Terms & Conditions:
1. Work shall be carried out as per drawing/ instruction and direction of PIC/EIC.
2. Above said vendor shall be hereby called as Piece Rate Worker (PRW).
3. Only completed work to the satisfaction of the Project-In-Charge of SICL will be measured & considered for payment.
4. Payment Terms:
a. Running Account Bills are to be submitted fortnightly and payments also will be released fortnightly after the final certification by the
Project-In-Charge of SICL.
b. Advance can be considered based on the work done at site based on the recommendation by the Project-In-Charge of SICL.
c. Retention amount @ 5% of the gross bill value to be deducted from each RA bill and will be released after 6 months from the date of
completion of the work. This will be forfeited in case the Piece Rate Worker (PRW) stop the work before completion of the assigned work.
d. Applicable deduction towards Income tax will be made.
e. ESI & PF for the workers is in the scope of Sub Contractor and the proof same to be produced along with the bill, if the contractor fails to
produce, SICL will deduct ESI & PF, shall be applicable to all Workmen who drawing Rs.15,000/month or less • ESI-1.75% of the Earned
gross wages & PF-12% of the basic earned wages, this amount will be deducted from contractors bills and the same deposit to workmen
accounts or as per current wages whichever is applicable. PF of Rs.55.92/day for skilled workers & Rs.53.52.00/day for unskilled workers will
be deducted from the bills.
f. Workmen compensation policy applicable to all workmen drawing above Rs.15,000/month recovery at Rs.25/month/head (or) at the current
rate.
5. The above mentioned rates are inclusive of all tools/tackles required to complete the above said work & shall be brought by you only.
6. Any damage to company's assets & wastage of materials can not be allowed and such expenses will be recovered from bills.
7. You are liable to pay all wages due to your work men. Contractor has to declare the wages of his workmen in the approved format of SICL.
Proof of payment made should be submitted every month with signature of work men.
8. All the workers working with SICL should produce their Photo identity proof approved by Govt. Of India ( PAN card/ Aadhar card/Voter
ID/Passport/ Ration card/ Driving license).
9. SAFETY:
a. The Piece Rate Worker (PRW) is responsible for the safety for his staff/labor.
b. All workmen are insured by SICL under WC Act and premium recovered at the current rate.
c. Safety gadgets like helmets, safety belts, shall be arranged by the SICL on returnable basis to the Piece Rate Worker (PRW) in good
reusable condition.
d. Medical/ Hospital expenses will not be paid for non-fatal injuries by SICL in case the workmen at the time of accident,
I) Was under the influence of Alcohol/drugs.
II) Has violated any order/rule framed for securing the safety of workers.
III) Has willfully removed/ not wearing safety gadgets providing for safety.
10. All disputes and differences of any kind whatsoever arising out or in connection with the contract shall be referred to MD of SICL for

settlement.
11. Workers with Photo Identity cards of SICL/ Contracting Company only will be allowed to enter the Work site.
12. The court of Chennai alone shall have exclusive jurisdiction in all disputes arising out of this contract.
Undertaking by Piece Rate Worker (PRW) :
13. The Piece Rate Worker (PRW ) has clearly understood that the terms and conditions herein contained, has been negotiated by and
entered into on behalf of the Company (i.e. SICL) and the Piece Rate Worker (PRW ) understands and accepts that the Chairman, The
Managing Director, Joint Managing Director of SICL , all or any Director(s) of SICL has no part to play in the execution of these presents and
accordingly is not liable at all in contract, tort or crime in respect of this contract or any acts pertaining thereto including prior to its execution.
The Piece Rate Worker (PRW ) accordingly undertakes that under no circumstances shall he/it sue and/or prosecute the Chairman or The
Managing Director or the Joint Managing Director of SICL all or any Director(s) of SICL, in respect of the breach of any terms and conditions
herein or in respect of any acts, deeds or statements that preceded this contract and pertaining to it.
