INITIAL SHERIFF’S RETURN
[WRIT OF DEMOLITION]

On February 11, 2020 plaintiffs, thru counsel, filed a Motion for


Issuance of Writ of Demolition pursuant to Section 10 [d], Rule 39 of the
Rules of Court since the defendants refused to vacate the premises of the
the subject property and deliver possession thereof to the plaintiffs. In an
Order dated February 27, 2020, this Honorable Court granted said
Motion, but gave defendants thirty [30] days within which to abide the
Writ of Execution, but herein defendants failed to voluntarily vacate the
premises and remove their residential house thereon within said
reasonable period, hence on August 24, 2021 this Honorable Court
issued a Writ of Demolition which was received by the undersigned
Sheriff on the 31st of August, 2021.

Initial Sheriff’s RETURN is thus hereby made of the said writ of


demolition to be attached to the records of the case and for the
information and guidance of this Honorable Court that the same was
served by the undersigned on the 5th of September, 2021 upon
defendants Sps. Raymundo Robles and Eying Robles against whom the
judgment for the delivery or restitution of the contested property was
rendered. Soon afterwards, they were demanded to peaceably vacate the
disputed property and voluntarily remove their residential house thereon
within thirty (30) days from receipt of Notice to Vacate/Demolish, a
copy of which is hereto attached, to which demand, defendant
RAYMUNDO ROBLES replied that they had no other place to which they
could transfer their residence and that it would be extremely difficult for
them to construct another house as they were already old at the age of
77 and had no means of livelihood.
