1. Reference: Memorandum dated July 28, 2023 from C, RLO 3 with subject:
“Endorsement re Request for Legal Assistance/Representation of PCMS Gerber S
Sanchez re NIAS-NMP-23-103 for Alleged Irregularity in the Performance of Duty.”

2. This pertains to the request for legal assistance/representation of PCMS


Gerber S Sanchez, Duty Investigator of Arayat Municipal Police Station, Pampanga
Police Provincial Office Police Regional Office 3, relative to administrative complaint
filed against him for alleged Irregularity in the Performance of Duty docketed as
NIAS-NMP-23-103.

3. Based on records, the case stemmed from the complaint filed by private
complainants, Salvador Verzuela and Marichu Pacheco against respondent PCMS
Gerber S Sanchez after a traffic incident that transpired on April 7, 2023 in
Barangay Tabuan, Arayat, Pampanga. The said traffic incident led to the death of
Verzuela's daughter who happens also to be Pacheco's sister and also caused
physical injuries to Pacheco's daughter. The complainants alleged that the
respondent PCMS Sanchez was the duty investigator handling the case and
committed neglectful, incompetent, dishonest, and illegal acts with respect to the
conduct of his investigation. Allegedly, respondent failed to indicate the correct
address of the suspects on the blotter report, did not arrest the said suspects and
required private complainants to provide their salaysay regarding the incident they
did not witness. Due to this incident, an administrative case for Irregularity in the
Performance of Duty was filed against the respondent hence this request for direct
legal representation.
4. After careful review of the documents submitted and endorsed by C, RLO
3, this Division finds the said case to be service related/ connected, compliant with
the requirements set forth in PNP MC 2017-062 and is hereby recommended to be
approved. Further recommend PLTCOL SWANERRIE SANGSHELL T COTAY to
be designated as Legal Counsel of the subject PNP personnel and be provided with
necessary fund support.

5. Respectfully recommend approval of paragraph 4 and signature on the


attached Memorandum for PLTCOL SWANERRIE SANGSHELL T COTAY.

3. Submit all after activity reports of appearances and case conferences


conducted; copies of pleadings, motions and memoranda prepared; including the
status of the case to the Legal Assistance Division on or before the 25 th of each
month.
