Respected Sir,
In
continuation of previous status report, it is submitted that a joint
reply dated 30.01.2023 of notice uls 91 CrPC was received at
police station
from Mr. Shankar Lal Solanki, AGM, ARB, Siddhartha
Enclave, Ashram
Chowk, New Delhi & Mr. Dinesh Kumar Rai, AGM, Punjab & Sind Bank H
Block Branch, Connaught Place, New Delhi. The said reply was found
incomplete and the reply was not proper, therefore, a Notice uls 91 CrPC
issued to Branch Manager, Punjab & Sind Bank HBlock Branch, Connaught
Place, New Delhi seeking clarifications with respect to above reply of bank.
The another reply of notice u/s 91 CrPC was received from Mr. Dinesh Kumar
Rai, AGM, Punjab & Sind Bank H Block Branch, Connaught Place, New Delhi,
but the reply is also not proper (The copy of reply is attached herewith).
As per the reply of bank, they do not have rules and regulations laid
down in 1992 to 1998 for creation/modification/renewal of credit facilities in

respect of a borrower/Company/sureties and the documents which were

required from the guarantors/sureties at the time of modification/renewal of
credit facility. The Bank does not have mortgage deed/Guarantee
Deed/Agreement which was executed by M/s Rajdhani Cold Storage Private
Limited in favour of bank towards extension of Mortgage in the Loan Account
of M/s Delhi Automobiles Limited. The bank could not able to provide all
documents related to Charge/limit creation in favour of Delhi Automobile
Limited from 1993 to 1996. The Bank did not provide the credit renewal
documents of Delhi Automobiles Limited loan account from 1996 to 2001.
The Bank did not provided the name, address and phone number of
Employees who sanctioned/modified/renewed the credit facilities in the account
of Delhi Automobiles Limited from the date of issue to 1998 and lodge the
entry on title deed register/release the property in title deed of alleged
property, on the ground that the said account is very old and the details of
their employ is not readily traceable or available.
Further the bank did not provide proper reply in the matter of clubbing
of 2 different properties and shown as one single property in its OA
677/2000.

The bank mentioned in his both reply that Sanction Letter dated
25.06.1996 as an Annexure to their reply but the said Sanction Letter dated
25.06.1996 is not actually annexed with their replies. I also asked the said
sanction letter in my second notice but they did not supply the same.
It is also mentioned that without the details of bank officials/employees
who sanctioned/modified/renewed the credit facilities in the account of Delhi
Automobiles Limited from the date of issue to 1998 and lodge the entry on
title deed register/release the property in title deed of alleged property, and
the documents related to the loan account of Delhi Automobile Ltd and rules
and regulation for sanctioned/modified/renewed the credit facilities, the
investigation of the case in respect of bank could not proceed further. The
investigation of the case is in progress.
