1. This quiz is an essay type and answers shall be hand-written in yellow pad paper. No
answer sheet shall be admitted if written in coupon bonds or if it is type-written.
2. Answers may either be submitted by mail or personal delivery. If mailed the date of

of ABC Company, had the land surveyed and later filed for land registration at the Regional Trial
Court. During the proceedings, the owner of ABC Company filed its formal protest over the
application of X. Under such circumstances who has a better title? Explain.

Pedro is an owner of a parcel of land covered by an Original Certificate of Title. He went
in the US and has not yet returned to the Philippines for a long time. During such period, Juan
entered to the property of Pedro and took possession of the property, not knowing the identity
of the real owner. After 15 years, Pedro came home and upon discovering the presence of Jun
within the premises of his property, filed an ejection case against Juan but the later countered
saying that the property is already owned by him by way of prescription. If Pedro comes to you
to seek advice, what will you tell him and why?

Question no. 9 (10 points)

A new route of highway traverses the property of Bong Bong wherein a 1000 sq. m. is
taken. If Bong Bong is willing to give up his property what is the appropriate mode of acquiring
title to be applied? What if Bong Bong hesitates? Explain your answer.

A large tract of land devoted to corn owned by private person was subdivided and
distributed to tenants under PD No. 27, however, a portion of about 15 hectares planted with
banana was spared. In the implementation of RA 6557 however, DAR proceeded with the 15
hectares banana plantation and covered it. Is DAR correct in not covering 15 hectares under PD
27, Explain. Is DAR correct in covering the 15 hectares under RA 6657, explain?

A parcel of land was covered by Tax Declaration No. 12345 in the name of Juan dela
Cruz and taxes were paid under the mentioned tax declaration since 1954. In 1998, the same
property
Mysteriously registered in the name of Juana De la Cruz and since then, Juana de la Cruz took
possession until her death in the year 2000. When her heirs applied for Transfer Certificate of
Title, Juan dela Cruz protested contending that the property should be owned by him as
evidenced by the Tax Declaration 12345. If you are the judge how will you resolve the case?
