DIRECT EXAMINATION

Atty. Dalidig: Attorney Dalidig for the prosecution, Your Honor. We are ready for
the initial trial. We will present our witness, Your Honor.

Atty. : Atty. Abiol for the accused, Your Honor.

Judge: Call the witness.

Atty. Dalidig: May I call on the witness stand Ms. Johaymah Bagul?
We offer the testimony of this witness to prove that she is the
complaining witness and she is the owner of the stolen personal property.

Atty. Dalidig (to the witness): Ms. Bagul, do you know the accused in this case,
Mr. John Michael Palancio and Mr. Ishamel Arumpac?

Joh: Yes, ma’am.

Atty. Dalidig: Are they present in this virtual trial? And if they are, can you
describe both of the accused?

Joh: Yes, ma’am, they are present. Mr. Palancio is the one wearing eyeglasses with
a birthmark on his right temple. On the other hand, Mr. Arumpac is the one
sporting the long hair and wearing a yellow shirt.

Atty. Dalidig: Ms. Bagul, will you tell this Honorable Court how do you know
both of the accused?

Joh: Yes, ma’am. Mr. Palancio and Mr. Arumpac are my employees of my gadget
store, Abenchon Technologies located in Ayala Mall, third floor. They have worked
for me as an Inventory Clerk since 2012.

Atty. D: Ms. Bagul, will you please tell the Honorable Court what both the
Accused, John Michael V. Palancio and Ishmael B. Arumpac, did that prompted
you to file your Complaint-Affidavit for Theft against them?

Joh: On August 10, 2021, both JMr. Palancio and Mr. Arumpac stole the ten (10)
units of the Ipad Air 12.9-inch Pro Wi-Fi iPad Air 5th Generation which were
placed in the storage room of my gadget store.

Atty. D: Where were you sometime on that date?

Joh: It was around 1 o’clock in the afternoon and I was in my office.

Atty. D: What did you do around that time?


Joh: I was about to leave the store when I noticed that the storage room was
partially opened. I entered the storage room to check what was going on.

Atty D: What prompted you to enter the storage room and check what was inside?

Joh: The storage room being opened around that time was unusual and not part of
the work protocol. To be clear, the storage room should not be opened until 1:30 in
the afternoon because the employees’ lunchtime is around 12 noon until 1:30 in the
afternoon.

Atty. D: What did you do inside the storage room when you entered, if any?

Joh: I immediately checked the gadgets that were inside. I also counted the
number of boxes per gadget available based on the list of the products we ordered
as reported to me by the Purchase Officer.

Atty. D: After you counted the number of boxes per gadget, what happened
thereafter, if any?

Joh: As I counted the numbers of boxes of each product, I noticed that ten (10)
units of iPad Air were missing.

Atty. D: What kind of unit or units of iPads were missing?

Joh: The ones went missing were the iPad Air unit which has 128GB storage.
These iPads have specific serial numbers with them.

Atty. D: Can you tell the court what these specific serial numbers are?

Joh: Yes, ma’am. The specific serial numbers of these iPad Air are the following,
to wit:

Atty. D: Ms. Bagul, how much does one (1) unit of iPad Air cost?

Joh: Since the iPad Air stolen has 128GB storage, it costs SIXTY-FOUR
THOUSAND NINE HUNDRED NINETY PESOS (Php 64,990.00) each.

Atty. D: Since you said that there were 10 units missing, can you tell the
Honorable Court how much did that cost in total?

Joh: Yes, ‘a’am. That would mean that the ten (10) units of iPad Air cost SIX
HUNDRED FORTY-NINE THOUSAND AND NINE HUNDRED PESOS
(Php 649,900.00) in totality.

Atty. D: Going back, did you do anything after you found out that these items
were missing, if any?

Joh: Yes, ma’am. I called my secretary, who also serves as my personal assistant,
to call the security guard office and asked if there were any suspicious employees
who exited the building and carried ten (10) boxes of iPad Air with them.

Atty. D: What happened after your secretary called the security guard office, if
any?

Joh: We were informed by the security guard that there were two (2) employees of
mine spotted to hail a taxi and loaded boxes inside it.

Atty. D: What is the name of this security guard who informed you and your
secretary about the same?

Joh: His name is Mr. Jose Chan.

Atty. D: After Mr. Chan, the security guard, informed you, what happened
thereafter, if any?
Joh: Mr. Chan requested my presence in the security guard office to confirm the
identity of the men they detained therein and to verify the contents of the boxes
which they loaded inside the taxi.

Atty. D: What did you do thereafter, if any?

Joh: I immediately proceeded to the security guard office.

Atty. D: What happened after you arrived at the security guard office, if any?

Joh: I saw John Michael V. Palancio and Ishmael B. Arumpac sitting before Mr.
Chan. They were handcuffed.

Atty. D: What happened after you saw them handcuffed, if any?

Joh: On the table beside them, I saw the ten (10) boxes of iPad Air.

Atty. D: What did you do thereafter, if any?

Joh: I approached the table to personally check the same boxes.

Atty. D: After checking the boxes, what did you do, if any?

Joh: I was able to confirm that the boxes were bearing the same serial numbers of
those ten (10) units of iPad Air which were missing inside the storage room.

Atty. D: What happened after such confirmation, if any?

Joh: I asked Mr. Chan to call the police so that Mr. Palancio and Mr. Arumpac will
be delivered to the proper authorities and that proper judicial action may be taken.

Atty. D: Ms. Bagul, is there anything else you want to add to your testimony, if
any?

Joh: That would be all, ma’am.


Atty. D: No further questions, Your Honor.
