INTRODUCTION:
The research project deals with the study of the offence of criminal conspiracy and the brief
evolution of the concept of criminal conspiracy in the Indian law aspect. The offence of
criminal conspiracy in Indian law is defined in the substantive law portion in the Indian penal
code, 1860:
“section 120A defines criminal conspiracy as; When two or more persons agree to do, or
cause to be done, —1) an illegal act, or 2) an act which is not illegal by illegal means, such an
agreement is designated a criminal conspiracy: Provided that no agreement except an
agreement to commit an offence shall amount to a criminal conspiracy unless some act
besides the agreement is done by one or more parties to such agreement in pursuance thereof.
Explanation-It is immaterial whether the illegal act is the ultimate object of such agreement,
or is merely incidental to that object.”1.
There are several other provisions in the same code that deals with the other elements for
conspiracy and punishment for conspiracy etc, this research project will be provided with
detailed study of the offence of conspiracy and the elements that are required to commit,
prove, analyse the offence of conspiracy and several other elements for the occurrence of the
offence and the exceptions from the charge to avoid the punishments. The various types and
aspects conspiracy will be analysed with the intent required in it for indictment and acquittal
for defending purposes.
RESEARCH OBJECTIVES:
The main objective of this research project is to
To analyse the history and rationale behind the concept of conspiracy.
To study and analyse the degree of intent in the offence of conspiracy.
To understand the difference in the offence of conspiracy in private and public matter.
To study how the punishments are established and how the conspiracy is determined
when its ingredients and proof of the act are established.
RESEARCH PROBLEM:
The research problem in this research project will deal with the offence of conspiracy
requires the unlawful act to be committed by two or more persons constitute the offence, and
what if one among the group of conspirators was not willing to take part in the unlawful act
but the person if being wrongfully forced to take part in the unlawful act by the other but
being held liable for criminal conspiracy. Under what element of law will this act be
validated, and various hypothetical examples supported by case laws will be given to support
both the conviction and acquittal of the charge against that innocent person and the also the
charges of the other conspirators in the aspects of Indian law were the research is limited to
secondary resources for the assertion and hypothetical instances.

RESEARCH QUESTION:
The research question for this research project will be:
What are the differences in the offence of criminal conspiracy and tort of conspiracy
in India?
What is the proof or evidences that are required to prove the offence of criminal
conspiracy?
HYPOTHESIS:
The research hypothesis will consist of the subjective findings of the research problem and
question that was put forth to establish the offence and the exceptions from punishments, has
explored the problems, both practical and theoretical, that result when applying this
seemingly simple truism of criminal law and the study will be concluded with the help of
secondary resources and case laws and statues.
RESEARCH METHODOLOGY:
The research paper is based on critical study of the concept for which will be supported by
secondary methodology will be implied which involves collecting information from the
writings related to this topic of various other distinguished authors. This methodology allows
us to collect, analyze and compare the available existing literature.

CHAPTER 3: elements or ingredients that are required to the prove the offence of
conspiracy
