SUMMARY:

On 12-23-05 at 1417 Hrs I was notified of a possible homicide scene at 18460 SW Rock Creek Road, Sheridan, Yamhill County,
Oregon.

ACTION TAKEN:

I responded to the scene and met with members from the Sheriff's Office administration, Detective Sergeant CareIle and
Detective Rosario. I was briefed by Deputies LaRue and Trombla who were the first two law enforcement officers on scene. I
learned from my dispatch center that through a Department of Motor Vehicle scan, they now had information on a vehicle that
was registered to the deceased that was missing from the scene After receiving that information, I caused a state wide attempt
to locate to be placed on that vehicle, a maroon 1992 Acura Vigor with Oregon license 872-BQS. Sergeant CareIle and
Detective Rosario entered the residence for an initial scan and photographs. After Deputy Whitlow received written consent
from the victim's mother to enter the home and investigate the victim's death I facilitated activation of the State Police Crime
Laboratory to responded to the scene Shortly thereafter, my dispatch center informed me that McMinnville Police Officers had
located our Acura Vigor with Oregon license 872-BQS and that they had detained three subjects who had been associated with
that vehicle. I asked for Deputy Whitlow to respond to the location of the vehicle and Lt. Ken Summers left the scene on Rock
Creek Road, also heading for the location of the located vehicle.

Sergeant CareIle assigned Rosario and Ito interview the three subjects that McMinnville Police had detained. I drove to the
Yamhill County Jail where I found that the three subjects were Gerard Smith, Lynley Rayburn and Nathan Knapp. Rosario and I
conducted interviews with all three subjects in the Sheriff's Office interview room. Each subject was read Miranda from a
prepared card and each subject stated that they understood their rights. Each subject was advised and shown a digital tape
recorder that was on the table. After being advised of the tape recorder the recorder was turned on and the length of the
interviews were tape recorded. Those recordings were later down loaded to compact disk and also transcribed to written form.

During an initial interview with Rayburn she told us in substance that she had no idea what we were talking about. A second
interview was conducted with Rayburn after we interviewed Knapp. In Rayburn's second interview she admitted that she was
present at the victim's house between the hours on 0130 and 0330 Hrs. Rayburn appeared to be in pain and stated in
substance that she had a medical problem with an ovary. Rayburn said "I fuckin' did it" during her second interview but when
questioned about exactly what she did she would not continue. Rayburn stated to us that Knapp was not present at the victim's
house and furthermore, Rayburn stated that Knapp could not have been present because he was still lodged at the Yamhill
County Jail at the time. Rayburn did not continue her interview much longer after those statements were made.

During an interview with Knapp he stated in substance that he has no idea what we were talking about. Knapp told us that he
had been in the Yamhill County Jail and after released, he was picked up by Smith and Rayburn in the locate vehicle at Smith's
house on Moriah Lane. Rosario and I were able to confirm much of what Knapp told us and subsequently, he was released
from custody after we spoke with Richard Sly, the department head for Yamhill County Probation.

During an interview with Smith he initially told us he had no idea what we were talking about. Knapp was brought back into the
room and after that, Smith began giving details regarding the events on Rock Creek Road. Smith told us that he and Rayburn
left his house on Moriah Lane to take a walk. Smith said that he took his father's old .22 rifle with him because he planned on
shooting animals if the opportunity arose. Smith said that he did not know why he and Raybum chose to walk up the victim's
drive way but that they did and that they encountered a man and a dog in the rear open doorway to the house. Smith said that
he and Rayburn entered the home and that he was holding the rifle, telling the male resident to do what he said. Smith told us
that he does not remember the victim being tied up. Smith said that he used methamphetamine via a syringe while in the
house. Smith said that after feeling the rush of the needle he picked up his rifle that he had leaned against a wall and shot the
male resides one time in the eye. When asked why he shot the male, Smith replied that he has always wanted to feel the rush
of taking a human life and he wanted to know how it felt to be god. Smith told us that he and Rayburn had taken bank cards
from the male resident and prior to killing the man, Smith said that he told the man to give him personal identification numbers
for the cards and they had better be the right numbers or he would come back and it would be worse next time. Smith told us
that the .22 rifle would probably be in the trunk of the victim's car. Smith said that he and Rayburn drove all over in the victim's
car using the victim's bank cards at automatic teller machines. Smith was in possession of .22 caliber live rounds, bank cards
belonging to the victim and 2,020 dollars United States Currency. Refer to taped interview and transcription of same for detailed
statements from Rayburn, Knapp and Smith.

After Gerard Smith's interview was complete I swabbed his hands and face for a field test kit gunshot residue test. The field test
was inconclusive, After all interviews were completed I drafted two probable cause affidavits for Smith and Rayburn. Both
Smith and Rayburn had been taken back to the jail after the interviews by jail staff. I walked the probable cause affidavits and
booking sheets completed by Rosario to the jail and both Rayburn and Smith were lodged on YCSO charges.

On 12-27-05 I prepared an affidavit for search warrant which was signed by Yamhill County Circuit Court Judge Jones at 1040
Hrs. Same date at 1500 Hrs I executed the mentioned search warrant on the 1992 Acura Vigor which was being stored inside
the locked patrol boat shed at the Yamhill County Shops, 2060 Lafayette Avenue, McMinnville, Yamhill County, Oregon. The
warrant was read to the vehicle, the vehicle was placed on a flat bed tow truck, a copy of the warrant was placed inside the
vehicle and the vehicle was towed to the Oregon State Police Crime Laboratory, located at 13309 84th Avenue, Clackamas,
Oregon. Sergeant Carelle later told me that he followed the tow truck from the Yamhill County Shops to the State Police Crime
Laboratory and that he was able to keep the vehicle in his sight the entire time. Carelle told me that the vehicle was being
locked in an indoor storage facility at the crime lab.

On 12-28-05 at about 0830 Hrs I arrived at the State Police Crime Laboratory and I met with Rhonda Banks, a forensic scientist,
employed by the Oregon State Police. Rhonda and I were later assisted by Hector Hernandez, also from the crime lab, in
searching the 1992 Acura Vigor for evidence. Hector recovered latent fingerprints from the vehicle which he kept in his
possession. I took possession of the other evidence which I transported back to the locked detective office inside the Yamhill
County Sheriff's Office. That evidence was later photographed and logged as ER items on seventeen (17) pages of Sheriffs
Evidence Receipt forms.

On 12-30-06 I prepared a second affidavit for search warrant, covering three cellular telephones and one digital camera that
were seized during the first search warrant on the vehicle. The second warrant was signed by Yamhill County Circuit Court
Judge Jones on 12-30-05 at 1357 Hrs. On 01-03-05 at 1010 Hrs I executed the second search warrant inside the Yamhill
County Sheriff's Detective Office, 535 5th Street room 143, McMinnville, Yamhill County, Oregon. The warrant was read to the
property and evidence was then seized from that property.

On 01-04-06 I received a packet of copied letters from jail staff. Three of these letters were addressed to Gerard Smith at the
Yamhill County Jail and they were from Nathan Knapp and Gerard's parents. I also received one letter addressed to Lynley
Raybum at the Yamhill County Jail. That letter was sent from Nathan Knapp. I read all the letters that were delivered to me and
I found nothing written with regards to this case. The letters were placed in the case file.

On 01-05-06 I learned that Lynley Rayburn had been transferred to the Polk County Jail. I made contact with Sergeant Shipley
at the Polk County Jail and I asked Shipley to make copies of all in and out mail from Rayburn. I also asked Shipley to record al
telephone calls that Rayburn makes from that facility. My final request was that she record any visitations and document who
the visitor was along with the date and time of the visit. Sergeant Shipley told me that she would take my requests to her jail
commander but she did not think that any of the requests would constitute a problem.

On 01-06-06 at 1340 Hrs I interviewed Kathryn Mueller at Willamina High School. Kathryn told me that she and her husband
live at 17901 Rock Creek Road and that they own the property at 18211 Rock Creek Road, Sheridan. Kathryn said that last
summer Lynley Rayburn was living at the 18211 Rock Creek Road address with a man named Justin Barkley. Kathryn told me
that Lynley and Justin were boyfriend/girlfriend while they lived at that address Kathryn said that her husband located a stolen
car on the 18211 Rock Creek Road property in August 2005 and as a result, they asked Lynley and Justin to vacate the property
on September 1st 2005. Kathryn told me that Lynley and Justin moved in with the Smith's on Moriah Lane when they vacated
the 18211 Rock Creek Road address and that as she understood it, Lynley became AJ Smith's girlfriend shortly thereafter.
Kathryn told me that Justin Barkley's parents live on East Rock Creek Road and that Justin works at TJ's ps station in
Sheridan. Kathryn could not make any connection between Gerard (AJ) Smith, Lynley Rayburn and the victim, Dale Rost.
Kathryn told me that it is common knowledge in the community that Rost was a recluse and she stated that she has never seen
any activity to speak of at his trailer. Kathryn told me that to her knowledge, Rost lived alone.

On 01-10-06 at about 1000 Hrs I made contact with Gerard Smith in the Yamhill County Jail. I asked Gerard if he had spoken to
his attorney about giving palm prints and he said that he had not. I read Gerard an e-mail that had been forwarded to me by
Brad Berry. The e-mail, I was told by Berry, was authored by Smith's attorney and it stated in substance that he would submit to
palm prints being taken but that Smith was not to be interviewed or questioned in any way about this case. I complied with the
attorney's wishes and Smith complied with my request for prints. The prints were taken by Corporal Saunders who is employed
in the Yamhill County Jail. The palm prints will be sent to the Oregon State Police Forensic Laboratory.

On 01-10-06 I prepared an affidavit for search warrant and at 1204 His I received a search warrant signed by Yamhill County
Circuit Judge Jones. Same date I executed that warrant at the Polk County Jail and took palm prints and a hair sample from
Lynley Rayburn. The warrant was read to Lynley prior to any action being taken. Lynley agreed to cooperate with the warrant.
Lynley removed her own hair sample from her head and handed the sample to me for packaging. A copy of a property sheet
was left with Lynley after the evidence was recovered. The palm prints and hair will be sent to the Oregon State Police Forensic
Laboratory.

ACTIONS TAKEN:

On December 23rd, 2005 at approximately 1415 hrs, I was dispatched by YCOM to a homicide that had occurred at 18460 SW
Rock Creek Road, Sheridan. On arrival, I met with Detective Todd Steele and Detective Sergeant Jim CareIle. I was told that
Deputy LaRue had arrived on scene where a white adult male, later identified as Dale Rost was found in the kitchen with some
sort of injury on the head. The house had been torn apart and ransacked, and the male subject was tied down and hog-tied. I
was also later notified that the Oregon State Police Crime Lab would be responding to process the residence.

At approximately 1615 hrs, Sgt CareIle and I walked into the scene which is described as a doublewide mobile home. The
mobile home is located at the end of an approximately 100-yard gravel and mud, uphill, driveway. The mobile home can only
been seen partially from the road. When we arrived at the top of the driveway, we noticed tire tracks that were photographed
and protected for the crime lab. Sgt CareIle and I donned some protective equipment for preservation of the crime scene, and
approached the front door. To the left of the front door we were able to see numerous beer cans. The front door had the mark
of a boot print; I was later notified that that boot print had been done by fire personnel in attempting to gain access into the
residence to check on the deceased.

Detective Sergeant CareIle and I entered the residence. The residence was completely in disarray. Right in front of the front
door was a green and red couch, which had been overturned. On top of the couch there were some clothing, ashtrays and
other items. To the left of the door there were numerous bottles of alcoholic beverages that had been left there. Looking above
a little wall in the entryway, I was able to see the body of a naked man with black hair, tied down with a white color material and
a green string on his legs.

. In addition to the first overturned couch, to the right there was a kind of tannish brown couch that had been overturned, and
things had been placed on top of the couch. I later noticed that the living room could be considered the living quarters for the
entire mobile home. AN was on and placed on an entertainment center that had family pictures. A Christmas tree was also in
the living room. Behind the Christmas tree was another couch, and on that couch was a metallic box was found. The box has a
metal hasp but it was missing a padlock. It was very clear and apparent that the house had been very low kept, garbage
scattered everywhere, animal feces everywhere on the carpet and the kitchen area, water spilled, food that had been left on top
of tables and counters for numerous days. Alcoholic beverage containers were left everywhere, unopened and opened drinks
left out, and items that had been recently purchased or received via mail, but not touched, or left in the place they were put in
the first time. It appears that the cat had a litter box, and litter was spread all over the residence. Refer to photographs.

The rest of the house, to the left there is a bedroom with a bed that was the only bed we were able to see in the residence, but
had not been used for sleeping. It was cluttered and packed with boxes and plastic containers. The second bedroom was also
in the same disarray; a mattress was there, but in an upright position. There was an old refrigerator door there. It appears that
Mr. Rost was living most of the day in the living room and only used the shower in the last bathroom, located in the second
bedroom, and the toilet and sink in the first bathroom, located across from the first bedroom.

Sgt Carelle and I then inspected the body of Dale Rost. The body was lying on the kitchen floor, but the head and right shoulder
were on the carpet side toward the dining room area. The body was bound around the legs with a dark green lead cable, and
that cable went to the victim's back. At that time we did not move the victim to find out where it was attached. We also noticed
that the victim's hands and arms were tied together with a white electric cord. Even though I could not see if the white cord and
the green cable were connected, the body was in a position that is normally called a hog tie. The body of Mr. Rost was nude.
Upon closer examination, I was able to see a small amount of blood that had pooled in the right eye, and it seemed that the
blood in that location had roll in two different directions. He had blood on the right side of his head, and also to the left, so it
appeared that the head had been moved while he was still bleeding. There was some blood on the right ear and on the carpet
below his head, but we were not able to make a decision about what caused the injury. Photographs of the body and the
residence were taken.

As we exited the house, we were notified that the two suspects, later identified as Lynley Rayburn and Gerard Smith, along with
a Nathan Knapp, had been arrested in the City of McMinnville by the McMinnville Police Department as they had been seen
driving the Acura registered to Dale Rost. I was requested to accompany Detective Todd Steele in trying to interview all three
suspects.

As I arrived in the city of McMinnville, I was notified that all three suspects were being transported to the Yamhill County Jail, anc
their vehicle was in the process of being towed into a secure location at the Yamhill County shops.

The first person that we interviewed was Lynley Rayburn. That interview was conducted at the Yamhill County Sheriff's Office.
She was brought into our interview room where she was advised of her Miranda Rights. At the beginning, Lynley did not
disclose any information, that she did not remember, and she told us that she does not want to talk anymore. She was then
turned back into the Yamhill County jail.

Her interview was recorded and she was advised about the recording. During the strip search of her body when we were
collecting her clothing for evidence, it was discovered that in her vaginal area she was hiding a small amount of a leafy, green
substance later identified as marijuana. This marijuana was in a plastic bag.

We then interviewed Nathan Knapp. Nathan was advised of his Miranda Rights and he was told that his interview was going to
be recorded. During the interview Nathan told us that he knew nothing of the incident. When we confronted him about the
vehicle belonging to a deceased person, and that we believe that his friends Lynley and Gerard Smith were the people who
killed the owner of the car. Nathan changed his attitude and told us that he had nothing to do with it, but he will help us to find
out the truth. It was later discovered that Nathan had been incarcerated until the noon hour of the 23rd of December and was
not a participant of the murder.

Detective Steele and I then decided to bring back Lynley into the interview room, where she met with Nathan Knapp. Nathan
requested Lynley to tell the truth about the incident. Lynley then looked at us and stated, "I fucking did it," "I fucking kill him," thal
Nathan had nothing to do with it.

I then advised Lynley that we were turning the tape recorder on and during that time Lynley told us that, with a very bad manner
and attitude, that she indeed did it. She stated, "I fucking did it', but she then indicated to us that she didn't want to talk to us
anymore. She indicated that she was aware of her rights and then would not talk to us.

Lynley was then returned to the Yamhill County Jail and Mr. Knapp was placed in the briefing room with other deputies. We ther
brought Mr. Gerard Smith downstairs.

Mr. Smith was advised of his Miranda Rights and he was advised that we would record his statements. In the beginning Mr.
Smith denied knowing anything about the incident, and that he would not make any more statements, but he did not invoke his
rights. A few minutes later I left the interview room and contacted Mr. Knapp. I told Mr. Knapp that I thought he had more
information that he had not given to me. Mr. Knapp then told me that when he was in the car he heard his friend AJ, referring to
Gerard Smith, and Lynley making comments and joking that they killed the fool, but that he thought they were referring to a song
that was playing on the radio.

I then brought Mr. Knapp into the interview room where he confronted Mr. Smith about telling the truth.

After a few minutes, Mr. Smith told us that he lived in the area near the crime scene and that he and Lynley had left the house
on foot, that he took a rifle because he was going to shoot some animals if he had an opportunity. Mr. Smith also told us that he
had no idea how they ended up at the victim's house, but that he does remember that when he approached the house he
observed the victim kicking a dog and that he got mad. They went into the house and it was between 1 and 3 in the morning.
He said they demanded money. He does not recall who tied him down, but he recalled that he got very high, that he used
methamphetamine while in the residence. He also indicated that he remembered shooting the guy with his .22 rifle, in the eye.
When he was asked why he killed this person, he indicated that he always wanted to feel the rush of taking a human's life and
that he wanted to know how it felt to be God.

When we asked him information about the whereabouts of his girlfriend Lynley, he said that she was there but he did not recall
what she was doing. Mr. Smith also made comments that he made threats toward the victim, demanding the pin number of the
credit cards that he took from the victim. He indicated that he took money from the victim's bank accounts and made other
purchases.

It was very apparent that Mr. Smith was trying to protect and cover for his girlfriend Lynley Rayburn. His attitude was very poor
when confronted about why he shot this person for money; some of his responses were "that shit happens" and definitely had
no remorse over the death of this Man.

During the interview of Gerard Smith, we asked some specific questions about the attack or the murder of Dale Rost For
example, we asked questions about who tied Mr. Rost and his response would be that he did not recall, that he didn't remember
because he was too high. We asked him about why Mr. Rost was naked, and he would angrily reply, "What do you think? Do
you think that I asked someone to do something to them" or something of that style, referring to Mr. Rost as being already
naked. At one point of the interview he looked up at us and with a smirk on his face said that he recalled the dog licking Dale
Rost's penis. Definitely there was no remorse in the shooting of Dale Rost, he made comments like "shit happens" when
referring to why he killed Dale Rost. During the interview he attempted to gain control by making exaggerated demands that
he knew were not possible. For more information refer to taped statements.

After the interview, I seized the clothing that Gerard Smith had on at the time of his arrest. Refer to evidence section.

During December 29th and 30th Deputy Michael LaRue and I did an examination of evidence of the suspects and from a search
of Dale Rost's vehicle. Refer to evidence section on this report.

During the examination of the evidence we found several receipts including some from debit and credit cards. Some of the
receipts were from Safeway, Bank of America, Walmart and Fred Meyer. On all of them it appears that Lynley and Gerard were
using the same debit card from Bank of America. A subpoena was requested for Bank of America and information of activities
on that debit card was obtained. That information indicated to us and gave us a sort of timeline of usage of the card and where
Gerard and Lynley traveled.

The first phone call that I made was on December 29th at 11:15 and that was to Bank of America to Diane Ferrenti of the
Newberg Branch. Diane told me that card 4426 5800 3203 1147 was not used and had not been active since November 29th,
2005, but for card 4426 5814 0162 9347, that card was active. The activity started at 0400 hrs at the Bank of America in
Willamina, and that was a withdrawal of cash for the total amount of $200.00. The second transaction for that card was at a US
Bank in Eugene at 0747 hrs for the total amount of $200.00 plus a $2.00 fee. The following transaction listed for that card was
at 1222 hrs at a Walmart Super Center in Eugene for the total amount of $224.18. Then there was an additional transaction at a
Fred Meyer on Division Street in Eugene, for $163.38, and that one was at 1330 hrs. The next transaction was from a Bank of
America and the time was 1625 hrs from 791 Main Street in Dallas, for $300.00, and at 1636 hrs there was a transaction for
$31.50 at the Safeway store in Dallas, and the store is marked as 4404.

At 1744 hrs there was a transaction for $312.00 at Walmart in Dallas. At 1917 hrs and at 1916 hrs there were two attempts of
withdrawing cash, one for $400.00 (1917) and $202 (1916) from an ATM located at Circle K in McMinnville.

Diane Ferrenti told me that all transactions posted on the card are three hours different They are three hours ahead because
transactions are posted in Eastem Time by the Central office. Also there might be some transactions that have not been posted
yet due to the fact that they are from private institutions or a specific private owned ATM's. With this information we were now
aware that the first transaction at the Willamina Bank of America ATM, instead of at 4:00 am it was at 1:00 am. This makes the
last transaction at the Walmart store in Dallas at 1444 hrs.

I also called the Chase Manhattan Visa card, 4266 8410 2992 5318. I talked to Herb Lorenz, at 813-584-3074. Herb told me
that that specific Visa card's last usage was on December 17th, 2005. No other transactions have been seen on that card.

At about 1300 hrs I talked to Cherise Deloria from Capital One MasterCard. Cherise is located in San Diego, California. The
Capital One card, 5291 1519 4941 5317, has not been used since it went into collections in July of 2004.

During the search and the examination of the evidence seized, we were able to determine the following: at 0100 hrs, Rayburn
and Smith were at Bank of America in Willamina where they withdrew $200.00. Then we found some receipts for a terminal
located at Shari's Restaurant in Eugene. These terminals are privately owned. In the evidence seized, we found some gift
cards from MasterCard, which are given by Key Bank to new customers. This MasterCard, they come out with a particular pin
number and they are for a total of $50.00. We found both cards in evidence, both pin numbers, and also both transactions that
were made at the Shari's Restaurant at 0427 hrs, actual time. Both of them were withdrawing $40.00 plus the terminal fee of
$1.50, for $41.50.

The second transaction was at a Eugene Wal-Mart store at 0922 hrs. This 0922 hrs is real time, not as the information from the
bank, which is three hours ahead. Then we found a receipt from Taco Bell, at 0934 hrs, where they spent $5.27. This Taco Bell
is located on 11th Street in Eugene. We also found the receipt from Fred Meyer in Division St in Eugene. The amount was for
$63.38, with $100 cash back, for a total of $163.38. This purchase was at 1030 hrs real time. I then contacted Bemie Phillips
from the Fred Meyer Store, at 541-461-1426, and requested information of video surveillance so we can see the individuals

doing purchases. Later on that afternoon I received a call from Bernie indicating that a video surveillance was being sent to our
office where we can see both male and female doing the purchases in Eugene.

One receipt that we located was from a Bank of America withdrawal for $300.00. This receipt indicated that it happened at 1:25
pm in Dallas Oregon. At 1:37 pm it was figured that they went to a Safeway store, where they went to the Starbucks store insidE
and the purchase was for $11.50 with $20 cash back, for a total of $31.50. At 1445 hrs, Rayburn and Smith were at Wal-Mart in
Dallas. Refer to attached receipts and attached information from Bank of America.

On January 3rd, 2005, I received two CDs with video surveillance showing Smith and Rayburn entering and shopping in the
Fred Meyers in Eugene. Rayburn is the only one at the cash register paying for the items.

SUMMARY:

ON TUESDAY, FEBRUARY 21, 2006 AT ABOUT 6:50 PM I LEARNED THAT INMATE ENGLEMAN WAS BEING RE-BOOKED
INTO JAIL FROM POLK COUNTY JAIL AND WANTED TO TALKED ABOUT THE RAYBURN/ SMITH MURDER
INVESTIGATION.

AT ABOUT 7:00 PM I MET WITH SHERRY ENGLEMAN AT THE SHERIFFS OFFICE INTERVIEW ROOM. SHERRY TOLD
ME SHE WAS A CELL MATE WITH LINDLEY RAYBURN FOR THE PAST 2 WEEKS AND THAT LINDLEY TALKED WITH HER
ABOUT DETAILS CONCERNING THE SHOOTING DEATH OF DALE ROST.

I ASKED SHERRY IF SHE WAS CONCERNED ABOUT TALK TO ME SINCE SHE IS AN INMATE AND SHE WOULD BE
CONSIDERED A SNITCH? SHERRY TOLD ME NO THAT SHE HAS LEARNED OVER THE YEARS ABOUT HER
IRRESPONSIBILITY BEHAVIOR USING DRUGS, COMMITTING CRIMES AND BEING A LIAR THAT SHE NEEDED TO
CHANGER HER LIVE AROUND. SHERRY SAID SHE HAS DONE JUST THAT RECENTLY AND SHE HAS CHANGED HER
LIFE'S PHILOSOPHY TO BEING A GOOD PERSON, BEING HONEST AND HELPING OTHERS.

CHANGER HER LIVE AROUND. SHERRY SAID SHE HAS DONE JUST THAT RECENTLY AND SHE HAS CHANGED HER
LIFE'S PHILOSOPHY TO BEING A GOOD PERSON, BEING HONEST AND HELPING OTHERS.

LINDLEY TOLD SHERRY THAT SHE AND AJ SMITH ARE BOYFRIEND/GIRLFRIEND AND HAVE BEEN FOR AWHILE.
LINDLEY TOLD SHERRY THAT SHE HAD BEEN A MARIJUANA AND HEAVY METH USER SINCE SHE WAS AGE 12.
LINDLEY SAID THAT HER PARENTS GAVE UP ON HER AND SHE HAS HAD NO CONTACT WITH THEM FOR SEVERAL
YEARS BECAUSE OF HER DRUG USE / ABUSE.

LINDLEY TOLD SHERRY THAT SHE AND AJ SMITH GOT A LARGE AMOUNT OF DOPE - 1/4 OUNCE OF METH THAT DAY
AND WERE USING AT HIS PARENTS HOUSE. LINDLEY SAID SHE AND AJ KNEW THE GUY THAT WAS KILLED, THEY
KNEW HE HAD A CAR AND HAD MONEY. LINDLEY SAID THEY GOT HIGH BEFORE THEY KILLED THE GUY. THEY TOOK
THE GUYS CAR AND MONEY AND THINGS. LINDLEY SAID THEY WENT TO GRAND RONDE THAT DAY AND GOT THE
GUN AT LARRY BRANDON'S PLACE. LINDLEY SAID THINGS DIDN'T GO THE WAY THEY WANTED IT TO GO, AJ TAPED
THE GUY UP AND THEY GOT HIGH BEFORE THEY DID IT. LINDLEY SAID SHE KNEW SOMETHING WAS GOING TO
HAPPEN. LINDLEY SAID THEY POINT THE GUN AT THE GUY AND PULLED THE TRIGGER AND AFTER HE WAS SHOT
THEY BOTH FREAKED OUT AND WERE VERY PARANOID. LINDLEY SAID THERE WAS BLOOD EVERY WHERE.

LINDLEY SAID THEY GOT INTO THE GUY'S CAR AND LEFT. LINDLEY SAID THEY DROVE AROUND AND LATER WENT
TO THE MCMINNVILLE CIRCLE K STORE AND TO YCAP IN MCMINNVILLE. LINDLEY SAID THEY PICKED UP A FRIEND
AND THEY LATER THE POLICE CAUGHT THEM AT THE YCAP FOOD STORE AND PUSHED THEM TO THE GROUND
AND ARRESTED THEM

LINDLEY TOLD SHERRY THAT SHE AND AJ SMITH ARE WRITING LETTERS BACK AND FORTH THROUGH THIRD
PARTIES WHO SEND THE LETTERS ON. LINDLEY SAID SHE AND AJ KNOW THAT THE JAIL STAFF MONITORS AND
REVIEWS THEIR LETTERS.

SHERRY SAID THAT LINDLEY SOUNDS SORRY AND REMORSEFUL ABOUT THE WHOLE INCIDENT BUT BLAMES ALL
OF HER PROBLEMS ON DRUG USE / DRUG ADDICTION

SHERRY SAID BY TALKING WITH LINDLEY SHE IS AWARE THAT LINDLEY AND AJ SMITH WILL PROTECT EACH OTHER
THROUGH THIS WHOLE THING. SHERRY SAID THAT LINDLEY IS WORRIED ABOUT THE ISSUE OF THE DEATH
PENALTY.

SUMMARY: On August 16, 2006 at 0959 Hrs Detective Rosario and I interviewed Nathan Knapp in a taped interview room at
the Yamhill County Sheriffs Office. Nathan was advised that the interview was being taped and he further stated that he was
willing to testify to the facts that he was presenting us with. In summary, Nathan admitted that he had not told us all the details
he knew during our initial interview with him after he was taken into custody with Rayburn and Smith in McMinnville. I showed
Nathan a written report that Smith's defense team had provided, which indicated Nathan had made statements to "Lilly", AJ
Smith's sister. I asked Nathan if the things he told Lilly were true and he stated that they were. We then broke those
statements down and went over them one by one. Nathan stated that he did not think he said anything about bloody bullets or
meth in AJ's pocket but that he did say the other things to Lilly. I asked Nathan how he came to know the details that he
repeated to Lilly. Nathan said that AJ and Lynley told him these things the night they were all arrested in McMinnville. Nathan
said that the conversation with AJ and Lynley happened in the vehicle they were all riding in and that it occurred between
Sheridan, where he was picked up and McMinnville, where they were arrested.

Nathan told us that when he got into the vehicle with Lynley and AJ at AJ's house, he knew the car did not belong to them.
Nathan did admit that AJ told him they were riding in a dead man's car and that Lynley confirmed that statement by saying yea,
you are. Nathan said that Lynley was at times, hysterical, crying a lot while they were in the car. Nathan told us that AJ was
calmer and at one point was rapping to a song. Nathan had opinions of why this crime was committed which are captured on
video but will not be recorded in this report due to lack of substance. Nathan told us that when he was picked up, both AJ and
Lynley were high. Nathan said that Lynley told him she went and looked for money while AJ held the gun on the victim.
Furthermore, Nathan also said that he was told by Lynley and AJ that Lynley stripped the victim of his clothing and tied him up
while AJ held the gun on him.

Nathan told Rosario and I that while talking to AJ and Lynley in the vehicle that he was told by both of them in a three way
conversation thatAJ wanted to leave the residence with the money and credit cards, leaving the victim alive and tied up.
Nathan said that Lynley was not in agreeance with that because she was afraid of being identified by the victim and going to
prison for what they had done. I asked Nathan if his statement to Lilly regarding AJ shooting the victim was true. Nathan said
that it was, even though earlier in the interview Nathan said that he was foggy on that. It appeared that the longer we sat with
Nathan and attempted to convince him that the truth about this incident had to come out, the more clear he became with us.
Nathan also became more cooperative after he found out I was reading from a document provided by AJ's defense team.
Nathan told us that Lynley was afraid of going to prison because she has kids and that she knew that if they left the victim alive,
they would be caught by police.

On 09-15-06 at 0848 Hrs I interviewed Sherry Engleman at the Sheriff's Office in response to an e-mail I received from Sergeant
Hausman in the Yamhill County Jail. This interview was copied to cid and the interview concluded at 0901 Hrs. In substance,
Sherry told me that she has been cell mates with Lynley Rayburn two times and for each time, the length of stay was about
fifteen days. Sherry told me that about five days ago, while in the Polk County Jail with Rayburn, Rayburn told her that she had
been inside the victim's house, seated at his table eating his food while he was taped up right next to her. Sherry said that
Rayburn continued to state that she was there when the trigger went off and it got all over her. Sherry said that Rayburn told her
that is the last thing she remembers. Sherry told me that Rayburn stated the police could not prove that she was in the house
but that Rayburn did not elaborate on why she thought that. Sherry also said that Rayburn told her prior to being arrested at
YCAP they had gone to circle K to get something to drink.
