INFORMATION
The undersigned accuses RICO BANG y TIGAS of Violation of Section 28 (1) in relation
to Section 28 (e) (1) of Republic Act No. 10591 committed as follows:

That on or about September 4, 2023, in the City of Manila, Philippines, the said
accused, a minor, 17 years of age acing with discernment, did then and there willfully,
unlawfully, and knowingly, have in his possession and under his custody and control one
(1) caliber .38 caliber revolver (Paltik/Homemade with engrave Made in USA and
Trademark Colt .38 subsequently marked “RB-9-4-23”, three (3) .38 caliber live
ammunitions subsequently marked “RB-1” to “RB-3”, all with date 9-4-23 and signature,
without first having secured the necessary license or permit therefore from the proper
authorities.

FACTS OF THE CASE:

Investigation disclosed that at about 4:00Am of September 4, 2023, police officers


assigned at Tactical Motorcycle Riding Unit of Police Station 9 (Malate) Manila Police
District conducted OPLAN Bakal at Thirsty Bar located at Malate, Manila.
Accordingly, upon arrival of the police officers at the said bar, they coordinated with
Ms. Ann Kits y Cabs, bar owner/manager to ask for permission and cooperation in
conducting OPLAN Bakal to which she agreed. After turning on the lights inside the said
bar, the police officers saw five (5) male customers having a drinking session at a table
near the entrance, they announced that they will conduct OPLAN Bakal and instructed
them to stand up and raise their upper garments as part of the procedure. However, PCpl
Arugay noticed that one of the customers refused to raise his upper garment. He notified
PSSg Aquino and Pat Babad about his observation, PCpl Arugay proceeded to approach
the said customer. When the customer saw PCpl Arugay approaching the customer
became anxious and tried to leave the bar but he was grabbed by PCpl Arugay on his
right arm. PCpl Arugay asked the customer why he was trying to flee but he refuses to
answer. At that moment PCpl Arugay noticed a bulged on the customer’s right waist in
the shape of a handgrip of a firearm.
At this point, PCpl Arugay frisked the said customer and managed to recover the said
object that was bulging from his waist which was revealed to be one (1) caliber .38
Revolver (Paltik/Homemade with engrave with Made in USA and trademark Colt .38
without serial number) which I later marked as “RB” 9-4-23. Upon inspecting the said
firearm, PCpl Arugay noticed that it was loaded with three (3) live ammunitions for .38
caliber. PCpl Arugay subsequently marked the three live ammunitions “RB-1”, “RB-2” and
“RB-3” with date 9-4-23 respectively. PCpl Arugay asked him if he has any document or
license for the said firearm but he was not able to show any. At that point, the police
officers apprehended the said customer who was identified as Rico Bang y Tigas, 17
years old, (DOB: February 14, 2006), out of school youth, and resident of A. Mabini St.,
Malate, Manila. He was apprised of his constitutional rights embodied under the Miranda
Doctrine in the Tagalog language known, understood, and spoken by him. He was
thereafter brought to Ospital ng Maynila for routine physical examination and later on
brought to Police Station 9 for disposition. His parents were also subsequently notified of
his apprehension and asked to bring a copy of his Birth Certificate to the police station.
The CICL’s mother then arrived at the Police Station bringing his Certificate of Live
birth showing that he was indeed 17 years old and was born on February 14, 2006. Seeing
that the apprehended suspect is a CICL, the processing and handling of the CICL was
conducted with the assistance of WCPD Officer PCpl Dianne Baloaloa.
Thereafter, the CICL was turned-over to the custody of the Manila CSWDO for the
determination by the latter of the presence or absence of discernment. The
certification/case study by the Social Worker of Manila CSWDO (hereto attached as
Annexes A and A-1) of the CICL indicates that he acted with discernment.
The CICL is presently under custody of Manila City Social Welfare and Development
Office while the recovered pieces of evidence are presently under custody of the Manila
Police District Forensic Unit.
This case will be presented to you by PCpl Bon Jovy Torino (09615910792)
Investigator-On-Case during the course of inquest proceedings. Further, request furnish
this Office a copy of resolution thereof for our ready reference.

JOINT JUDICIAL AFFIDAVIT OF ARREST

We, PSSg Bernabe Aquino (PSSg Aquino), PCpl Froilan Arugay (PCpl
Arugay), and Pat Presco Babad (Pat Babad), all of legal ages, married, PNP members
of Police Station 9 Malate Manila, with Office address at Malate, City of Manila, after
having been duly sworn to in accordance with law, hereby depose and state that:

It was Police Investigator, PCpl Bon Jovy Torino who conducted the examination
of the undersigned affiant Police Station 9 Malate Manila;

We hereby state, that in answering the questions asked of us as appearing below,


we were fully conscious that we did so under oath and that we may face criminal liability
for false testimony or perjury;

Question 1 : Did you report for duty on September 4, 2023?


Answer : Yes, we reported for duty on that day.

Question 2 : Where were you at around 3:00 AM of September 4, 2023?


Answer : We were around Malate, Manila rendering patrol.

Question 3 : What happened while you were patrolling?


Answer : We were instructed by our Station Commander thru Station Tactical
Operations Center (STOC) to conduct OPLAN Bakal in all nightclubs
and resto bars within our AOR.

Question 4 : After you received the said instruction, what did you do, if any?
Answer : We conducted pre-operational briefing for the conduct of OPLAN
Bakal wherein I (PSSg Aquino) was designated as Team Leader, I
(PCpl Arugay) was designated as seizing officer, and I (Pat Babad)
was designated as videographer and the one wearing the Body-Worn
Camera (BWC). After that, we boarded our station-issued
motorcycles and proceeded along A. Mabini St. Malate, Manila where
most of the bars and nightclubs were located.

Question 5 : What happened next?


Answer : At around 3:55AM, we arrived at Thirsty Club situated at the same
area and coordinated with the bar owner Ms. Ann Kits who at that
time was standing outside the said bar. We explained to her that we
will conduct OPLAN Bakal and the procedures therein which she
agreed to.

Question 6 : What did you do next?


Answer : At around 4:00AM, we entered the said bar and instructed the owner
to turn on the lights. We saw five (5) male customers seated near
the entrance of the bar and having their drinking session. We
introduced ourselves and announce that we will conduct OPLAN Bakal
then instructed them to stand up and lift their upper garments for
inspection, as part of the procedure. During the course of the
operation, I, PCpl Arugay, noticed that one of the customers did not
lift his shirt. I (PCpl Arugay) then notified PSSg Aquino and Pat Babad
of my observation and then proceeded to approach the said
customer.
However, when the said customer saw that I (PCpl Arugay) was
about to approach him, he suddenly became anxious and tried to
leave the bar. I (PCpl Arugay) managed to grab him by his right arm.
I (PCpl Arugay) asked him why he was trying to flee but he refused
to answer. It was at this moment that I (PCpl Arugay) noticed a bulge
in his right waist in the shape of a handgrip of a firearm. When I
(PCpl Arugay) asked him what was the object bulging from his waist,
he refused to answer instead he resisted even more. Due to his
resistance while holding his right arm, his upper garments
accidentally lifted revealing the handgrip of a revolver, I (PCpl
Arugay) then decided to frisk him. During the frisking I (PCpl Arugay)
felt something hard object at his right part of his waist appearing to
me as a handgrip of a firearm. As a result, thereof, I (PCpl Arugay)
recovered the object that was bulging from his waist which was
revealed to be a caliber .38 revolver (Paltik/homemade with engraved
“Made in USA” and trademark Colt .38 without serial number) which
I (PCpl Arugay) later marked as “RB” 9-4-23. Upon inspection of the
said firearm, I (PCpl Arugay) noticed that it was loaded with three (3)
live ammunition for .38 caliber revolver which I subsequently marked
as “RB-1”, “RB-2”, and “RB-3” with date 9-4-23 respectively;

Question 7 : What did you do next?


Answer : After seizing the firearm and ammunitions, I, PCpl Arugay asked him
if has the necessary legal documents or permit for the firearms and
ammunition but the latter failed to present any. I (PCpl Arugay) then
apprehended the said person whom we identified as Rico Bang y
Tigas, male, 17 years old, and a resident of A. Mabini St. Malate,
Manila. I (PCpl Arugay) also apprised him of his constitutional rights
embodied under the Miranda Doctrine in Tagalog dialect known,
understood, and spoken by him.

Question 8 : Before the apprehension, how far are you from the CICL?
Answer : I, PCpl Arugay is about 2-3 meters away from the CICL.

Question 9 : What happened afterwards?


Answer : I, Pat Babad, informed our Station TOC and requested for a mobile
car for the transportation of the said CICL to the Police Station. I also
informed them that since the apprehended person is a CICL, we
would need the assistance of WCPD officers in handling the CICL. We
subsequently brought him to Ospital ng Maynila for his routine
physical examination.

Question 10 Did you make any effort to inform the parents of the CICL of his
: apprehension?
Answer : Yes, upon reaching the station, we immediately tried to establish
contact with his parents. We were able to contact his mother Mrs.
Bang and inform her that her son has been apprehended and to bring
a copy of his Birth Certificate to the Police Station. Upon arrival of
Mrs. Bang, she presented the Certificate of Live Birth showing that
Rico Bang is indeed a minor at 17 years old with birth date on
February 14, 2006.

Question 11: What did you do next?


Answer : I, PCpl Arugay, turned-over the recovered firearms and ammunition
to the investigator/evidence custodian PCpl Bon Jovy Torino for
disposition.
Question 12: What happened to the CICL afterwards?
Answer : With the assistance of WCPD Officer PCpl Dianne Baloaloa, we
turned-over the CICL to the custody of Manila City Social Welfare and
Development Office (CSWDO) for the determination by the latter for
the presence of discernment of the CICL.

Question 13: What is the result of the assessment by the Manila CSWDO of the
CICL?
Answer : According to the Social Case Study and Certification issued by the
Manila CSWDO, the said CICL acted with Discernment.

Question 14: I have no more questions at this moment. Is there anything you
would like to add or remove from your statement?
Answer : None at this time. Anything that we have not stated herein will be
stated in open court.

AFFIDAVIT ON THE USE OF BODY WORN CAMERA

I, Pat Presco Babad Jr, of legal age and a bona fide member of Philippine
National Police (PNP) presently assigned at Police Station 9, Malate, Manila designated
as Tactical Motorcycle Riding Unit (TMRU), after having been duly sworn to in accordance
with law, hereby depose and state that:

1. I, Pat Presco Babad Jr, together with PSSg Bernabe Aquino and PCpl
Froilan Arugay were performing our duty on September 3, 2023 from
7:00PM to 7:00 AM of following day;

2. At around 3:00AM of September 4, 2023, we were instructed by the Station


Commander thru Station Tactical Operation Center (STOC) to conduct
Patrolling and OPLAN BAKAL in all night clubs and resto bars within our
area of jurisdiction;

3. We conducted briefing pertaining to the said OPLAN BAKAL. During the


briefing PCpl Aquino was designated as Team leader while PCpl Arugay
was designated as seizing officer and I (Pat Babad) designated as
videographer/BWC operator;

4. We immediately conduct patrolling along A. Mabini St., Malate, Manila, on


board three (3) PNP issued motorcycles and upon reaching the Thirsty Bar
situated at the same place, we alighted and proceeded thereat;

5. At around 3:55 AM of September 4, 2023, PCpl Arugay coordinated with


the bar owner named Ann Kits y Cabs (Miss Ann) 30 years old, single, and
resident of A. Mabini St., Malate, Manila, that we will be conducting OPLAN
BAKAL in her bar to all of her customers which the latter agreed to;

6. Before we conduct the said operation, I turned on the Body Worn Camera
with serial no. 123456 to start taking video footages before, during and after
the conduct of OPLAN BAKAL, that during the operation, we informed the
people inside the bar that this operation is being recorded;

7. Upon arrival at the police station, I turned over the BWC to PCpl Bon Jovy
Torino, investigator on case/evidence custodian, who extracted the video
footages from the computer of this office without redaction and save the
copy of the footages in USB flash drive, color black marked as “IDL
9/4/2023” in the presence of Rico Bang and his mother. The original copy
of the video footages remains in my custody and accessed only by myself
and by the evidence custodian;

8. In the process thereof, I, nor anybody else did not attempt nor engage in
any act or manner that will alter the validity of the said recording so as to
preserve its integrity and evidentiary value; and

9. I am executing this affidavit to attest to the truthfulness and the legality of


the procedure conducted in compliance with AM No. 21-06-08-SC Rules on
the Use of Body Worn Camera and Alternative Recording Devices.

AFFIDAVIT OF INVESTIGATOR/EVIDENCE CUSTODIAN

I, PCpl Bon Jovy Torino, of legal age, a bona-fide member of the Philippine
National Police (PNP) presently assigned at Police Station 9, Malate, Manila as
Investigator and evidence custodian, after having been duly sworn to in accordance with
law, do hereby depose and state that;

1. On September 4, 2023 at around 4:30 AM, PSSg Bernabe Aquino, PCpl


Froilan Arugay, and Pat Presco Babad appeared this station, bringing with
them one male person named Rico Bang, informed me that they conducted
OPLAN BAKAL at Thirsty Bar located at A. Mabini St., Malate, Manila at
around 4:00 AM of September 4, 2023 which resulted in the apprehension of
one (1) CICL which later identified as Rico Bang;

2. Arresting Officers disclosed that in the course of conducting OPLAN BAKAL


at the said bar at around 4:00 AM of September 4, 2023, PCpl Arugay, who
noticed that Rico (CICL) did not lift his shirt as instructed instead tried to flee.
However, PCpl Arugay was able to prevent and stop him and noticed that
there was a bulk in his waist which appears to be a handle of a short firearm;

3. Due to the suspicious behavior of Rico Bang, PCpl Arugay asked the latter
about the bulging on his waist but he refused to answer and acted unruly,
after which he started frisking him and, in the process, he was able to seize
from his control and possession the following:

a. One (unit) .38 Revolver (Paltik/Homemade, Colt .38, made in USA


without serial number marked as “RB” 9-4-23;

b. Three (3) live ammunitions marked as “RB-1”, “RB-2” and “RB-3” with
date 9-4-23 respectively;

4. We informed the parents of Rico about his apprehension and instructed to


proceed to the Police Station and bring with them a copy of his Certificate of
Live Birth;

5. After several minutes, Mrs. Bang arrived and handed me a copy of Certificate
of Live Birth of Rico Bang showing that he was indeed 17 years old and was
born on February 14, 2006;

6. On the other hand, Pat Babad turned over to me his Body Worn Camera used
during the said operation and later extracted the video footages without
redaction to our office computer and also made a copy of it and save it in USB
Flash and marked it as “IDL 9/4/2023” in the presence of Rico and his mother;

7. That at around 5:30AM I, together with PCpl Arugay, PSSg Aquino and Pat
Babad turn over Rico Bang to CSWD for the determination of the presence
of discernment;

8. I also requested for firearm verification before the office of Firearm and
Explosive Office (FEO);
9. While waiting for the Certification coming from the CSWD and firearm
verification result, the owner of the bar, Ms. Ann C. Kits (Ann) and the waiter,
Mr. Tony Stark came in this office to support the filing of complaint against
Rico Bang to serve as witnesses;

10. Immediately thereafter, Ms. Ann Kits handed me a copy of the extracted
CCTV footage in a USB flash drive and marked it as “BJT 9/4/2023”;

11. At around 8:00 AM of September 4, 2023, CSWD Officer Ms Andi Naval


handed to me the Certification indicating that Rico acted with discernment;

12. Seized pieces of evidence were turned-over to MPDFU for Ballistics


Examinations at around 11 :00 AM of September 4, 2023. I received the result
of the said examination at around 12:00 PM indicating therein that the .38
caliber revolver and the three (3) .38 caliber cartridges recovered are
serviceable;

13. That I prepared the following documents:

a. Judicial Affidavit of Complaint/Arresting Officer


b. Affidavit of Body Worn Camera User
c. Sworn Statement of Witnesses
d. Affidavit of Investigator/Evidence Custodian

14. That I am executing this affidavit to attest the truthfulness of the foregoing
facts and in support of the filing of criminal case for Violation of Section 28
(a) in relation to Section 28 (e) (1) of RA 10591 against Rico Bang.

A: Because I personally saw the incident transpired inside the Thirsty Bar situated
at A. Mabini St., Malate, Manila, which is owned by me, at about 4:00 AM of
September 4, 2023, sir;

7. Q: Can you please narrate the incident?


A: Yes sir. At around 3:55 AM of September 4, 2023 while I was outside of Thirsty
Bar, a police officer (PCpl Argay) approached me and to inform that they will
conduct OPLAN BAKAL inside my bar and later on gave my permission to do so.;

8. Q: What happened next, if any?


A: I went inside the Thirsty Bar together with the police officers and I headed
towards the switch to turn on the lights. Then, I saw and heard the police officers
announced that they will conduct OPLAN Bakal and instructed the five (5) male
costumers who were left in the bar to stand and lift their upper garments. However,
one of the five male costumers, acted suspiciously and even me I saw him tried to
run, but he was grabbed by the police officer. Then and there, the police officer
asked him what is the bulging thing on his right waist and I saw Mr. Rico Bang
acted unruly and I saw that his upper garment slightly raised and I saw a handgrip
of a gun from his waist;

9. Q: What happened next, if any?


A: During the apprehension, I saw PCpl Arugay confiscated one (1) firearm from
his right waist. I also heard PCpl Arugay asked Rico Bang if he have the necessary
permit/legal document/s for possessing the said firearm but the latter failed to
present any and instead claims that he was 17 years old. Bang was subsequently
apprehended and was brought by the police officers to their mobile patrol;

10. By the way, how far are you when the police officer frisked Rico?
A: About three (3) meters away from them and I could clearly saw the incident sir;
11. Q: What happened next, if any?
A: PCpl Bon Jovy Torino also asked for a copy of CCTV footage during the
operation and I extracted a copy of the video footage from our CCTV and saved it
in a USB flash drive and gave it to him.

A: Because I witnessed the incident that happened inside the Thirsty Bar where I
work, Sir;

A: Yes sir. At around 4:00 AM of September 4, 2023 while I was on duty as waiter
of Thirsty Bar, I saw three (3) police officers together with our owner/manager, Ms
Ann Kits (Ms. Kits);

8. Q: What happened next, if any?


A: I saw Ms. Kits turned on the lights and the police announced themselves and
says that they will conduct OPLAN Bakal and instructed the customers to stand up
and lift their upper garments. However, one of the five male costumers, identified
later on as Rico Bang (Rico), did not lift his upper garment and when PCpl Arugay
about to approach the customer, he became anxious and tried to leave the bar but
was caught by PCpl Arugay and acted unruly. PCpl Arugay frisked him after
noticing a bulge in his waist and refusing to answer what it was.

9. Q: What happened next, if any?


A: During the frisking, PCpl Arugay was able to recover from the latter’s waist a
loaded short firearm. PCpl Arugay asked him if he have the necessary permit/legal
document/s for possessing the said firearm but the latter failed to present any. The
customer was subsequently apprehended and apprised of his constitutional rights
then rode the mobile patrol going to the police station;

conducted OPLAN BAKAL at Thirsty Bar situated at A. Mabini St., Malate, Manila
which resulted to the apprehension of one (1) CICL named Rico Bang, 17 years old,
(DOB: February 14, 2006), high school, student, and resident of A. Mabini St., Malate,
Manila for the possession of .38 Revolver (Paltik/Homemade with engrave Made in
USA and trademark Colt .38 without serial number loaded with three live ammunitions.
Prior to the apprehension, at around 3:55AM of same date, they coordinated with the
owner of Thirsty Bar named Ms. Ann Kits y Cabs, that they will conduct OPLAN
BAKAL. During the conduct of OPLAN BAKAL, PCpl Arugay, noticed one male
customer a bulging object tucked in his right part of his waist which appears to be a
handle of a short firearm prompting to approach him. When asked what was the object
that was bulging to his right part of his waist the latter did not answer and acted unruly
and suddenly his upper garment was slightly lifted and PCpl Arugay saw a handgrip
of a firearm. After which frisked the latter. On the process PCpl Arugay recovered from
the latter a .38 Revolver Paltik/Homemade with engrave Made in USA and trademark
Colt .38 without serial number which he later marked as “RB” 9-4-23, loaded with three
live ammunitions marked as “RB-1” to “RB-3” with date 9-4-23 respectively. The
operating personnel requested the male customer to show the pertinent documents to
possess the said firearm however he failed to present it which resulted to his
immediate apprehension.

The said CICL was brought to this station and later on to Ospital ng Maynila for
physical and subsequently brought to Women’s and Children Protection Desk of this
station for documentation.

On the other hand, confiscated pieces of evidence were turned over to the duty
investigator and evidence custodian PCpl Bon Jovy Torino. Lastly, the said CICL was
turned over to City Social Welfare and Development for disposition.

Minor, Rico Bang was allegedly accused of Violation of Sec 28 (a) in relation to
Sec e (1) of RA 10591 otherwise known as the Comprehensive Firearms and
Ammunitions Regulation Act. He was brought and referred to this office on September
4, 2023 and underwent for an intake interview and assessment of Discernment.
IV. HISTORY OF THE CASE

As per the interview of the minor, identified as Rico Bang y Tigas he relates
what happened to him on September 4, 2023 at about 4:00AM at Thirsty Bar located at
Malate, Manila. According to him, he was then with his four friends at the said bar,
having a good time when they noticed a group of Police Officers entered the bar to
conduct OPLAN BAKAL. One of the Police Officers instructed them to lift their upper
garments and saw from his waist a .38 caliber revolver that resulted to his
apprehension.

V. THE MINOR

Rico is skinny with a fair complexion. He is the eldest among three (3)
children of Protacio and Marina. He is not attending school.

VI. ECONOMIC BACKGROUND OF THE FAMILY

Minor’s father is a construction worker while his mother is a Barangay


health Worker in their barangay. His parents strive very hard to raise
their children and provide their basic needs. The family of the minor
belongs to one of the indigent families in the community. The family
dwells in a simple dwelling place.

VII. INITIAL ASESSMENT OF DISCERNMENT

Rico, 17 years old, got a score of 4.428 in the LEVEL OF MORAL


DEVELOPMENT. This suggests that he has a superior level of vale of
judgment wherein he tries to “get things right” to build a positive image
of himself. He can follow rules and regulations but see to it that it will
gain positive remark to him.

On the other hand, in the index of Value Judgment Tools, he got a score
of 53 which suggests that he has a SUPERIOR LEVEL OF
DISCERNMENT which means that he is fully aware in determining what
is right and wrong and could recognize the reality that society has rules
to be followed.

For the FAMILY FUNCTIONAL CHECKLIST, the result shows that the
tool interpretation is FUNCTIONAL FAMILY since he got a score of
3.142, hence, his level of discernment score of 80 which suggests that
his level of discernment is SUPERIOR.

His ability to discern may be associated with his functioning as an


individual got a score of 3.142; to the circumstances of his family and
that of his community. He may have been acquainted with peers who
are engaged in productive activities. Family functioning checklist also
indicates that his family is also functional and the community where he
resides may have a big population but there are groups of duty bearers
tasked to maintain peace and orderliness in their community.
VIII. RECOMMENDATION

The undersigned strongly recommend the minor to undergo intensive


Behavioral Therapy and Treatment in a Rehabilitation Center for Youth
as it provides a holistic and rehabilitative approach to promote the child's
rehabilitation, well-being, and reintegration into society. Through series
of appropriate programs and support services it increases the likelihood
of the child becoming a law-abiding and productive member of the
community.
