A Barangay Ordinance Requiring All Sari-Sari Store, Food

WHEREAS, the same RA also provides the primary enforcement & responsibility of solid waste
management with LGU while establishing a cooperative effort among the national government,
other local government units, NGO’s, & the private sector which may include the row of
businesses in the locality who are also considered primary waste generators;
WHEREAS, the barangay being the lowest local governing body nearest to the people and as
provided for in the implementation of its roles and responsibilities vested in the local
government code of 1990, it is therefore the duty and obligation of the barangay to impose
significant programs to help the government in its combat against the uncontrolled generation of
solid wastes;
WHEREAS, guided by the policy of the nation to protect and advance the right of the people to
a balanced and healthful ecology in accord with the rhythm and harmony of nature as stipulated
in section 16 of the 1987 Philippine Constitution, the barangay has deemed it proper and very
necessary to require all sari-sari store, food stand and carinderia owners/operators and vendors
to put trash can/trash bin in front of their establishment & to properly manage solid wastes
generated during their operation by practicing waste segregation, hence the national goal of a
zero waste volume of the government may be achieved later in the long run;
SECTION 1. TITLE
A. There shall be established in the barangay the Community Business Solid Waste
Management Committee.
B. The Barangay Captain shall assign the focal person to head this committee and to ensure
that this ordinance is properly implemented and followed accordingly.
C. The focal person shall inspect all sari-sari stores, food stands and carinderias in the
barangay.
D. Trash bins or trash cans shall be properly labeled for identification of recyclable,
biodegradables & non-biodegradable wastes.
The Community Business Solid Waste Management of ___________ shall be composed of the
following:
1. Committee Chairman on Health & Sanitation- Heads the implementation of this Ordinance.
2.Sectoral Kagawads- Monitor the implementation of the Ordinance including any violation of
the same
3. Barangay Secretary- responsible to paper works and other important documents about this
ordinance
4. Barangay Treasurer- collects fines for any violation of this ordinance as approved by the
Sangguniang Barangay

SECTION 5. PENALTIES
Provided in Section 49 of RA 9003, any violation of section 48 paragraph 1.) “Littering, throwing,
dumping of waste matters in public places like roads, sidewalks, canals, esteros or parks &
establishments or causing or permitting the same”, shall upon conviction be punished with a
fine of not less than Php300 but not more than PHP1,000.00 or render community service for
not less than one (1) day to not more than fifteen (15) days to the barangay. The same penalty
shall be imposed to any sari-sari store, food stand & carinderia owner/operator and vendors
who fails to put trash can/trash bin in front of their establishments. Their failure is similar to an
act of permitting littering & throwing wastes elsewhere within their respective establishment
which is considered a prohibited act.
This ordinance shall takes effect within fifteen (15) days after its approval and the posting of the
full text of this ordinance in two (2) conspicuous places of the barangay.
