What is the jurisdiction of the Katarungang Pambarangay?

The Katarungang Pambarangay Law provides for local disputes which fall under its jurisdiction
to be resolved through mediation, conciliation, or arbitration by the Lupong Tagapamayapa
of which the Punong Barangay is the Chairman.

Mediation - Mediation is an informal and flexible dispute resolution process. The
mediator's role is to guide the parties toward their own resolution.
Conciliation - Conciliation is an alternative out-of-court dispute resolution
instrument. Like mediation, conciliation is a voluntary, flexible, confidential, and interest
based process. 
Arbitration - the use of an arbitrator to settle a dispute.

What is Original Jurisdiction?


Original jurisdiction is the right of a court to hear a case for the first time. It can be
distinguished from appellate jurisdiction which is the right of a court to review a case that has
already been heard and decided upon by a lower court. (Hear a legal case for the first time)

The term original jurisdiction refers to the question of which court has the authority
(“jurisdiction') to hear a legal case for the first time. For instance, family law court has
the authority to hear a child custody case, but not to hear a burglary case. Therefore, the
family law court has original jurisdiction

What is Exclusive jurisdiction?


Exclusive jurisdiction exists in civil procedure if one court has the power to adjudicate a case to
the exclusion of all other courts. The opposite situation is concurrent jurisdiction in which more
than one court may take jurisdiction over the case.

It exists where one court has power to adjudicate a case to the exclusion of all other courts.

Ex. MTC has jurisdiction to all offenses punishable with imprisonment not exceeding 6 years.

What is the jurisdiction of the MTC under Summary rules?


Under Section 32 (2) of BP Blg. 29, MTC shall exercise exclusive original jurisdiction over all
offenses with imprisonment not exceeding 6 years "irrespective of the amount of the amount
of fine."

Section 1251(a) provides that with one type of dispute (disputes between states), the Court's

Regional Trial Courts shall exercise exclusive original jurisdiction in all criminal cases not within

exclusive and concurrent jurisdiction of the Sandiganbayan which shall hereafter be exclusively
taken cognizance of by the latter.

What is the Appellate jurisdiction of RTC?


Appellate jurisdiction. — Regional Trial Courts shall exercise appellate jurisdiction over all cases
decided by Metropolitan Trial Courts, Municipal Trial Courts, and Municipal Circuit Trial Courts
in their respective territorial jurisdictions. Authorized to appeal case that was originally

Republic Act 8249 (February 5, 1997) further defined the jurisdiction of the Sandiganbayan,
amending for the purpose PD 1606. The Sandiganbayan (SB) tries and decides criminal and
civil cases against government officials and employees accused of “graft and corruption
“and similar other offenses.

orders of the RTC whether in the exercise of their original or appellate jurisdiction over crimes
