Though, in the compliance affidavits filed on behalf of

the respective contemnors, it has been asserted that the directions

issued by this court as well as the report submitted by the One Man

directions in the present proceedings have been reported to have

been complied with, the same is very seriously objected on behalf

of the respective employees, who are now absorbed in the respective

power utilities in Telangana. It has been pointed out that their

salaries have been calculated and paid which was being paid at the

time when they were relieved by the Andra Pradesh Power Utilities.

It is also reported that their seniority/inter-se seniority along

with other employees of the Telangana Power Utilities has also not

been fixed. It is reported on behalf of the employees, who are

now absorbed in the Telangana Power Utilities that their cases are

also required to be considered for promotion along with other

employees of Telangana Power Utilities.

Learned Senior Advocates appearing on behalf of the respective

Telangana Power Utilities/State of Telangana have stated at Bar

that the salaries to be paid to the absorbed employees shall be re-

calculated at par with the employees of the Telangana Power

Utilities similarly situated, within a period of four weeks from

today. They have also stated at the Bar that seniority shall be

fixed/re-fixed vis-a-vis the employees of the Telangana Power

Utilities also within a period of four weeks from today. They have

stated at the Bar that during the pendency of the litigation before

this Court, no promotions have been given to any of the employees

of the Telangana Power Utilities. The same is very seriously

disputed by Shri Harin P. Raval, learned Senior Advocate appearing

on behalf of the absorbed employees. According to the absorbed

employees, temporary promotions have been given. Learned Senior

Advocates appearing on behalf of the respective Telangana Power

Utilities have requested to make suitable observations directing

the respective Andhra Pradesh Power Utilities to co-operate and

send the service books of all the allocated/transferred employees,

who are now absorbed by Telangana Power Utilities.

Shri Rakesh Dwivedi, learned Senior Advocate has made a

statement with respect to promotion so far as TSGENCO and TSTRANSCO

are concerned.

Mr. Ranjit Kumar, learned Senior Advocate appearing on behalf

of the Southern Power Distribution Company/Respondent No.2 has

stated at the Bar that so far as the said power utilities are

concerned, some ad-hoc promotions were given. However, the

aforesaid are only ad-hoc and without prejudice to the rights of

the absorbed employees to get the promotion on merits.

Put up on 12.12.2022 at 2 P.M.

In the meantime, it will be open for the absorbed employees to

file rejoinder affidavit to the compliance affidavits.
