ABOUT THE COMPETITION

Dr. Ram Manohar Lohiya National Law University is extremely proud and
excited to announce the inaugural edition of its flagship arbitration moot,
i.e. RMLNLU–Kochhar & Co. Arbitration Moot Court Competition, 2023.
This moot is being organised in association with Kochhar & Co. as the
Title Sponsor and IAMC, Hyderabad as our Exclusive Institutional Partner.

Ever since its establishment, RMLNLU has built an excellent reputation in


the mooting community. Over the years, many leading institutions and
individuals have been associated with the Moot Court Committee of the
university.

The use of arbitration as an alternative dispute resolution mechanism has


grown exponentially over the past decade. Consequently, arbitration laws
have also witnessed constant development in their interpretation and
application across the globe. Hence, the purpose of this competition is to
expose law students to the concept of arbitration in India and to provide an
enriching experience through simulated court proceedings.

As a part of the competition, the registered teams shall be required to


submit their memorials. Subsequently, top 32 teams qualifying the
memorial knockout rounds shall appear for the oral rounds to be conducted
at the University campus from 24th-26th March, 2023. Apart from the
incredible cash prizes, the top performers in the competition shall also be
awarded internships with distinguished luminaries in the arbitration field.
ABOUT RMLNLU

Dr. Ram Manohar Lohiya National Law University was established in 2005 by
the State Legislature of Uttar Pradesh. It came into existence in 2006 intending
to encourage and disseminate legal knowledge. The University instils a sense
of responsibility towards the society in the students and is committed to
promote diverse culture in the field of law. The University attempts to further
meet its objectives by organizing its flagship event, i.e., RMLNLU – Kochhar
& Co. Arbitration Moot Court Competition, 2023 with an endeavour to engage
law students from all over the country and apprise them with the concept of
arbitration by providing them an opportunity to gain a working understanding
of arbitration through simulated court proceedings.

Competition, for the past ten years and now, we are making a transition
towards a new subject matter, i.e. Arbitration Law.
ABOUT KOCHHAR & CO.

ABOUT IAMC, HYDERABAD

International Arbitration and Media Centre (IAMC), Hyderabad was


inaugurated on December 18, 2021. The Centre is the brainchild of Hon'ble
Justice (Retd.) N.V. Ramana, the then Chief Justice of Supreme Court of India.
It is equipped to handle online arbitrations and mediations via high-quality
video conferencing. It strives to encourage business entities to resolve disputes
in a timely, cost-effective and impartial manner through first-class client
service, cutting-edge technology, top-notch facilities and highly experienced
arbitrators and mediators. The Centre aims to efficiently provide new services
like Med-Arb, emergency arbitration, online arbitration and mediation, and
constantly strive to improve its services to meet stakeholders' expectations.

The Centre has a highly eminent board of Trustees composed of senior Judges
and the Law minister of Telangana overseeing the functioning of the Centre at
the policy level. It has support from the State Government and the High Court
of Telangana.

Advocate Tariq Khan, who is a renowned practising lawyer, columnist and


author with more than 60 publications in his name is the Registrar of the Centre.
ABOUT EASTERN BOOK COMPANY

In 1940s, two brothers, the Late Shri C.L. Malik and his younger brother, the
Late Shri P.L. Malik, decided on a career in law bookselling and publishing.
This acted as the foundation for establishing the Eastern Book Company

research for Supreme Court case laws. Full text
of judgments of the Supreme
Court of India, case notes and judgements of other High Courts, statutory
material, Law Commission Reports and the Constituent Assembly debates are
also present. Hundreds of volumes of law reports are accessible for legal research.

The legal database covers the Supreme Court of India, the Privy Council since

ABOUT MOOT COURT COMMITTEE

The Moot Court Committee at Dr. Ram Manohar Lohiya National Law
University, Lucknow, is the official student-run body consisting of
members across the 5 batches of the B.A. LL.B. (Hons.) program. It is
entrusted with the responsibility of administering mooting activities and
events at the University.

The Committee organises an intra-moot court competition annually to


allot National Moots. Similarly, Open Challenges are organised to allot
International Moots to the students. It also organises a number of practice
moots for the fresher batch.

In order to promote the mooting culture, the Committee further organises


various orientations and demonstrative workshops which assist the student
body in getting accustomed to the nuances of mooting.

The Committee has also been entrusted with the responsibility of


organising the flagship moot court competition of the University every
year.

With the growth of arbitration as an alternative dispute resolution


mechanism, the Committee has taken an initiative to acquaint law students
with the concept of Arbitration and provide them an enriching experience
in the form of simulated court proceedings. This year, the Committee will
be hosting the inaugural edition of the RMLNLU – Kochhar & Co.
Arbitration Moot Court Competition.
MESSAGE FROM THE VICE CHANCELLOR

It gives me immense pleasure to welcome you all to the


1st RMLNLU - Kochhar & Co. Arbitration Law Moot
Court Competition at Dr. Ram Manohar Lohiya National
Law University, Lucknow. This is an opportunity for the
new generation of lawyers to hone their skill set and
experience what their future careers could hold for them.
Moot court competitions assist you in developing your
research abilities, which are crucial for lawyers to possess
because in the end, your research will help you present
your case and defend your position. It is your research that will also assist
you in crafting a strong Moot Court Memorial that will be used as a weapon
against the opposing team. Mooting also tests one's patience and focus, which
is extremely helpful for lawyers across the globe to create a name for
themselves, which I am sure that the participating institutes and teams will
have in them to get the best possible experience in this Competition. Here,
the students receive training on how to confidently and clearly deliver their
case to the judges. You can acquire the skills you'll need through
competitions that you might not learn from only textbooks. This year's moot
court competition revolves around the area of Arbitration Law, which is an
ever-growing branch of law with many diverse aspects related to it. I wish
that all the participants find intriguing research points while working under
the ambit of this law. With that being said, I also thank and extend my

The RMLNLU-Kochhar & Co. Arbitration Moot Court Competition provides
a platform and an opportunity to the future generation of lawyers to improve
both their written and oral advocacy skills in this competitive field of law. The
Moot Court Competition has a holistic structure that provides the participants
with valuable training, experience, and feedback at the same time. Arbitration
is a very relevant area in the field of law. This Moot Court Competition is a
means to facilitate students in cumulating immense knowledge and substantial
experience in the field of Arbitration but also can learn about the virtue of
mooting. It further increases one’s confidence in public speaking and also
develops an understanding of the law. Through this Competition, participants
also get an opportunity to meet students from different law schools and
understand the uniqueness and differences that exist within the mooting
culture present both in different parts of the country as well as the world. The
networking opportunities afforded to the participants in the Competition are
immense as the participants will be able to interact with students from
different colleges. The participants can always seek expert opinions of judges
and uncover their personal aptitude and improve their shortcomings. We wish

COORDINATOR

We, at Dr. Ram Manohar Lohiya National Law


University, Lucknow are proud to host the inaugural
edition of RMLNLU - Kochhar & Co. Arbitration Law
Moot Court Competition, 2023. It has been our aim to
provide an enriching mooting experience to the future
generation of lawyers. RMLNLU and Kochhar & Co.
seek to acquaint the participants with Arbitration Law,
which is a very important and contemporary domain of
law.
Mooting is an activity that substantially helps one in honing the skills
required in handling of and dealing with legal materials. Mooting also
teaches one to thrive under pressure and manage time suitably. It also helps
one improve their ability to work in a team. It augments fluency and
enunciation, clarity of thoughts alongside acquainting the participant with
nuances of Court procedure. Mooting also makes the participant well-
versed with the particular aspects of law. It helps a great deal in
augmenting presentation and persuasion skills as well. Though there are
incentives of prizes, mooting reinforces a student’s will to participate and
excel. It offers an individual sufficient scope for uncovering personal
aptitude and potential, and helps understand one's capabilities. I look
forward to hosting a grand 1st edition of our Moot. I sincerely hope this
event is an enriching experience for everyone involved.

It is indeed an honour for Kochhar & Co. to be a part of


this excellent initiative by RMLNLU of organising an
Arbitration Law Moot Court Competition.
Moot Courts are great opportunities to gain experience
in advocacy. I have always been very fond of mooting
and truly believe that it helps aspiring law students
acquire the closest experience of a courtroom.
As a good litigation lawyer, it is important to think deeply on the legal issues
and invest time in undertaking thorough legal research, prepare a good draft
covering all legal points, and then formulate a strategy to manage the
litigation effectively.
Participating in moot court certainly helps in better preparation for the future
by encouraging students to follow processes, organize information, develop
strategy and implement them, conduct themselves professionally, enhance
interest in advocacy, and the entire process is intellectually rewarding.
Additionally, working as a team fosters the appreciation for teamwork,
develops mutual respect for fellow professionals, and creates an ecosystem
where one can learn from each other and evolve.
Given the merits of moot court competitions, I would like to congratulate the
entire organizing team for bringing such much needed initiatives for the
benefit of the law students, and also take this opportunity to convey my best

It is my great pleasure to welcome all the participating


teams from across the country to the inaugural edition of
the RMLNLU-Kochhar & Co. Arbitration Moot Court
Competition, 2023. When we talk about mooting, it is one
of those activities that every law student must endeavour
to participate and excel in, in order to develop the set of
skills they require to show their legal prowess and get an
experience of advocating in a case before they actually
land in a court. Mooting helps hone one's skills and gives them a taste of what
lies ahead in life and legal profession. It is a holistic experience where
participants learn to discern and find out the important aspects of the fact sheet
and the related laws and learn to prioritise their tasks. After one has formulated
the issues, one has to do extensive legal research to find authorities and various
sources to support the arguments that will be advanced before the Judge. It is a
rich experience of gathering information, learning new subject matters and taking
a step further in one's career. Mooting tests one’s ability to understand things
from a limited source such as the legal brief and argue on these limited facts with
unlimited resources and different legal precedents not limited to countries. It
allows one to develop their own unique style of argumentation in a Court Room.
At the same time, it inculcates legal discipline as to how one ought to conduct
oneself inside a Court Room and the art of hard work and perseverance. At EBC
and SCC Online,® it has always been our goal to provide the most accurate and
authentic legal information and supporting and sponsoring Moot Courts which is

our way of giving back to the academic community for its contribution to our
student publications and their continued support and patronage. As a special

MESSAGE FROM IAMC, HYDERABAD

In law schools, usually, the focus is on making students


good lawyers. However, there are very few activities
which can make them good advocates. I may add,
advocacy is a skill set which a person acquires after years
of experience and more importantly by applying the law
practice i.e. to a given set of facts. This is where moot
courts come into the picture and give students a platform
to learn the art of advocacy.
Mooting is an integral part of law school owing to its capacity to simulate real
court proceedings which help law students to experience the kind of legal
research, drafting, and advocacy that the profession demands. It is a key legal
skill, but one that’s transferable to many other professions outside of the
traditional legal career path. It helps improve public speaking, teamwork and
analytical thinking which students may find nerve-racking but can be
intellectually rewarding. It is not just about winning or losing in a competition. It
is about learning, growing, and gaining the skills and confidence to argue your
case effectively.
On behalf of IAMC, Hyderabad, it gives me immense pleasure to announce our
collaboration with the RMLNLU-Kochhar & Co. Arbitration Moot Court
Competition, 2023 scheduled to take place from 24th-26th of March. We, as an
institution, have been at the forefront in promoting the cause of arbitration and

ABOUT OUR PROPOSITION DRAFTERS

Mr. Jawad A.J.


Mr. Jawad A.J. is working as Global Faculty for ADR ODR
International, UK and is an accredited Digital Dispute
Resolution Specialist with DDRS.
He has more than 12 years of experience in conducting civil,
commercial and matrimonial mediations. His experiences
also include conducting basic and advanced training in
mediation as well as training of trainers (ToTs) for MCPC
and TNMCC and civil-commercial Mediation training
courses in universities in the UK and India as Associate Faculty for ADR ODR
International, UK. He has been empanelled as a mediator with the Singapore
International Mediation Centre and the Bombay Chamber of Commerce.

Advocate Tariq Khan

Advocate Tariq Khan is the Registrar of the International


Arbitration and Mediation Centre (IAMC), Hyderabad.
He is a trained mediator and has significant experience in
domestic and international arbitration, commercial
disputes, writs, MSME disputes, and Insolvency &
Bankruptcy cases. He has worked as a Partner with
Advani & Co., New Delhi.
Enlisted in the Forbes Legal Power list (2020-21), he is a prolific writer having
more than 60 publications on arbitration.
