Case: 20-DIS-054

IN THE COURT OF COMMON PLEAS, ASHLAND COUNTY, OHIO

DOMESTIC RELATIONS DIVISION

JOSHUA MANDEL,

First Petitioner, CASE NO. 20-DIS-054

And

ILANA MANDEL,

Second Petitioner. JUDGMENT ENTRY

This matter came before the Court for a hearing on November 16, 2022,

pursuant to the parties’ joint motion to file all pleadings under, filed April 24, 2020, as

well as a supplemental motion to restrict access filed October 24, 2022. All parties and

their respective counsel participated by remote video utilizing Zoom, all parties testified

under oath, and a record of the hearing was made utilizing a digital recording

application.

The Court originally granted the April 24, 2020 motion, but the original order was

vacated at the direction of the Supreme Court of Ohio, and remanded for further

proceedings. The November 16, 2022 hearing was conducted in accordance with the

directives of the Supreme Court and the decision below is based on this Court’s

consideration of the testimony of the parties in support of their April 24, 2020 and

October 24, 2022 motions.

Hon. Ronald P. Forsthoefel, Judge, Common Pleas Court of Ashland County, Ohio
Upon consideration of the testimony of the parties, and in accordance with the

requirements of Sup.R. 45(E), the Court finds by clear and convincing evidence that the

presumption of allowing public access to the information restricted by this judgment

entry is outweighed by a higher interest in protecting the safety, security, protection, and

privacy of the individuals whose personal identification and residence information is

directed to be redacted in all pleadings identified herein, including the name, address

and dates of birth the of the second petitioner and the parties’ children, parenting time

schedules, and any financial account and/or asset identifiers. The Court finds the

October 24, 2022 motion well taken and grants the same in the manner set forth below.

The April 24, 2020 motion is moot and denied as such.

The Court hereby ORDERS that the following pleadings, as redacted and

attached hereto, shall be added to the docket in this matter, and shall replace, for the

purpose of public access, the original, unredacted original copies of the attached

pleadings, which shall be sealed and restricted from public access, subject to the

provisions of Sup.R. 45. Nothing contained in this judgment entry is intended to impact

or affect the existing restrictions as to all documents which are not “case documents”

[as defined by Sup.R. 44(C)(1)(h)], and otherwise already restricted from public access,

or the requirement that Form 18 be filed and remain under seal pursuant to local rule

and Sup.R. 44(C)(2)(b):

2. Petition for Dissolution filed April 24, 2020

3. Parenting Proceeding Affidavits filed April 24, 2020
