This memorandum amends Sections 6 and 7 of Rule IV of NAPOLCOM Memorandum Circular No. 2011-009 to provide an appeal mechanism for Philippine National Police (PNP) members whose applications for Total Permanent Physical Disability (TPPD) retirement have been denied. AMENDING SECTIONS 6 AND 7 OF RUIE TV OF NAPOLCOM MEMORANDUM CIRCULAR NO.


2011-OO9 ENTITTED "REVISED RUTES GOYERNING THE INVESTIGATIONAND
ADIUDICATION OF BENEFru CLAIMS OF I.INIFORMED MEMBERS OF THE PHILIPPINE
NATIONAL POLICE pi.IP)"

WHEREAS, the Commission issued Memorandum Circular No. 2011-009 entitled "Revised
Rules Governing the Investigation and Adjudication of Benefit Claims of Uniformed Members of the
Philippine National Police (FNP)";

WHEREAS, the said Memorandum Circular provides that all cases confirmed and
recommended for Totai Permanent Physical Disability (TPPD) retirement by the TPPD Board shall
be endorsed by the PNP to the Commission thru the Legal Afhirs Service (LAS) for evaluation;

WHEREAS, there is no clear provision on the recourse of applicants in case their applicarion
for TPPD has been denied or disapproved by the Medical Screening Committee for Physical or
Mental Incapacity (MSCPMD and the denial was duly approved by the Board;

WHEREAS, in order to give full opportunity to concerned PNP members to e>chaust all
possible administrative remedies to determine the merit of their application for TPPD, there is a need
to amend Section 6 @ndorsement of the Recommendation for TPPD Retirement to the Commission)
and Section 7 (Evaluation and Examination of the Application by the NAPOLCOM Medical Officer)
of Rule fV thereof to provide an appeal mechanism to a higher administrative body;

NOW I"HEREFORE, the Commission, pur$rant to its constitutional mandate to administer


and control the PNP, HAS RESOLVED TO AMEND, AS IT HEREBY AMENDS Secrions 6 and 7 of
Rule IV of Memorandum Circular No. 2011-0@, to read as follows:

"Sec. 6. Endorsement
Commission-All cases confirmed and recommended for TPPD retiremenr shall be
endorsed by the PNP to the Commission thru the Legal Affairs Service (LAS) for
evaluation.

In case of denial or disapproval of the said 4pplication for T?PD at any stage
of Section 4 and Section 5. the applicant may file a petition for re-evaluation to the
Commission thru the Legal Affairs Service (LAS) within fifteen (15) days front
receipt of a copy of the Resolution of the TPPD Board denying such claim.

The decision of the Comrdssion shall be final.

Eualuation and Examination of the Application by the NAPOLCOM


"Sec. 7,
Medical Officer. - The NAPOLCOM Medical Offrcer shall evaluate the application
and the recommendation of the PNP for the TPPD retirement of a PNF member.

In casep of denied or disapproved applications for TPPD. the NAPOTCOM


Medical Officer shall nevertheless comment on the merits of the petition.

In the evaluation of the application, the Medical Officer may require


submission of additional clinical or medical records, personally examine the
claimant PNP member or require him to undergo laboratory tests.

Thereafter, the Medical Officer shall submit his recommendation to the


Director, Legal Affairs Service who shall forward the complete records of the
application for TPPD to the Regional Director of the NAPOLCOM Regional Office
that has administrative jurisdiction over the police unit of the claimant for
Adjudication.'

All issuances and e:cisting rules and regulations inconsistent with this Circular are hereby
repealed and modified accordingly.

This Memorandum Circular shall cover all petitions that are presently filed with the
Commission for re-evaluation.
