Abstract
Muslim jurists take a broad and more general interpretation from the verse of the Qur’ān which commands
abstention from eating and drinking when fasting. The purpose of fasting is to abstain from that which satisfies thirst
and hunger generally. This is seen as anything which is taken via the conventional way through the mouth to reach
the jawf, i.e. throat, stomach, including the intestine, regardless of it having nutritional value or not. If any substance
is to enter any other additional cavities, then they must serve the purpose of restoring strength in the body (ṣalāḥ al-
badan). The blood circulation system is the essential cavity which the digestive tract is dependent on to achieve its
role of providing strength to rest of the body. Without this the digestive tract does not achieve its purpose of
providing these nutrients to strengthen the body. If the blood circulation is to receive nutrients or medication through
other routes other than the digestive tract then it also achieves the role of restoring and strengthening the body
independent of the digestive tract. This paper provides four simple principles indicated by classical Muslim jurists
which allow us to determine which cavities qualify as those, whereby if any substance was to enter them, would
invalidate the fast. These principles will allow us to apply rulings to new modern medical procedures to determine
when the fast will be invalidated.
Introduction
It is essential for Muslims to be aware of Islamic rulings related to those acts, interventions and procedures which
invalidate the fast, so that they can refrain from such acts whilst fasting. Muslim scholars, health care professionals
and general Muslim public need to be aware of what acts, procedures or interventions invalidate the fast especially
those related to medical procedures and interventions. Some of these interventions are quite straight forward and
obvious that they invalidate the fast, yet there are other interventions that can be quite complicated and require one
to grasp current medical understandings of human biology, medicine as well as some detail of medical procedures
and interventions to be able to come to a sound conclusion. Muslim scholars refer to classical fiqh texts as their
source to deduce new rulings related to modern issues. This requires them to contextualise the classical fiqh text,
deduce principles and apply to new cases. For this reason, with the permission of Allah swt, and through the
requests of many, I have attempted to provide a comprehensive paper related to this, “Part 2- What invalidates
fasting related to body cavities”. “Part 1- What invalidates fasting related to the throat”, was received well, and
many have provided me some great feedback and expressed how beneficial it was for them, from an academic
perspective, Islamic and medical, as well as its practical use. What is important is that we are able to define
principles deduced by our classical Muslim jurists and apply them to modern knowledge. The paper has been put
together to provide the following:
1. Basic principles that will support and guide Muslims – Recognising that some questions can be quite
complicated and there is a need to present a simple toolkit which can guide those who require a simple
approach to such queries.
2. Discussion and reference to medical issues related to human biology, which is relevant and
appropriate to the topic- This will address the complexity and confusion that can arise.
3. Details and explanation around some of the areas of confusion and differences amongst the different
Sunnī schools- This will allow Muslims from any of the Sunnī schools to use this document and appreciate
where there are agreements and differences.
4. The Fiqh sources from classical fiqh text – These have been put together in quite an exhaustive way as a
form of reference and evidence for the conclusions drawn. They are in Arabic as per the original source,
because they are more appropriate for Muslim scholars rather than general public.
As a final note, recognising that medicine is advancing at fast pace and new issues will inevitably arise in the near
future. I am hopeful that that these principles should address future interventions and hence provide enough detail
for one to apply to new cases. Having said that, this is a working document and may require amendments and
updating over time and I humbly request those who can add to this, not to hesitate to contact the author.
It is also important to note that for personal and specific complex issues it is best advised for one to approach a
qualified Muslim scholar who is well read in this area.

Our focus will be on the first two as they relate to the topic concerned. Definitions of “eating” and “drinking” are
important as they convey the literal meaning of such actions deduced from scripture.

“To drink” includes that which:
1. …is drank in liquid form
2. …encompasses all that is drank from liquids, be it water or anything else
3. …relates to drinking liquids which then reaches the stomach cavity (al-jawf) without the condition for the
gulp to pass the lips in reaching the stomach.
In summary, the literal meaning of eating and drinking is taken as:

Muslim jurists describe abstention from food and drink whilst fasting, more generally, rather than just the literal
meaning. From the Ḥanafi9 and Māliki10 fiqh texts, fasting has been described broadly as refraining (imsāk) from the
two pleasures; the pleasures of the stomach (shahwat al-baṭn) and the pleasures of the private parts (reproductive
organs) (shahwat al-farj). The Shāfiʿī11 and Ḥanbali12 fiqh describes fasting less specifically as refraining from that
which invalidates the fast and does not necessarily elaborate on the detail.

The pleasures of the stomach must be curbed when fasting. This requires one to undergo some hardship, as
abstention from food or drink can make one weak. If one was to gain strength through consuming that which has
nutritious value or medicinal benefit, then the strength will be restored and the purpose of the fast will cease.

Al-Ṭaḥṭāwī explains that the body has a natural disposition (ṭabʿa) towards that which is nutritious, and the
pleasures of the stomach (al-baṭn) demand it because of its benefit in strengthening/ restoring the body (iṣlāḥ la-
badan). By restoring the body, the stomach no longer undergoes the hardship of an empty stomach and hence the
purpose of the physical act of fasting ceases. In other words, fasting leads to the burden of an empty stomach. This
burden ceases when one satisfies the pleasure of the stomach through consuming that which is nutritious and
restores the strength of the body. Restoring and strengthening the body through nutrition is to defy the purpose of
fasting and hence invalidates the fast because the natural disposition towards food and drink diminishes and there is
no longer any hardship.
Muslim jurists do not restrict abstinence from eating and drinking solely based on the literal understandings of
eating and drinking food as has been described earlier, but rather they take a more general meaning encompassing
other acts which restore the strength of the body (ṣalāḥ al-badan) and hence defy the purpose of fasting.
al-Jaṣṣāṣ explains how Muslim jurists interpret the verse [Q 2:187]. He explains that the verse is to be understood in
the broader sense indicating that when fasting, we must abstain from eating, drinking and having sexual intercourse,
and this is not limited to just the literal meaning of eating and drinking, but also includes that which is not customary
or commonly considered as eating or drinking. These other means are supported by indicative evidence, which arise
from the prophetic tradition like the ḥadīth of Laqīṭ ibn Ṣabirah, where he was advised against snorting water up his
nose excessively during ablution when fasting. This is seen to indicate that whatever reaches the qualified cavity (al-
jawf al-muʿtabar) like the throat or brain from any of the other passages, (in this case the nasal cavity), invalidates
the fast. It does not need to be solely via the mouth, otherwise why would the Prophet ( )ﷺhave prohibited Laqīṭ ibn
Ṣabirah from it. Why would the Prophet ( )ﷺprohibit snorting ablution water up the nose considering it is amongst
the needs of wuḍū’, except as a cautionary measure to ensure the fast does not invalidate through these alternative
passages or cavities. 14

There is also an agreement amongst Muslim jurists, that the verse [Q 2:187] should be interpreted broadly by
extending also to substances which are inedible and not considered as food. Therefore, substances that have no
nutritional value are also prohibited when fasting.15 The legal reasoning behind this is that the purpose of fasting,
seen as abstaining from that which satisfies thirst and hunger is defeated with anything that is swallowed and would
occupy the stomach through whichever means. Inedible things which are not considered as food would also be
included, as they contribute to relieving the hardship (shiddah) and burden (waṭ’ah) of an empty stomach because of
hunger.16
Ibn Rushd explains the legal approach of Muslim jurists. Some of them have taken the literal and rational approach
by differentiating between that which provides nutritional value and that which does not, and so they see that the fast
invalidates only by consuming food which restores the strength of the body, whereas there are others who argue that
reasoning does not come in to acts of worship (of which fasting is one), and hence the objective is to refrain (imsāk)
from any form of ingestion that reaches the al-jawf, and so consider all, whether it restores the body or not, as
invalidators of the fast.17
Ibn Rushd asserts, that as a result of this broader understanding, there are differences amongst Muslim jurists about
what determines a qualified cavity (al-jawf al-muʿtabar), as well as what constitutes a qualified passage (al-manfadh
al-muʿtabar) to this cavity. These would be cavities and passages other than the natural cavity and passage of eating
and drinking (i.e. the mouth, throat and stomach). They would be additional qualified cavity places like the place of
the enema (al-ḥuqnah), i.e. rectum, and can possibly also include all internal bodily cavities other than the stomach,
like the brain.18
Ibn Taymiyyah explains that eye antimony (kohl), enema, that which is inserted into the urethra, and treating a deep
wound of the top of the scalp, or through a piercing wound that reaches the stomach, all these matters are
approached and viewed differently by Muslim scholars. Some claim they are all cavities and passages that
invalidate, others claim exceptions, including that which is related to drops of medication (al-taqṭīr).19
These differences amongst Muslim jurists, regarding determining additional cavities which invalidate fasting, are
left to the exercise of ijtihād (expert scholarly deduction and legal reasoning), because it is not clear from the Qurān
or from the prophetic tradition.
Those who interpret the Quranic verse more specifically or literally are:

Imām Al-Bukhāri who indicates this from the titling of his chapters in his Ṣaḥīḥ20, Ibn Taymiyyah who explains that
other passages and cavities have not been clearly mentioned by the Prophet ()ﷺ, nor has anything been transmitted
to us by the companions21, and Ibn Ḥazm who does not accept the role of analogical deduction (qiyās) in deducing
new rulings from scripture, and so takes the verse literally in the common sense of eating and drinking to the
exclusion of everything else.
The majority four sunnī schools agree to the broader understanding of the verse. The purpose of fasting is to abstain
from that which satisfies thirst and hunger generally. This is seen as anything which is taken via the conventional
way through the mouth to reach the jawf, i.e. throat, stomach, including the intestine, regardless of it having
nutritional value or not. If any act extends to any additional cavities, then they must serve the purpose of restoring
strength in the body (ṣalāḥ al-badan) when a substance providing nutritional or medicinal benefit enters them.
Muslim jurists provide principles (al-ḍawābiṭ) that determine theses additional qualified bodily cavities (al-jawf al-
muʿtabar), as it is through these means that the fast invalidates. These principles were developed recognising that
their application of these principles was to be understood in context of their understanding of human biology.
We will begin by defining these principles to help us to determine what qualifies as an additional qualified cavity
(al-jawf al-muʿtabar)
The first principle that can be drawn is as follows:
There is no clear definition of what is meant by al-jawf from the Qu’rān and aḥadīth and hence it is determined
through ijtihad by referring to the lexical meaning of al-jawf in addition to its use in the Qur’ān. The following
understandings of al-jawf were referred to.
Al-jawf: any concealed bodily cavity (al-baṭn), more specifically based on its capacity and its spaciousness,22 to be
occupied or be emptied or hollowed.23

There is only one mention of al-jawf in the Qur’ān, which is unrelated to fasting, and its use in the prophetic
tradition is diverse, non-specific and does not relate its meaning to the subject of fasting24
From this lexical understanding of cavity (al-jawf), the different sunnī schools elaborate on what they consider as
the additional qualified cavity (al-jawf al-muʿtabar).
All four sunnī schools describe al-jawf broadly as any cavity that goes according to the description in the lexical
sense. The gut (throat, stomach and intestines) are seen as the main cavities and this extends to additional cavities
like brain, uterus, bladder etc.25
I will now refer to similarities and differences amongst these schools in how they apply this description of al-jawf in
determining the additional qualified cavities (al-jawf al-muʿtabar).
All sunnī schools are agreed that the throat (al-ḥalq), stomach (al-maʿidah) and intestines (al-amʿā’) are the
essential (al-aṣl) qualified cavities (al-jawf al-muʿtabar). This is because they are the cavities of concern when we
refer to the common and literal acts of refraining from eating and drinking to achieve our purpose when fasting.
Other cavities can also qualify on the basis of principles deduced from proofs like the ḥadīth of Laqīṭ ibn Ṣabirah,
where he was advised against snorting water up his nose excessively during ablution whilst fasting. Jurists conclude
from this that whatever reaches the qualified cavity (al-jawf al-muʿtabar) like the throat or brain from any of these
other passages will also invalidate the fast if they serve the same purpose. This may even include a perforation of the
body (makhāriq al-badan).26
In other words, subsidiary or additional qualified cavities like the brain (al-dimāgh), vagina and bladder etc. can be
deduced as being additional qualified cavities.
Ḥanafī school
The essential qualified cavities (al-jawf al-muʿtabar) according to the Ḥanafī jurists, are the throat, stomach and
intestine
Other additional cavities can only be included if they have a passage that leads to one of these three cavities- so that
if something is placed in the cavity it will reach one of these three essential cavities naturally, with ease of flow,
either directly or through another cavity, then this additional cavity will also be considered a qualified cavity (al-
jawf al-muʿtabar) and hence anything that enters it, will also invalidate the fast.
The brain, vagina, uterus, bladder and urethra were seen as qualified cavities by most, and have been mentioned in
the books of fiqh, as there was an assumption that they had a direct passage (manfadh), which lead to the essential
qualified cavity i.e. throat, stomach or intestine.
Māliki School
The Māliki jurists also refer to the throat, stomach and intestine as qualified cavities (al-jawf al-muʿtabar)

وصار ذلك أصال عند أبي حنيفة في إيجاب القضاء في كل ما. لوال ذلك لما كان لنهيه عنها ْلجل الصوم معنى مع أمره بها في غير الصوم،أنه يفطر

Their approach to other cavities is the same as the Ḥanafīs, in that other cavities can only be included if they have a
passage that leads to one of these three essential cavities, so that if something is placed in the cavity it will reach one
of these three essential cavities naturally, either directly or through another cavity.
Similarly, the brain, vagina, uterus, bladder and urethra were seen by some of the Mālikī jurists to qualify as
qualified cavities (al-jawf al-muʿtabar) and hence anything that enters them would invalidate the fast.
Shāfiʿī School
The Shāfiʿī scholars are divided on the issue of al-jawf al-muʿtabar based on two important conditions27
1. Any cavity in the body which is commonly considered a cavity qualifies as long as it can be reached by an
open external passage
2. That the invalidating substance that enters this cavity must be one that gives strength, provides nutritional
or medicinal benefit
According to the first condition all cavities of the body will be considered al-jawf al-muʿtabar regardless of whether
they reach or do not reach the throat, stomach or intestine, as long as there is an external passage leading to them
and they fall within the definition of a cavity.
A group amongst the Shāfiʿi jurists clarify that the invalidating substance (al-wāṣil) must be something that gives
strength like what is attained from food or medicine, if the fast is to invalidate via the additional cavities as they
don’t place conditions of it having a passage leading to other essential cavities.
The first condition is the majority opinion, and some do not consider the second condition as necessary. This is
because the throat is seen as a qualified cavity, yet it there is no need for the substance that reaches it to give
strength, and even if it did not reach the stomach, it will still be considered as one that invalidates the fast. 28
The second condition, where the invalidating substance is one which gives strength, as it has nutritional or medicinal
value, is one supported by al-Ghazāli as well as many others, where he asserts that every cavity where there is
strength gained through nutrition and medicine, like the brain, internal abdomen, intestines and bladder, will
invalidate the fast. 29
To sum up, according to the majority, if the cavity is directly connected to the throat, stomach and intestine,
regardless of benefitting from the nutritional or medicinal substance or not, it will invalidate the fast. However, if it

does not connect to the throat, stomach or intestine, then unless there is nutritional or medicinal value gained from
the substance, it will invalidate the fast.30
Ḥanbali School
Most hold a similar position to the Shāfiʿī school. Ibn Qudāma and al-Buhūṭi, describe that all cavities of the body
that have a passage that leads to the stomach invalidates the fast, regardless of whether this is through the
conventional way by mouth or not, as this is to be considered similar to the action of eating. If it disappears from
view and enters the al-jawf of the body, it will invalidate the fast.31
There are others who assert the condition that strength must be gained through nutrition or medicinal benefit32 and
any cavity and passage which leads to the stomach like the brain, throat, internal vaginal and anal area will
invalidate the fast.33
?So, what are the reasons for the broader understandings of al-jawf according to the Shāfiʿī and Ḥanbalī schools
The Shāfiʿi and Ḥanbalī scholars have a looser understanding and application of qualified “cavities” relative to the
Ḥanafīs and Mālkīs. This is because they depend on the principle that, “anything that enters the body invalidates”.
This is based on the ḥadīth of Ibn ʿAbbās who narrates that, “invalidation of fasting is solely with that which enters
and not with that which leaves”. This has been understood by some Muslim jurists as indicating that every passage
that leads to an internal bodily cavity invalidates the fast.34 There are limits to this understanding. Firstly, the ḥadīth

wuḍū’ and mentioned that the contents that enter the stomach from such an act are like the kissing of one who fasts
[i.e. the saliva of the wife will not invalidate the fast], because it is not intended to pass the throat and it is negligible,
and then he further explained that the fast is invalidated by that which enters not that which leaves (the body). 36 This
statement can be applied more generally but was mainly contextualised to what invalidates from the mouth when it
passes the throat and hence the example of the one who fasts whilst kissing was given. It is not strong enough a
statement to imply that any bodily cavity is a qualified cavity, regardless of it being connected or not to the throat,
stomach and intestine. However, it is used by some Muslim jurists to qualify any cavity other than the essential
qualified cavities i.e. throat, stomach and intestine.
It is important to differentiate between what we consider as principles particular to a school, from that of the
outcomes of their application. The latter being based on the understanding of human biology at any particular time.
The earlier fiqh texts relate understandings of human biology at times different to what we understand today.
Muslim jurists provide principles that guide us on what invalidates our fast. They express this in their works when
they inform us that the application of these principles can only be achieved through knowledge of human biology
(medicine) and not just fiqh.37 I will elaborate on this through examples in the following table and using these
principles apply them to human biology as understood today which is more certain.

Brain Ḥanafī
The brain was thought of as a jawf because it was assumed that whatever entered it would lead to the
stomach through a passage (manfadh),38. This is not how we understand it today as there is no such
passage, and hence it will not be considered a qualified cavity (al-jawf al-muʿtabar).
Mālikī
If the substance enters a passage high up, and then enters the throat, stomach, intestine, it will invalidate
the fast.39 The brain is high up, but there is no passage from it to the throat and so the fast will not
invalidate.40
Shāfiʿī and Ḥanbalī
Even those (i.e. Shafiʿī) who consider the brain as al-jawf al-muʿtabar, regardless of there being a passage
to the stomach or not, consider the brain as that which provides nutritional / medicinal strength gained by
the brain as a result of the substance which enters it41, which is known not to be the case now except the
strength gained by the brain through the CSF (cerebrospinal fluid). In other words, anything that enters the
brain will normally not invalidate the fast unless the agent reaching the brain is providing strength and
restoration to the brain or body due to the substance that enters it.42

Bladder/ Ḥanafī
urethra
There is a difference amongst the imāms of the Ḥanafi school of whether drops in the urethra invalidate
the fast when they reach the bladder. This difference was based on whether the substance is dry or moist
as that will determine whether it will get to the jawf and that the passage be a natural, passage as it is more
likely to reach the jawf contrary to one which is not natural which could lead elsewhere.43. It is known that
there is no such passage between the bladder /urethra and the bowels and so this would suggest that the
bladder/ urethra would not qualify.44
Mālikī45
Does not invalidate as it does not reach the place of eating and drinking (i.e. jawf ). Al-Ṣāwī explains that
regarding the vagina there is a difference of opinion, but it is like the urethra in that it is not qualified.46
Shāfiʿī
في المجموع شرح المهذب وصح حه الغزالي كال كتحال وادعوا أنه ال منفذ من اْلذن إلى الدماغ وإنما يصله بالمسام كالكحل وكما لو دهن بطنه فإن

Ḥanbalī
Regardless of whether the substance reaches the bladder via the urethra the fast will not invalidate as there
is no manfadh between the urethra and the jawf.48
Vagina/ Ḥanafī
uterus
There was an assumed passage between the bladder and al-jawf (stomach or bowels) and hence anything
that entered the vagina reached the bladder and then the bowels. 49 We know this is not the case and hence
it will not be considered a qualified cavity (al-jawf al-muʿtabar).
Mālikī
The vagina is not connected to the jawf and so will not invalidate.50
Shāfiʿī and Ḥanbalī
If one was to insert a finger into the vagina it would invalidate.51 That which reaches the jawf from the
vagina will invalidate. This is based on the idea that there is a passage (manfadh) between the vagina and
the al-jawf, which clearly is not the case and hence it will not invalidate the fast. 52

It is clear from these examples that an additional cavity only qualifies if it reaches either the throat, stomach or
intestine (i.e. the essential qualified cavities), through a patent passage. If there is another cavity which receives
nutrition or benefit from medicine to give it strength which will restore the body, then such a cavity may also be
considered al-jawf al-muʿtabar regardless of whether it connects to the throat, stomach or intestines according to
some Shāfiʿī and Ḥanbalī jurists, though they generally limit this just to the brain, requiring other cavities like the
bladder, uterus to have a passage (manfadh) to the essential qualified cavities (throat, stomach, intestines).
I will now elaborate further on this latter point.53
These additional qualified cavities were considered on the basis that they had a patent passage to the throat, stomach
and intestines i.e. essential qualified cavities. Our knowledge of human biology would suggest that this is not the
case and hence they do not qualify even though they are mentioned as such at times in the fiqh literature.

These principles are applied in conjunction with other considerations such as the requirement for independent stay
and excusable states like forgetfulness and arduousness. I have presented the details to this in [part 1 – what
invalidates fasting related to the throat in light of modern medicine] and will not elaborate on this here, except where
relevant.
There was a clear recognition by Muslim jurists that giving strength to the body is a means to invalidate the fast.
Anything that strengthens the body or restores it infringes the purpose of fasting and so, invalidates the fast. This is
expressed by Musim jurists as that which invalidates in “meaning or purpose” (maʿna). The condition stipulated by
jurists was that the cavity where such a substance reaches, should also have a patent passage to the essential
qualified cavities.
وعلى هذا، فال يوجد الصوم بدونه... فاإلمساك عن اْلكل والشرب والجماع- أي الصوم- «وأما ركنه: يقول- رحمه هللا- في بدائع الصنائع للكاساني
سواء كان صورة. وذلك باْلكل والشرب والجماع،أمر ضروري ٌ اْلصل؛ ينبني بيان ما يُفسد الصوم وينقضه؛ ْلنَّ انتقاض الشيء عند فوات ركنه

Al-Kasānī explains that one is not able to fast without refraining from eating, drinking and having sexual
relationships. It is on this principle that the explanation of what invalidates or breaks the fast are borne. This is
because the cessation of something is at the time when it’s necessary conditions end. [With regards to fasting] this
is with any intervention [broadly related to] eating, drinking and having sexual relationship either in (1) action [lit.
form] and purpose [lit. meaning] together (ṣuratan wa maʿnan), (2) in action, not purpose (ṣuratan lā maʿnan), or in
(3) purpose, not action (maʿnan lā ṣuratan)
As al-Kasāni explains, any of the following ways will invalidate the fast.
1. In action and purpose together – consuming food and drink or taking medicine [purpose] which passes or
reaches the throat, stomach or intestines through conventional entry points like mouth, nasal area [action].
i.e. eating or drinking food by mouth
2. In action but not in purpose- consuming that which is inedible i.e. not gaining nutrition [no purpose] via the
conventional entry points to reach throat, stomach, intestines [action]. This would include swallowing all
substances that do not have nutritional benefit or medicinal benefit like plastic, paper, wood etc.
3. Not in action but just in purpose- i.e. gaining nutrition or medicinal benefit [purpose] but not through the
conventional entry points to reach throat, stomach, intestines [no action]. This will include nutrition or
medication through routes like PEG feeds, however Muslim jurists included bladder, brain, ear, vagina and
uterus in this.
In other words, the rulings related to what invalidates the fast are not just related to
(1) the act of eating and drinking (ṣūrah) as is commonly understood via the throat, stomach and intestines, but
also in relation to
(2) the meaning or purpose of eating and drinking (maʿna)- anything that gives strength and nutritional value
to the body. This can be through other cavities other than the essential qualified cavities. Some Muslim
jurists have referred to cavities like the brain.
There are many accounts in the fiqh literature regarding invalidation of fast based on the idea of it restoring the body
or giving strength (ṣalāḥ al-badan) as this was contrary to the purpose of fasting (maʿna).
Al-Sarakhsī explains how a fly or dirt which enters the throat will not invalidate because of juristic preference
(istiḥsān) on the basis that it is not of nutritional value and has not attained the meaning of imsāk (restraint from
eating and drinking), but does invalidate on the basis of analogical deduction (qiyas).54
وهذا استحسان وكان ينبغي في القياس أن يفسد صومه؛ ْلنه ليس فيه أكثر، وإن دخل ذباب جوفه لم يفطره ولم يضره:) في المبسوط للسرخسي (قال54
من أنه غير مغذ وأنه ال صنع له فيه فكان نظير التراب يهال في حلقه وفي االستحسان ال يضره هذا؛ ْلنه ال يستطاع االمتناع منه فإن الصائم ال يجد بدا
وهو نظير الدخان والغبار،من أن يفتح فمه فيتحدث مع الناس وما ال يمكن التحرز عنه فهو عفو؛ وْلنه مما ال يتغذى به فال ينعدم به معنى اإلمساك
ولو كان هذا، وقد يدخل في هذا االستحسان بصفة القياس فإنه لو كان الذباب في حلقه ثم طار لم يضره- رحمه هللا تعالى- :يدخل حلقه قال أبو يوسف
Ibn ʿĀbidīn states that invalidation of fast is with that which is done through one’s action and when there is
restoration of the body with it.55
Ibn al-Ḥammām claims that al-fiṭr (that which invalidates) is that which enters (the body) and relates to the meaning
(purpose) of invalidation of the fast through restoring the body. 56
Al-Marghināni states if one was to snort (up the nose) and apply drops in the ear then the fast will invalidate, this is
because of the meaning of al-fiṭr (invalidating fast) in that one passes that which restores the body to the jawf.
Applying water to the ear will not invalidate as opposed to oil (al-daḥn). The difference being that the water
provides neither the act nor the meaning or purpose of al-fiṭr (because it does not provide strength). In other words,
with the oil, the purpose is achieved, because it causes restoration of the body even though the act is not achieved
i.e. it is not through the oral cavity.57
This is also elaborated by Ibn al-Ḥammām in that, if water was poured in to the ear then there is a difference of
opinion of whether it would invalidate the fast and the more sound opinion is that it will, because it will reach the
jawf and not because of restoration of the body.58 This indicates that if the cavity of concern is other than throat,
stomach or intestine, then the substance that enters that cavity (i.e. ears) must be one that provides nutritional or
medicinal benefit. If that is not the case, then it will not invalidate the fast.
Al-Dusūqi explains that smoke or dust invalidates the fast if it reaches the throat because it has a body that gives
strength to the brain just like what is attained from eating.59
al-Walwājiya states that whatever enters the nose does not invalidate because the medication that enters the nose
does not restore the body.60
The Shāfiʿī jurists also elaborate on the basis of gaining strength from food or medicine as being invalidators of
fasting.61

The Māliki scholar, Al-Maghrabī states that “to inhale water up the nose (istinshāq) is equivocal to food (in its
effect) in terms of their similarity to incense (al-bukhūr). The fragrance from food has a body that strengthens the
brain and inhaling water up the nose has the same effect which is caused by food i.e. it has fumes that strengthen the
brain”62 However, Al-Qarāfī states, “That which reaches the brain will not invalidate contrary to the imāms.” 63 This
is because there is no passage to the throat.
If one was to benefit from nutrition or medication through another way other than through the essential qualified
cavities of the throat, stomach and intestines, then this will also invalidate the fast i.e. from the rectum or through a
physical surgical passage introduced via the abdomen. Muslim jurists only advocated this if this cavity had a direct
patent passage to the throat, stomach or intestines. This is because other cavities do not invalidate the fast unless
they allow the substance to reach these essential cavities. This condition was introduced because Muslim jurists
could not conceive that there was any other way that a substance could provide the benefit of strength and
restoration to the body with food or medicine, except either through the throat leading to stomach or the intestines.
This was regardless of which entry point in the body as long as it was patent.
The reason the throat, stomach and intestines were considered essential cavities was because they fulfilled the
criteria as cavities that invalidated, on the basis of both action (ṣūrah) as well as meaning or purpose (maʿna)
The throat, stomach and intestines were seen by most as the only cavities where absorption of nutrients and
medicine to restore and strengthen the body were acceptable and hence, they were considered as the essential
qualified cavities. Some also viewed the brain in such a manner also. That is why any other cavity that did not have
a passage directly to them was not considered as an additional qualified cavity.
Al-Kharshī (Mālikī) mentions that whatever reaches the bowels i.e. from anal area that gives nutritional value will
invalidate. He provides the explanation, that the enema is absorbed from the stomach and the whole bowel (tujdhabu
min al-maʿidati wa min sāiri al-amʿā’i), as has been mentioned by doctors, and hence this is equal to the meaning or
purpose of eating (fī maʿna al-akal).64
Those things that invalidate the fast on the basis of the meaning or purpose (maʿna) and not necessarily the action
(ṣūrah) are indicated here. The meaning referred to here, is the gaining of strength and restoration of the body to the
degree that the natural disposition towards food diminishes and hence defying the purpose of fasting. Classical
Muslim jurists did not have the means nor the technological advancement to restore the body or give strength to the
body from other than what reached the throat, stomach and intestines.
It was assumed by some Muslim jurists that the brain was a cavity that gave strength to the body from those
substances that entered it, regardless of it having a passage leading to the throat and stomach and that the fast would
invalidate if the substance had reached there. This was, however, the opinion of some of the Shāfiʿī and Ḥanbali
scholars
We now know that these substances that provide nutrients and medicinal benefit are absorbed through the lining of
the gut and enter the blood circulation via the hepatic portal vein.

The digestive tract provides the nutrients, but it is the blood circulation that restores the body and gives strength to it
having absorbed these nutrients from the digestive tract (see above diagrams for more detail). Therefore, the blood
circulation system is the essential cavity which the digestive tract is dependent on to achieve its role of providing
strength to rest of the body. Without this, the digestive tract does not achieve its purpose of providing these nutrients
to strengthen the body. In other words, the purpose (maʿna) is not achieved without the blood circulation system.
al-Kharshī mentions this process and mechanism, similar to how we understand it in modern medicine today, as the
process through which the body gains strength. After asserting that the medicine that is poured into the rectum is
absorbed by the bowels and that which provides nutritional benefit is absorbed by the liver from the stomach and the
whole bowel (fa inn al-kabida yujdhabu min al-maʿidati wa min sāiri al-amʿā’i), according to doctors, and this is
the “meaning of eating” (wa dhālika min maʿna al-akl).65
This resembles the first-pass effect (also known as first-pass metabolism). This is a phenomenon of drug metabolism
whereby the concentration of a drug, specifically when administered orally, is greatly reduced before it reaches the
systemic circulation. First pass metabolism may occur in the liver or in the gut. After a drug is swallowed, it is
absorbed by the digestive system and enters the hepatic portal system. It is carried through the portal vein into the
liver before it reaches the rest of the body. The liver metabolizes many drugs, sometimes to such an extent that only
a small amount of active drug emerges from the liver to the rest of the circulatory system. This first pass through the
liver thus may greatly reduce the bioavailability of the drug.
I will now apply these principles to our current understanding of the brain and also our circulatory system as both
are seen as additional qualified cavities.

The Brain
PRINCIPLE 1- THE The brain is surrounded by cerebrospinal fluid (CSF) which is a clear, colourless

ventricles are interconnected with each other, and also with the central canal of
the spinal cord and with the subarachnoid space (space between two of the linings
that separate the brain from the skull). CSF is produced by the lining of the
ventricles. The CSF then circulates throughout the ventricular system and is
eventually reabsorbed in the subarachnoid.
Conclusion: The brain has internal cavities (ventricles) occupied by CSF. This is
no less than 100ml and because Muslim jurists accepted the brain as an additional
qualified cavity, this amount can be said to be a good indicator of the minimum
volume required for a cavity to qualify.
PRINCIPLE 2- THE There is a connection from the subarachnoid space to the bony labyrinth of the

Placement of cerebral spinal fluid (CSF) shunt systems to treat hydrocephalus, the
swelling of the brain due to excess buildup of (CSF), is a medical procedure and a
life-saving treatment for many patients. These shunt systems drain excess fluid
from the brain to another part of the body where the fluid is absorbed as part of
the circulatory process. Shunts can come in a variety of forms but most of them
consist of a valve housing connected to a catheter, the end of which is usually
placed in the peritoneal cavity in the abdomen, but other locations include the
heart and lungs
There is a mention in the fiqh books of the belief that the prohibition from kohl
during fasting before sleep is due to a fear of it reaching the brain which is
mentioned in ḥadīth- this is based on the idea that there is a manfadh between the
two and as has been explained this is not the case as we understand today. Besides
this ḥadīth is weak and hence not from the Prophet ()ﷺ, also there are other
aḥadith which state the contrary.66 The prohibition of excessive nasal inhalation
was due to the fear that it will lead from the nasal cavity to the brain as related in
the ḥadīth – similar to the above there is no such passage (manfadh) and the
manfadh indicated that has the potential to invalidate can only be the connection
between the nasal area and the throat and not the brain.67
Conclusion: There is no natural passage especially to the throat nor is the brain
directly connected to the throat, stomach intestine through any means. CSF shunt
systems have a closed system and will only invalidate if external fluid / medicine
is infused or injected into them it would have to be a large amount to reach the
peritoneal cavity, which does not happen.

the brain. However, it is rare for this to happen and anyone who is having this
procedure is likley not fit to fast anyway.
CONCLUSION The brain does not qualify as a qualified cavity, as it does not provide strength to
the rest of the body, it does not have a clear passage to the stomach via the throat,
and there is no natural external patent passage that leads to it. Potentially
medication can be injected into the CSF via spine (i.e. epidural) but it is a closed
system and strength will not naturally reach the rest of the body but just to the
brain. According to Shāfiʿī and some Ḥanbalī jurists this would invalidate the fast
if the liquid injected gives strength to the brain.

BODY
The circulatory system is a closed system and hence Muslim jurists did not relate
accounts of it in the fiqh literature as one that can invalidate the fast. The throat,
stomach and intestine were seen as the essential routes that invalidate the fast.
The fast will invalidate if anything enters the oral cavity and passes the throat.
This is described as al-ifṭār (ṣūratan) i.e. in action, and Muslim jurists understood
this in the broad sense that any other cavity which relates ifṭār (maʿnan) i.e. in
meaning and purpose through restoring the body and giving it strength would also
invalidate. The essential qualified cavities have a role to digest food and through
absorption they serve the blood circulatory system so that it can strengthen the
body.
Conclusion: As a closed system the circulation will not invalidate the fast, but if
there is patent direct venous access and IV fluids and nutritional drips are
administered, then this is equivalent to what the digestive system is essentially
providing the blood circulation.
CONCLUSION The blood circulation comes into the sharʿī definition of a qualified cavity (al-
jawf al-muʿtabar) on the basis of all three principles mentioned.68
The blood circulation system is the essential cavity which the digestive tract is dependent on to achieve its role of
providing strength to rest of the body. Without this, the digestive tract does not achieve its purpose of providing
these nutrients to strengthen the body.
Also, if the blood circulation is to receive nutrients or medication through other routes other than the digestive tract
then it also achieves the role of restoring and strengthening the body independent of the digestive tract. Because the
digestive tract is dependent on the blood circulation to contravene the purpose of fasting, and the blood circulation is
not dependent on the digestive system, then the blood circulation will be seen as the main cavity of consequence.
Lungs
PRINCIPLE 1- THE Conclusion: The lungs fall into the broader definition of a cavity (al-jawf) as has

Muslim jurists clearly outline that there are certain conditions related to the passage that enters such additional
cavities for the fast to invalidate.
There needs to be an expectant level of certainty that a substance will reach the additional qualified cavity through a
patent entry passage
Factors related to patency of passage
(1) Whether a passage actually exists – A cavity which is closed and has no external patent access will not
qualify
(2) Whether there is a wide enough passage to let the substance pass freely- If a passage does exist externally,
then the substance must pass through one which is wide enough for a body to pass69 (this has been
described in different ways by Muslim jurists, mainly on the basis of the certainty and ease of passage) 70.
Passage through the process of absorption through a lining, membrane or anything which has pores to reach
the qualified cavity (al-jawf al-mu’tabar) will not be considered a qualified passage (al-manfadh al-
mu’tabar).71 The only exception is when it is absorbed in the essential cavities of the throat, stomach and
intestines, as they are the cavities which are essential to means of restoration of the body.
The Ḥanafī and Māliki jurists see the lacrimal duct of the eye as equivalent to a pore (al-masāmm) and hence not a
qualified passage, this is because it is not wide enough to be considered as such. Similarly rubbing oil on the skin
will not invalidate even if absorbed in the skin, nor pouring water on the skin as pores are not a qualified passage. 72
In other words, there must be a patent entry point and / or a patent passage leading to the essential qualified cavity.

تصرح به في العمد لكن يؤخذ من إطالقها وهللا أعلم اهـ بن( .أو غيره) أي :المتحلل كدرهم من منفذ عال فقط بدليل ما يأتي (على المختار) عند اللخمي
من الخالف وهو ابن الماجشون ،ومقابله قول ابن القاسم هذا خاص بغيره ،فلو قال كغيره بالكاف لوافق عادته .ونص اللخمي اختلف في الحصاة والدرهم
فذهب ابن الماجشون إلى أن للحصاة والدرهم حكم الطعام فعليه في السهو القضاء فقط وفي العمد القضاء والكفارة .والبن القاسم في كتاب ابن حبيب ال
قضاء عليه إال أن يكون متعمدا فيقضي لتهاونه بصومه ،فجعله من باب العقوبة ،واْلول أشبه؛ ْلن الحصاة تشغل المعدة إشغاال ما وتنقص كلب الجوع
وصلة إيصال (لمعدة) أي :ما تحت الصدر إلى السرة وهي لآلدمي كحوصلة الطير وكرش البهيمة ،وصلة إيصال أيضا (بحقنة) أي :احتقان (بمائع) في
دبر أو قبل امرأة ال إحليل .واحترز .بمائع عن حقنة بجامد فال قضاء فيها ولو فتائل عليها دهن ليسارته قاله اإلمام مالك -رضي هللا عنه -فهو مستثنى
من المتحلل أو حلق ...لكن بشرط أن ال يرد غير المتحلل ،فإن رده بعد وصوله الحلق فال شيء عليه قاله البساطي ،وتبعه جماعة من الشراح البناني وهو
غير صواب لنقل المواق عن التلقين ،ويجب اإلمساك عما يصل إلى الحلق مما ينماع أو ال ينماع اهـ .ونقله الحط بأبسط من هذا ،وعطف أو حلق على
حقنة يقتضي أن الواصل للحلق ال يفطر إال إذا جاوزه إلى المعدة ولو كان مائعا وهو قول ضعيف والمذهب أن المائع الواصل للحلق مفطر ولو لم يجاوزه

Al-Dusūkī (Mālikī) elaborates that whatever liquid enters the bowels from a high position will invalidate the fast
regardless of the narrowness of the passage concerned as opposed to that which is entered from a lower passage
where it would need to be a wider passage like the anal area, vagina or bladder. The urethra or abdominal
perforation will not invalidate because they are lower and narrow.73 The Shāfiʿī are more explicit about the passage
being patent and wide for it to qualify.74
(1) Attributes of the substance itself – This will be related to whether the substance flows easily and whether it
is in liquid form, as then it will flow more readily and independently into the qualified cavity and if it is
solid it is less likely to. 75
(2) Means of administration of the substance. According to the Ḥanafīs there needs to be independent stay so
that it is known to have established itself there.76 The Mālikīs differentiate on the basis of location of the
passage because whatever liquid enters the bowels from a high position will invalidate the fast, regardless
of the narrowness of the passage concerned, as opposed to that which is entered from a lower passage
where it would need to be a wider passage like the anal area, vagina or bladder. The urethra or abdominal
perforation will not invalidate because they are lower and narrow.
Muslim jurists clearly outline that that there are certain conditions related to the passages that enter these essential
cavities for the fast to invalidate. I will apply these principles to the anal/ rectal area

The anal / rectal area is not entirely seen as a qualified cavity but seen as a qualified passage (al-manfadh al-
muʿtabar). The question arises, at what part of the rectum or intestine will we consider it a qualified cavity (al-jawf
al-muʿtabar), where if anything reaches it, the fast will invalidate.
Anus / Rectum
PRINCIPLE 1- THE The anus is not concealed but the internal part of the rectum is, and is spacious,

internal iliac vein → Inferior Vena Cava.
Conclusion: The upper 2/3 of the rectum resembles the intestine and would be
under the same ruling as an essential qualified cavity. Its venous drainage is to the
portal system like the rest of the intestine. The lower third has a different membrane
and different venous supply. Anything that is absorbed above the pectinate line will
invalidate the fast as this is absorption via the intestine. If below the pectinate line,
then it will not, as this is absorption external to the qualified cavity.
PRINCIPLE 3- IF THE Conclusion: The upper 2/3 rectum is directly connected to the large intestine and is

If one was to insert finger into rectum it would invalidate. That which reaches the
jawf from the rectum will invalidate.79
Conclusion: The upper 2/3 of the rectum above the pectinate line comes under the
same rulings as the intestine (i.e. essential qualified cavity). The lower third of the
rectum will be a qualified passage which leads to the qualified cavity.

If anything was to enter or to be absorbed below the pectinate line it will not
invalidate the fast. It would have to disappear from view according to all schools
with the additional condition of independent stay according to the Ḥanafīs
It would have to be in liquid form for the fast to invalidate.
In summary, the external passage to the qualified cavity should be patent and wide enough for a sufficient amount of
the substance to pass freely and independently and for it not to rely on pores, narrow ducts, passages or absorption
as this limits the amount. This is more likely to happen if the substance is in liquid form due to ease of passage and it
establishes itself in the qualified cavity.
SECTION 2
THE FOUR PRINCIPLES THAT QUALIFY A CAVITY
The cavity should fulfil this description, and also be of reasonable size enough to hold at least over100ml of liquid
(this is the minimum amount of CSF around the brain and spinal canal) as some Muslim jurists accept the ventricles
of the brain as a qualified cavity.
Examples: any internal bodily cavity like nasopharynx, uterus, bladder, peritoneum, brain, heart, lungs, blood
circulation system, etc.
PRINCIPLE 2- THE ADDITIONAL QUALIFIED CAVITY MUST BE CONNECTED TO THE THROAT,
STOMACH OR INTESTINE DIRECTLY THROUGH A PATENT PASSAGE WHICH FREELY FLOWS
The cavity should have a patent passage that connects it with the gut from anywhere from the throat (lower
oropharynx) down to the upper 2/3 of the rectum. This patent passage should allow free flow directly to the essential
qualified cavity (throat, stomach, intestine). In other words, if any substance was to enter this additional qualified
cavity, then with surety it will freely flow to the essential qualified cavity
Examples: nasopharynx would not qualify as anything that enters them does not enter the throat with surety, lungs
would qualify as whatever enters the trachea (windpipe) must also enter the throat
PRINCIPLE 3: IF THE ADDITIONAL QUALIFIED CAVITY IS NOT CONNECTED TO THE THROAT,
STOMACH OR INTESTINE DIRECTLY, THEN IT SHOULD ATLEAST BE A MEANS OF STRENGTH
AND RESTORATION TO THE BODY
The cavity should naturally accommodate substances (usually liquid or vapour which flows) which have nutritional
or medicinal benefit and it should provide this restoration and benefit to the rest of the body. Benefit of strength here
is seen as any substance, be it even of small amount, which has attributes that restore the energy of the body to
overcome weakness due to lack of food (feeling of hunger), dehydration (feeling thirst) or illness (feelings of
reduced symptoms)
Examples: blood circulation system is an essential cavity which provides strength to the body, lungs have a role
similar to digestive tract in that they are a potential means to provide strength to the body via the blood circulation.
The substance would have to be a discernible vapour, or smoke that has nutritional or medicinal benefit for it to
invalidate the fast, however just the fact that it would need to pass the throat would suffice it to invalidate the fast.
PRINCIPLE 4: THE ADDITIONAL QUALIFIED CAVITY MUST HAVE A PATENT ENTRY PASSAGE
WHICH OPENS EXTERNALLY
The cavity should be connected externally via a patent passage and not be open externally without a passage,
otherwise it would be a passage itself. The mouth, nasal cavity, anus and lower rectum would qualify as qualified
passages.
Examples: upper rectum, a cannula placed into a vein to provide fluids to the blood circulation system
lungs would also qualify as they have a patent passage which opens externally via the throat/ mouth
