Coverage:
1. Mayor’s Permit Fee
2. electric and/or telecommunication poles/posts/ owned by public utility

companies
3. erected on government and/or private lots along government streets,

roads, highways and/or alleys
This Ordinance shall shall not apply to all telecommunication companies, their
general contractors and subcontractors, successors-in-interests, applying to
construct and or operate Active Infrastructure, PTTIs, Shared PTTIs, and other
similar wireless communication facilities and its accessories in Bacolod City.
Defined as:
Active Infrastructure - For purposes of active infrastructure sharing, this

refers to the active elements of wireless networks which are maintained
and operated/managed by operators, such as antennas, antenna systems,
transmitters/receivers, transmission systems, radio frequency modules,
channel elements, and other radio-communications systems.
Cell Site Towers – shall refer to a pyramid-like skeletal structure with a

framework of angular steel, bolted or welded together, typically higher than
its diameter and high relative to its surroundings, and used to install
antennas or signal boosters for better radio-and sound-wave reception and
transmission.
Passive Telecommunications Tower Infrastructure (PTTI) - refers to all

types of outdoor non-electronic telecommunications infrastructure or civil
works, including but not limited to towers, masts, poles, and other similar
infrastructure, as well as, the facilities auxiliary thereto -built on the ground
or installed on buildings, walls, rooftops or other edifice-that are utilized for
purposes of mounting antennas, transmitters/receivers, radio frequency
modules, and other radio-communications systems as macro Active
Infrastructures for the rendition of ICT services in the telecommunications
network. The term shall include:
(a) the ducts, ladders, arresters, mounts, cable entrances, and the cable
trays of the PTTI;
(b) the shared fiber-optic and/or radio frequency cables or other similar
equipment assemblies that make up the fronthaul;
(c) its appurtenant shelters, sheds, cabins, cabinets or other similar house
for the base-band units, radio units, and related electronic equipment, as
well as the cable entrances thereof;
(d) its power supply and back-up power management systems; and
(e) all other ancillary facilities as thereto may be necessary and pertinent
for its proper, resilient, and continuous operation as a PTTI. These auxiliary
and ancillary facilities need not necessarily have to be owned or managed
by each mobile network operator.
ADDITIONAL REGULATIONS:
1. Identify, check and monitor the use of electric posts by private utility
companies, all electrical, telephobe, television and internet cable wires shall
conform to the corresponding coding scheme, as follows:
1.1 ELECTRICAL Cable wires shall be marked/wrapped with a 5-inch wide RED
reflectorized
adhesive tape at both ends of electrical posts;

1.2 TELEPHONE Cable wires shall be marked/wrapped with a 4-inch wide YELLOW
reflectorized adhesive tape at both ends of electrical posts;

1.3 TELEVISION and INTERNET Cable Wires shall be marked/wrapped with a 3-
inch wide WHITE reflectorized adhesive tape at both ends of electrical posts.
3. All utility cable wires must be anchored, stringed and arranged such that they
follow a general horizontal line direction, with the lowest anchored cable wire
exhibiting physical clearance of at least eighteen (18) feet from the concrete
pavement.

4. Crossover cables are not allowed to sag lower than eighteen (18) feet from the
ground.

5. Cable wires that have been misplaced/misaligned, must be fixed and/or re-
stringed properly within a period of three (3) working days after the concerned
company had been officially informed or notified by the Municipal Government.

6. Tattered and weathered-beaten cable wire must also be fixed and/or replaced
by the concerned company within a period of seven (7) working days after having
been informed by the municipal government.

7. Penalty. Any privately owned utility company who fail or refuse to conform
with the color-coded marking scheme and physical appearance, replace or fix
tattered and weathered-beaten wires as mentioned in Section 1 and 2 of this
Ordinance, shall be fined Two Thousand Five Hundred Pesos (Php 2,500.00) per
electric post utilized and/or six months imprisonment or both upon the discretion
of the Court.

8. Unmarked and tattered utility cable wires shall also be cut and removed by the
Municipal Government.
The Approved Pole Location Plan shall contain the following details; 1. Exact
location and/or relocation site of electric pole. 2. Pole type 3. Allowed voltage of
distribution lines 4. Clearances 5. Exact traverse point of conductors 6. Other
details as necessary for the effective implementation of this ordinance.
