THIS WRIT PETITION IS FILED UNDER ARTICLES 226

AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO

ISSUE WRIT OF CERTIORARI QUASHING THE IMPUGNED

ORDER DATED 30-08-2018 VIDE NO.BHOOSU-79A/B:CR-02-

2018-19 PASSED BY THE 3RD RESPONDENT AND PRODUCED AS

ANNEXURE-C AND ETC.,

THESE PETITION IS COMING ON FOR PRELIMINARY

HEARING IN 'B' GROUP, THIS DAY, THE COURT MADE THE

FOLLOWING:

ORDER

Heard the learned counsel for the petitioners and the

learned High Court Government Pleader for the respondents.

02. The W.P.No.200329/2023 is filed challenging the

order dated 30.06.2012 at Annexure-B. The

W.P.No.200480/2023 is filed challenging the order dated

30.08.2018 at Annexure-C. These orders are passed by the

Assistant Commissioner invoking Section 79 (A) of the

Karnataka Land Reforms Act. The properties are confiscated on

the ground that the sale transactions in the name of the

respective petitioners violated the provisions of Section 79 (A)

of the Karnataka Land Reforms Act. The Section 79 (A) of the

Karnataka Land Reforms Act, is deleted in terms of ordinance of

2020. The effect of deletion was considered by the Coordinate

Bench of this Court in W.P.No.107318/2019 and

W.P.No.103756/20210.

03. Under these circumstances, this Court is of the view

of that the petitions should succeed. The impugned orders are

to be set-aside. Consequently, the impugned orders are set-

aside. The respondents No.2 and 3 shall certify the name of the

petitioners in the respective property records of the properties

purchased by them, within one month from the date of receipt

of certified copy of this order.

04. It is also made clear that in view of the amendment

referred above, the sale deed dated 31.10.2011 at Annexure-A

and A1 are held to be not in violation of Section 79 (A) of the

Karnataka Land Reforms Act.

05. With the above observations, the writ petitions are

allowed.
