Sir/Madam:
We refer to:
1. The Loan Sanction Terms, Loan Details Sheet, Acknowledgement By Borrower, Loan General Terms
And Conditions, Lender Cover Letter, Payment Undertaking, Credit Terms And Conditions For
Online Disbursement Request, Credit Line Details Sheet, Payment Undertaking, T&C for Online
Disbursal Request, Schedule Of Charges, Acknowledgement by Borrower, Vernacular
Declarationexecuted between you and our Client, M/s Akara Capital Advisors Pvt. Ltd. ('Powered by
Stashfin.com'), a Non-Deposit accepting Non-Banking Financial Services Company having a
certificate of registration issued by the Reserve Bank of India and a Company incorporated under the
provision of Companies Act, 2013 as amended up to date having CIN No.U74110DL2016PTC290970
and having its Branch office at 58, First Floor, Arjun Nagar, Kotla Mubarakpur, New Delhi-110003
(hereinafter referred as Our Client), (hereinafter collectively referred to as “Loan Agreements”);
3. Demand Cum Legal Notice dated 2022-11-01 (hereinafter referred to as 'Legal Notice 1');
4. Demand Cum Legal Notice dated 2022-11-16 (hereinafter referred to as 'Legal Notice 2');
5. An amount of 12701 due from you to our Client as EMI Repayment and interest and other charges
(hereinafter referred to as “Due Payment”).
Please take Notice that under instructions from our Client we hereby serve you with the following Demand
Cum Legal Notice (hereinafter referred to as “Legal Notice 3”):
1. Our Client, is inter-alia engaged in the business of rendering financial/credit facilities, in the form of
loans etc., to Borrowers.
2. You, in your capacity as Borrower applied to our Client for seeking a loan amounting to 12701
(hereinafter referred to as “Loan Amount”) under the Personal Loan category.
3. That in accordance with the Loan Agreements executed by you under Customer ID - 5798468, you are
required to repay the Loan Amount together with interest in monthly instalments on the stipulated date
as per the repayment schedule therein (“EMI Repayment”).
4. In spite of our Client’s Reminder Letter sent on 2022-10-17 as well as Legal Notice’s 1 sent on 2022-
11-01 and Notice’s 2 on 2022-11-16 by the date of this Legal Notice on review of your Loan Account
under Customer ID - 5798468 we note that our Client has not yet received Due Payment regarding the
Customer ID - 5798468.
5. Per the Loan Agreements on your failure of making the EMI Repayment on the agreed upon date our
Client is also entitled to recall the entire Loan Amount.
6. We hereby call upon you to make payment of the Due Payment within 7 days from the date of this
Notice per the attached Schedule failing which we may take all such actions we are entitled under the
Loan Agreements and under Applicable Law to recover the Due Payment including civil and criminal
actions as may be applicable. Please note that such criminal action would inter-alia include action
under Section 138 etc. of The Negotiable Instruments Act, 1881 read with the Payment and Settlement
Systems Act, 2007 by which you could face imprisonment for upto 2 years also have to pay double the
amount as fine. Please also note that non-payment of the Due Payment will also lead to serious
implications on your credit bureau portfolios.
7. Therefore, if we do not obtain the Due Payment before 2023-02-15 (deadline), our Client will have no
other alternative but to initiate appropriate Civil and Criminal legal action against you to retrieve the
Due Payment.
