    restoration to the original contractor in case of ongoing works - Sanction
    Accorded - Orders issued.

    ORDER

    The Roads Wing of Public Works Department is responsible for the


    maintenance and upkeep of roads under the category of State Highways
    and Major District Roads in the State. Permission for cutting of roads for
    laying utilities such as pipelines and cables by various agencies including
    KWA, KSEB, IT Service Providers etc is being given by the Department,
    which are to be resurfaced as early as possible to make the road traffic
    worthy.
    2. In majority of the above cases, the restoration works are arranged
    by Public Works Department itself, utilising the amount deposited by the
    agency and the works are arranged by tendering. But in several cases,
    cutting permissions have to be given in roads where other works are
    arranged under Budget, NABARD, KIIFB schemes etc. In such cases the
    deposit works have to be arranged through separate tenders and will have
    to be entrusted to a separate contractor. Due to this, the original works are
    often held up and issues will be caused due to arranging two works and
    handing over the site to two different agencies in the same reach. Also, it
    becomes difficult to impose the DLP of the restoration works, since other
    works are already arranged in the same stretch.
    3. Due to the road Cutting issues and delay in arrangement of
    restoration works, the original works are delayed and the contractors of
    the original work become unwilling to execute their work and request for
    termination of contracts. This eventually lead to the further deterioration

    of the road and leads to public protests.

    4. As per the G.O read as 1st paper above, PWD have adopted the
    online system developed by KSITM for the Management of road cutting
    permissions from 01.08.2020. All road cutting permissions applications
    in Public Works Department are through this online portal. Now the
    upcoming road upgradation/maintenance works are published well in
    advance through the RoW services portal so that the other infrastructure
    service providers can plan their road cutting works before the
    commencement of road works by PWD. It has also been instructed to
    submit the request for cutting permission well in advance and remit the
    restoration amount before the actual commencement of work. In such
    cases also, the restoration works may intervene with the arranged road
    work, if arranged separately.

    5. As per the existing norms, there is no provision to entrust


    restoration works to a contractor without tendering. Considering the
    above issues, recently proposals are being submitted to Government for
    arranging the restoration works in stretches where there are works
    already arranged through the original contractor itself and sanction was
    accorded for the same. Since this issue is faced in several ongoing and
    scheduled works, the Chief Engineer, PWD, Roads as per the letter 2nd
    cited has proposed that sanction to arrange the restoration works through
    the existing contractor may be granted in order to avoid delay. In such
    cases the restoration works shall be executed by the existing contractor at
    estimate rate or agreed rate of the original contract, whichever is lower. A
    supplemental agreement has to be executed for the same. Only the
    provision for subgrade, GSB and WMM shall be included in the
    restoration part and shall be optimised in conjunction with the items in
    the original estimate. The surfacing works will be carried out as per the
    original agreement. Also provision for including the restoration estimate
    as a separate appendix has to be incorporated in the PRICE software.

    6. Government have examined the matter in detail and sanction is


    accorded for arranging the restoration works through the existing
    contractor in cases where there are existing works arranged subject to the
    following conditions.

    i. Only the provision for Sub grade, GSB and WMM shall be included in
    the restoration part and shall be optimized. The excess provisions
    observed in GSB/WMM in road restoration works shall be regulated .

    ii. The surfacing works will be carried out as per the original agreement.

    iii. Provision for including the restoration estimate as a separate appendix


    has to be incorporated in the PRICE software.

    iv. The restoration works shall be executed by the existing contractor at


    estimate rate or agreed rate of the original contract, whichever is lower.

    v. A supplemental agreement has to be executed for the restoration


    works.
