

The President has the following roles, functions and power as the head of the
Executive branch of the government:

a. Appointing Power
b. Removal Power
c. Military Power
d. Pardoning Power
e. Control Power

g. Borrowing Power
h. Diplomatic Power

What Is It

APPOINTING POWER

This procedure starts at the President’s nomination to persons who are


qualified to vacant various public offices. And then, the Commission on Appointments
may approved or set aside the nomination done by the President. Lastly, the President
will provide appointment to those persons who will fill up those vacant positions in
public offices, this will signal the time of assuming the post or work. There are two
ways of Appointment: (1) Regular Appointment wherein the Congress is at session and
will follow the 3 steps and (2) Ad Interim Appointment which is done while the
Congress is at recess and the person appointed can start his work even if there is no
approval by the Commission on Appointment until such time that his appointment
will be denied.

CONTROL POWER

As the head of the Executive branch, the President has the power to direct or
command in such work in different executive departments, bureaus and offices. He
/She may modify or revised such decisions made by the head of office.

SUPERVISE POWER

The President has the power to oversee such work in different executive
departments, bureaus and offices. In this juncture the President monitor the
performance of the employees and check if the laws are implemented carefully.

MILITARY POWER

This power authorized the President to: (1) Lead the Armed Forces of the
Philippines as the Commander in Chief (2) Suspend the privilege of writ of habeas
corpus and (3) Declare Martial Law. Martial Law can only be declared if there an
invasion or rebellion and if public safety needs it, moreover, it can only be done with
the approval of the Congress.

PARDONING POWER

The act of exempting and other acts of clemency to offenders of the law. This
power: (1) cannot be done in impeachment, (2) can only be given if final verdict was
done and (3) amnesty can also be issued upon the consensus of the majority of
members of the Congress

REMOVAL POWER

The President has the power to withdraw any persons from his/her position in
different executive departments, bureaus and offices.

VETO POWER

The power given to the President to disapproved a bill or some parts of the bill
which will open a venue for modification or such revisions.

INFORMING POWER

The President will deliver a speech in front of the Filipino People about his
accomplishments, status of the country and his future plans and programs. This is
known as the State of the Nations Address (SONA)

DIPLOMATIC POWER

The President can represent the country in such deals with the members of
international community for the purpose of diplomacy and other global transactions
and commitments. He / She can also enter into agreements without approval of
Congress known as “Executive Agreement”

BORROWING POWER

The President serves as the agent of the government in borrowing money from
international financial institutions which will be used for the expenditure of the
government.

BUDGETARY POWER

Through the heads of the different executive departments, bureaus and offices,
the President will submit a general appropriation bill to the Congress reflecting the
over-all expenditure and budget of the government for a fiscal year as well as the
sources of financing and proposed procedures for revenues.
